Powers delegated to the Hurunui Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this third day of May, 1897.

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.

IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Administrator of the Government of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twenty-first day of January, one thousand eight hundred and eighty-four, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present Order, delegate, but only with respect to the parcel of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Hurunui Domain Board, namely,—

ROBERT RONALD MANNING,
EDWIN HENRY BROOKER,
MICHAEL JOHN BURKE,
ARCHIBALD EARSHMAN,
CYRIL THOMAS WHITE, and
Colonel FRANCIS JOHN FOX

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the third Saturday in each month, at the Schoolhouse, Medbury, at 2.30 o’clock p.m., or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Saturday, the fifteenth day of May, one thousand eight hundred and ninety-seven.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting, and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the third Saturday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

  6. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

SCHEDULE.

ALL that parcel of land in the Canterbury Land District, containing by admeasurement 85 acres 2 roods, more or less, being Reserve No. 2598, situate in the Waipara and Waikari Survey Districts. Bounded towards the north-east by the terrace north-east of the racecourse; towards the west by Reserve No. 198, 1857 links; and towards the south and south-west by road-lines, a distance altogether of 5794 links: be all the aforesaid linkages more or less; as the same is delineated on the plan deposited in the District Survey Office, Christchurch.

Validating Election of Native Assessor under Licensing Acts.

ORDER IN COUNCIL.

At the Government House, at Wellington, this third day of May, 1897.

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.

WHEREAS by section two hundred and twenty-seven of “The Licensing Act, 1881” (herein termed “the said Act”), it is provided that, if, through any accidental or unavoidable impediment, misfeasance, or omission, anything required by the said Act to be done is omitted to be done, or is not done within the time fixed, the Governor in Council may take all such measures as may be necessary for removing such impediment or rectifying such misfeasance or omission, and may validate anything which may have been irregularly done in matter of form, so that the intent and purpose of the Act may have effect:

And whereas in the month of February last the Returning Officers omitted to hold elections of Assessors for the Native Licensing Districts of Waioeka and Taupo, but such elections were held on the ninth day of April and the thirteenth day of April instant, and Paora Pakihi and Reweti te Rakaherea were then duly elected Assessors for the said districts of Waioeka and Taupo respectively: And whereas it is expedient to validate such elections:

Now, therefore, His Excellency the Administrator of the Government of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred by the said Act, and of all other powers enabling him in this behalf, and by and with the consent of the Executive Council of the said colony, doth hereby validate the said elections of Paora Pakihi as the Assessor for the Native Licensing District of Waioeka, and Reweti te Rakaherea as the Assessor for the Native Licensing District of Taupo.

Extending Time for Preparation of Burgess Roll, Borough of the City of Auckland.

ORDER IN COUNCIL.

At the Government House, at Wellington, this third day of May, 1897.

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.

WHEREAS it has been made to appear that certain things required to be done by “The Municipal Corporations Act, 1886,” in connection with the making and revision of the burgess lists or rolls of the Borough of the City of Auckland cannot be done by or within the time required by the said Act: Now, therefore, His Excellency the Administrator of the Government of the Colony of New Zealand, in exercise and pursuance of the powers and authorities vested in him by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby extend the time for the doing of the said things in connection with the burgess lists or rolls of the said Borough of the City of Auckland, and doth declare that the times for the doing of such several things shall be those which are specified in the Schedule hereunder.

SCHEDULE.

  1. Burgess list to be made out on or before the 20th May, 1897.

  2. Burgess and defaulters’ list open for inspection, and delivery of objections thereto, until the 4th June, 1897.

  3. Inspection of lists of objections, from the 5th June, 1897, to the 14th June, 1897.

  4. Sitting of Council to determine claims and objections, between the 15th and 29th June, 1897.

  5. Burgess roll to come into force on the 2nd August, 1897.
