Notice of Intention to take Land compulsorily under “The Land for Settlements Act, 1894.”

NOTICE is hereby given that it is intended, on behalf of Her Majesty, to take compulsorily, under the provisions of “The Land for Settlements Act, 1894,” the land commonly known as the “HATUMA” ESTATE, whose acreage, description, and classification, as also the names and addresses of whose owners, are specified in the Schedule hereto.

SCHEDULE.

  1. ACREAGE and Description.—All that area in Hawke’s Bay Land District, containing by admeasurement 26,371 acres, more or less, situated in the Waipukurau, Motuataria, and Takapau Survey Districts. Bounded towards the north generally by the Makaretu and Tukituki Rivers; towards the south-east generally by Blocks Nos. 16 and 89, the Ngahape Stream, Sections Nos. 36 and 35, the Mangapora Stream, parts of Blocks Nos. 44 and 36, and the Turaekaitai Stream; and towards the west generally by Blocks Nos. 83 and 69, and the Maharaeke Stream.

Also, all that area in the Hawke’s Bay Land District, containing by admeasurement 756 acres, more or less, situated in Takapau Survey District. Bounded towards the north-east generally by Block No. 69; towards the south-east generally by Block No. 83; towards the south-west by the Waikopiro Stream; and towards the north-west by Block No. 69 aforesaid: as the said estate is delineated on the plan marked S.G. 19152, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Wellington Land District.

  1. The Minister’s Classification of the Land.—
    First class: Sections Nos. 31, 88, part 48, part 37, 49, part 73, part 78, 52A, part 65, part 66, part 34, part 51, part 54, 36, 53, 35, part 50, part 46, part 47 .. .. .. 10,000
    Second class: Sections Nos. part 48, part 37, 52, 32, 33, part 34, part 51, part 54, part 50, part 73, part 78, part 65, part 66, part 46, part 47 .. .. .. 14,412

The area of each class being shown on the said plan in distinctive colours.

  1. The land intended to be taken is the whole of the estate.

  2. Names and Addresses of the Owners of the Estate.—The owners in fee-simple are,—
    (a.) As to portion of the estate, to wit, 22,770 acres, being Sections Nos. 37, parts of 36 and 44, 35, 46, 47, 50, 65, 70, 80, 81, 82, 32, 33, 51, 52, 52A, 34, 36, 37, part 48, part 49, 53, 54, 66, 73, 78, 88, as shown on said plan: Thomas Purvis Russell, of “Hatuma,” Waipukurau, Hawke’s Bay, New Zealand, and of Warrock, Milnathort, Scotland, who is the beneficial owner of the said portion.

(b.) As to the residue of the estate, to wit, 4,357 acres, being Section 31, and portion of Sections 48 and 49, as shown on said plan: George Edward Sainsbury, of Napier, solicitor; Henry Hamilton Bridge, of Fairfield, Ruataniwha, Hawke’s Bay, sheep-farmer; Thomas Hughes Gibbons, of Lostwithiel, Cornwall, civil engineer; Francis John Sainsbury, of Berkley Place, Camden Hill, Bath, Esquire; Herbert Elphinstone Montgomery, of Hatton Burn, North Britain, Esquire; and James Edward Hope, of No. 10, Magdala Crescent, Edinburgh, Writer to the Signet; who hold the said residue as trustees, under and subject to the trusts and provisions of the following deeds of marriage-settlement, that is to say: Deed dated the 5th day of July, 1859, and made on the marriage of the said Thomas Purvis Russell with Mary Glass Sainsbury; and also deed dated the 5th day of September, 1882, made on the marriage of Henry James Montgomery, of Hatton Burn, North Britain, with Mary Maud Russell. By the provisions of the said deed the said Thomas Purvis Russell and his said wife are life-tenants of the said residue, and the said trustees hold such under and subject to such life-tenancy.
