Application to the Validation Court under "The Native
Land (Validation of Titles) Act, 1893."
IN THE VALIDATION COURT,
GISBORNE.
In the application of the Honourable James Carroll and
Wiremu Pere, both of Gisborne, in the Provincial Dis-
trict of Auckland, for the validation of a charge claimed
by them upon the Mangatu No. 1 Block, situate in the
County of Cook and the Native Land Court District of
Gisborne.
A. WE, James Carroll and Wiremu Pere, both of
Gisborne, members of the House of Repre-
sentatives of New Zealand, apply under "The Native Land
(Validation of Titles) Act, 1893," for the validation of
a claim for moneys advanced by the New Zealand Native
Land Settlement Company (Limited) to the Native owners
of the Mangatu No. 1 Block, containing 100,000 acres, more
or less (the original title to which was a memorial of owner-
ship), in or about the year 1883, on account of the said land.
The amount which we claim to be charged against the said
land is the sum of £2,000, and interest thereon from the
year 1882.
B. We desire to appear before the Validation Court at
Gisborne on Monday, the 15th day of February, 1897, at the
hour of 10 o'clock in the forenoon, or so soon thereafter as
counsel can be heard.
C. The nature of the transaction proposed for validation
is the securing of the sum of £2,000 so advanced by the said
company to the said Native owners, together with interest
thereon from the year 1888.
D. The manner in which and the persons or companies
through whom we claim to hold the said charge are as fol-
low:—
(1.) Mortgage, dated the 3rd day of July, 1888, from the
New Zealand Native Land Settlement Company
(Limited) to the Bank of New Zealand.
(2.) Transfer, dated the 5th day of August, 1890, of the
above mortgage from the Bank of New Zealand
to the Bank of New Zealand Estates Company
(Limited).
(3.) Transfer, dated the 10th day of July, 1891, from the
Registrar of the Supreme Court of New Zealand
at Gisborne to the Bank of New Zealand Estates
Company (Limited).
(4.) Agreement, dated the 17th day of February, 1892,
between the Bank of New Zealand Estates Com-
pany (Limited) of the first part, William Lee Rees
of the second part, and James Carroll and Wiremu
Pere of the third part.
E. The estate or interest in the said land which we seek
to obtain from the said Court is an estate by way of mort-
gage, or such other estate as to this honourable Court may
seem meet.
F. Our address for service in the Town of Gisborne is at
the office of William Lee Rees, solicitor, in Gladstone
Road.
G. We desire the estate and interest of the corporation
known as Mangatu No. 1, together with the estates and
interests of the Native owners of the said land, and also
the Public Trustee, to be bound by the decrees of this Court,
and for that purpose require that copies of this application
be served on them or their representatives according to the
list herewith, and we desire that all others who may claim
to be interested in this matter shall be treated as parties to
these proceedings.

IN THE VALIDATION COURT,
AT GISBORNE.
In the matter of "The Native Land (Validation of Titles)
Act, 1893," and the amendments thereof, and in the mat-
ter of the block or parcel of land known as Waiaranga
No. 2, and in the matter of the application of James
Nelson Williams.
- JAMES NELSON WILLIAMS, of Frimley, in the Pro-
vincial District of Hawke's Bay and Colony of New
Zealand, sheep-farmer, desires to appear before the Valida-
tion Court at Gisborne on Wednesday, the 17th day of
February, 1897, at the hour of 10 o'clock in the forenoon,
and to ask that the undivided estates and interests of Kere-
ama Kaipara, Hone Heke, Raniera Tuhua, Ihehu Haki,
Horomona Hapai, Pita Rongo, Pipi Taweka, Renata Hape,
Eparaima Uruika, Wiki Tirore, Aramata Pongahuru, Riwia
te Haua, Mere Ruawahine, Pekama Pahuru, Irihapete Poi-
hakena, Wiremu te Urupa, Hori Matamua, Hori Pikoi,
Himiona te Moana, Mokana Horua, Mere Tauiwi, Herewini
Tamahori, Iritana Iriwaho, Pipi te Manga, Pine Tipuna,
Eruera Kupenga, Apirana Tatua, Peta te Wa, Winiata
Taniwha, Himiona Tiwhatiwha, Popata Pikihua, Marara
Takanini, Harata Taheke, Hiria Tehaikoko, Erana Rauhaere,
Hirini Tenate, Raiha Kamau, Iritana Horua, Maraea Wha-
kaki, Hohepa Taiha, Wiremu Ngara, Himiona Hapai, and
Makere te Rahikoia in the parcel or block of land situate in
the Provincial District of Auckland, containing by ad-
measurement 216 acres 1 rood 15 perches, more or less, and
known as the Waiaranga No. 2 Block, transferred, conveyed,
and assured by the said aboriginal natives to one Herewaka
Poata, of Gisborne aforesaid, aboriginal native woman, by
deed of conveyance dated the 2nd day of October, 1882, in
consideration of the sum of £2 10s. paid by the said Here-
waka Poata to each of the said aboriginal natives, and that
the estate and interest of the said Herewaka Poata, trans-
ferred by the said Herewaka Poata to the applicant by
memorandum of transfer dated the 29th day of December,
1896, in consideration of the sum of 5s. paid by the applicant
to the said Herewaka Poata, be vested in the applicant for
an estate in fee-simple in possession free from encumbrances.

At the time of the alienation witnessed by the said
conveyance of the 2nd day of October, 1882, the title to
the said land was memorial of ownership, and the said
aboriginal natives, vendors in the said conveyance, were
owners of the said Waiaranga No. 2 Block. The title to the
said block is now under "The Land Transfer Act, 1885,"
being a customary title within the meaning of "The Native
Land Court Act, 1894." By the said customary title, which
bore date the 30th day of April, 1880, the said parcel of land
was vested in Kereama Kaipara, Hone Heke, Tuta Nihoniho,
Raniera Tuhua, Ihehu Haki, Horomona Hapai, Reupena te
Ana, Heni Nohoaka, Pita Rongo, Hoana Whakama, Pipi
Taweka, Renata Hape, Eparaima Uruika, Wiki Tirore,
Aramata Pongahuru, Tamihana Kakano, Erueti Rena,
Riwai te Haua, Mere Ruawahine, Pekama Pahuru, Irihapeti
Poihakena, Wiremu te Urupa, Hori Matamua, Hari Pikori,
Himiona te Moana, Mokena Horua, Hati Taitua, Hari
Maruata, Mere Tauiwi, Herewini Tamahori, Iritana Iriwaho,
Pipi te Manga, Hori Peita, Pine Tipuna, Emara Kupenga,
Apirana Tatua, Makere te Rahikoia, Peta Tewa, Mereana
Nihoniho, Winiata Taniwha, Himiona Tiwhatiwha, Popata
Pikihua, Marara Takaanini, Harata Taheke, Hiria Tehai-
koko, Erana Rauhaere, Hirini Tenati, Raiha Kamau, Iritana
Horua, Maraea Whakaki, Hekiera Taurare, Wiremu Ngara,
Himiona Hapai, Mere Whariki. -
The estate or interest in the said parcel of land which
the applicant seeks to obtain through the aid of the Court is
a freehold which was vested in the said Herewaka Poata by
the said deed of conveyance of the 2nd day of October, 1882,
and was transferred by the said Herewaka Poata to the
applicant by memorandum of transfer bearing date the 29th
day of December, 1896. -
The applicant names the office of Messrs. Nolan and
Skeet, solicitors, in Gisborne, as the place where notices,
orders, and other documents may be served upon the appli-
cant by leaving the same at such place for him. -
The applicant names the said Herewaka Poata and
Kereama Kaipara, Hone Heke, Raniera Tuhua, Ihehu Haki,
Horomona Hapai, Pita Rongo, Pipi Taweka, Renata Hape,
Eparaima Uruika, Wiki Tirore, Aramata Pongahuru, Riwia
te Haua, Mere Ruawahine, Pekama Pahuru, Irihapeti Poi-
hakena, Wiremu te Urupa, Hori Matamua, Hari Pikoi,
Himiona te Moana, Mokana Horua, Mere Tauiwi, Herewini
Tamahori, Iritana Iriwaho, Pipi te Manga, Pine Tipuna,
Eruera Kupenga, Apirana Tatua, Peta te Wa, Winiata
Taniwha, Himiona Tiwhatiwha, Popata Pikihua, Marara
Takanini, Harata Taheke, Hiria Tehaikoko, Erana Rau-
haere, Hirini Tenate, Raiha Kamau, Iritana Horua, Maraea
Whakaki, Hohepa Taiha, Wiremu Ngara, Himiona Hapai,
and Makere te Rahikoia as the persons upon whom the
applicant requires that a copy of this application be served.
