Consenting to Land being taken for Main Road in the Horowhenua County.

ORDER IN COUNCIL.
At the Government House, at Wellington, this fourteenth day of June, 1897.
Present:
HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.
WHEREAS by “The Public Works Act, 1894” (hereinafter termed “the said Act”), it is, in section fourteen thereof, inter alia, enacted that nothing shall authorise the taking of any land occupied by any building, yard, garden, orchard, or vineyard, or in bonâ fide occupation as an ornamental park or pleasure-ground, without the previous consent of the Governor in Council:
And whereas an application has been made by the Horowhenua County Council that certain land described in the Schedule hereto, which land is occupied by a garden and orchard, may be taken for the main road:
Now, therefore, His Excellency the Administrator of the Government of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the land described in the Schedule hereto being taken by the said County Council for the purposes of the said main road.

ORDER IN COUNCIL.

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.
WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work, to wit, the construction of a main road at Waikanae, through Block IX., Kaitawa Survey District:
And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown:
And whereas a map in duplicate has been prepared of the said land by the Horowhenua County Council, as required by the eighty-eighth section of “The Public Works Act, 1894”:
Now, therefore, in pursuance and exercise of the powers vested in him by the eighty-eighth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Administrator of the Government of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the land shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purpose of the said road, and the said land shall vest in Her Majesty the Queen as from the seventeenth day of June, one thousand eight hundred and ninety-seven.

In New Zealand Gazette No. 1, page 22, in Schedule to Warrant of 19th December, 1896, temporarily reserving lands for various purposes, and in New Zealand Gazette No. 41, page 937, in Schedule to Warrant of 28th April, 1897, permanently reserving lands, for “Section 30, Waiwera Parish, containing 1a. 2r. 30p., reserved for a public landing reserve,” read “Section 30, Okura Parish,” &c.
