“The Native Land Court Act, 1894.”
IN THE NATIVE LAND COURT OF NEW ZEALAND,
AUCKLAND DISTRICT.
In the matter of the subdivision of Te Pure Block, Thames District, and of an application by Francis McCormick, of Puru, farmer, under section 39 of “The Native Land Court Act, 1894.”
WHEREAS the said application was referred by me to the Native Land Court for inquiry and report, and such inquiry was held at Shortland on the 2nd day of June, 1898, before Herbert Frank Edger, Esq., a Judge of the said Court: And whereas, as the result of such inquiry, it appeared that at the time of the subdivision of the said block it was concealed from the Court that certain of the owners had sold their interests to the applicant, and that by reason of such concealment, and of the omission to give notice to the applicant, the block was unfairly divided: Now, therefore, for the purpose of remedying such omission, and in exercise of the powers vested in me as Chief Judge of the Court by section 39 aforesaid, I hereby order that the subdivision of the said block made by the Native Land Court on the 5th day of June, 1897, be and the same hereby is annulled: And I further order that a new subdivision of the said land be made upon the application of any of the persons entitled, such new subdivision to take effect in substitution for the subdivision made on the 5th day of June, 1897, as if the same had been made on that date; and, further, that the land awarded in substitution for Te Pure B shall bear the same name, and shall be subject to all orders which have been made by the Court in respect of the succession to Raika Whakarongotai and the appointment of trustees for such of his successors as are minors. I direct that this order be notified in the Gazette and Kahiti.
As witness my hand, this 17th day of June, 1898.
GEO. B. DAVY, Chief Judge.
Waimarino Block.
[Wellington, 98–39.] Registrar’s Office, Wellington, 23rd June, 1898.
Inquiry under section 49 of “The Native Land Laws Amendment Act, 1895.”
WHEREAS complaint has been made by Tira Koroheke that he has been deprived of his interest in the said block by reason of the mistake of the Native Land Court in substituting the name of one Hira Hinekura for that of Hohepa Taurerewa as trustee: Notice is hereby given that the said complaint will be inquired into by the Native Land Court sitting at Whanganui on Monday, the 11th day of July, 1898. All persons interested are hereby notified to attend.
