Allocating Land reserved and taken for a Railway to the Purposes of a Road in Riccarton Road District.

A PROCLAMATION.

WHEREAS the land mentioned in the Schedule hereto forms part of land taken for the purposes of the Hurunui–Waitaki Railway, and it is considered desirable to allocate such land to the purposes of a road:

And whereas it has been certified by the Minister for Railways that such land is not required for railway purposes:

And whereas such land is situated in the Riccarton Road District, the local authority of which has consented to the issue of this Proclamation:

And whereas His Excellency the Administrator of the Government is of opinion that the said local authority can conveniently construct and maintain the said road:

Now, therefore, I, James Prendergast, the Administrator of the Government of the Colony of New Zealand, in exercise and pursuance of the powers and authorities in me vested by section one hundred and seventy-seven of “The Public Works Act, 1894,” and of every other power and authority in anywise enabling me in that behalf, do hereby proclaim and declare that the land described in the Schedule hereto shall, upon the publication hereof in the New Zealand Gazette, become a road, and that the said road shall be under the control of the Riccarton Road Board, and shall be maintained by the said Board in like manner as other public highways are controlled and maintained by the said Board.

SCHEDULE.

All that area in the Canterbury Land District, in the Christchurch Survey District, containing 2 acres 1 rood 9 perches, more or less, situate near Riccarton Station on the said Hurunui–Waitaki Railway, being part of Rural Section 163, in Block XI., in said survey district, and being bounded as follows: Commencing at the junction of the east side of the railway land with the north side of the Riccarton Road; thence northerly, following the east side of the railway land, distances of 66 links and 1540 links; thence easterly, northerly, north-easterly, and easterly, following the boundary of the railway land, distances of 50 links, 300 links, 116 links, 514 links, and 1000 links, to the west side of the Park Road; thence northerly, along the west side of the Park Road, to the north boundary of the railway land; thence westerly, along the north boundary of the railway land, distances of 1000 links and 657 links, to its junction with the east side of the railway land; thence southerly, in a straight line, a distance of 309 links, to a point distant 66 links from the east side of the railway land; thence southerly, in a line parallel to and 66 links distant from the east side of the railway land, a distance of 100 links; thence south-westerly, in a straight line, a distance of 109·8 links, to a point distant 50 links from the east side of the railway land; thence southerly, in a line parallel to and 50 links distant from the east side of the railway land, a distance of 1550 links, to the north side of the Riccarton Road; and thence easterly, following the north side of that road, a distance of 36 links, to the commencing-point: as the same parcel of land is more particularly delineated upon the plan marked 7176, deposited in the office of the Minister for Railways, at Wellington, and thereon coloured purple.

Given under the hand of His Excellency Sir James Prendergast, Knight, Chief Justice, Administrator of the Government in and over Her Majesty’s Colony of New Zealand and its Dependencies, at the Government House, at Wellington; and issued under the Seal of the said Colony, this twenty-third day of March, in the year of our Lord one thousand eight hundred and ninety-seven.
