Land (Vali dation of Titles) Act, 1893. "

IN THE VALI DATION COURT,
Gis borne.
In the application of the Honourable James Car roll and
Wiremu P ere, both of Gis borne, in the Provin cial District
of Auck land, for vali dation of interests claimed by them
in the M atarau No. 1 Block, situate in the Nati ve Land
Court District of Gis borne.

A. W E, James Car roll and W i remu P ere, both of Gis -
borne, members of the House of Representatives
of New Zea land, apply under " The Nati ve Land (Vali dation
of Titles) Act, 1893," for the vali dation of a contract made
between the owners of the M atarau No. 1 Block (which said
block of land is situate in the Nati ve Land Court District of
Gis borne, and contains 345 a c res 2 ro ods 38 perches, more or
less) and the New Zea land Nati ve Land Settle ment Com -
pany (Lim ited).

B. We desire to appear before the Vali dation Court on the
5th day of April, 1897, at the hour of half - past 10 o'clock in
the forenoon, or so soon there after as counsel can be heard
in that beha lf.

C. The nature of the transaction proposed for vali dation is
a contract made on or about the day of , 1883,
between the owners of the M atarau No. 1 Block and the New
Zea land Nati ve Land Settle ment Company (Lim ited) for the
transfer to the said company by the owners of the said land
of the said block of land, in trust for the Nati ve owners
thereof, in accordan ce with the articles of association of the
said company. The said company, in accordan ce with the
said contract, expended large sums of money on beha lf of
the said owners, and made advance s to the said owners in
pursuance of the said contract in connection with the said
land.

D. The land which was intended to be alie nated by the
above - mentioned contract was the block of land called or
known as the M atarau No. 1 Block, above described, the
original title to which is a memorial of ownership under
the Nati ve Land Court A cts, 1873 and 1874, bea ring date
the 12th day of June, 1876.

E. The estate in the said land which we seek to obtain
from the said Court is an estate in fee - simple.

F. The manner in which and the persons through whom
we came to be inve sted with the title to the said land which
we now hold are as follow:—
(1.) Contra c t as above set out between the Nati ve
owners of the said M atarau No. 1 Block and
the New Zea land Nati ve Land Settle ment Com -
pany (Lim ited).
(2.) Memoran dum of mortga ge, da te d the 3rd day of
July, 1888, by the said New Zea land Nati ve
Land Settle ment Company (Lim ited) to the
Bank of New Zea land.
(3.) Memoran dum of transfer, da te d the 5th day of
August, 1890, by the said Bank of New Zea land
to the Bank of New Zea land Estates Company
(Lim ited).
(4.) Memoran dum of transfer, da te d the 10th day of
July, 1891, by the Regi strar of the Supreme Court
of New Zea land at Gis borne to the said Bank of
New Zea land Estates Company (Lim ited).
(5.) Memoran dum of agree ment, da te d the 17th day of
February, 1892, between the Bank of New Zea -
land Estates Company (Lim ited) of the first part,
William Lee Rees, of Gis borne, soli citor, of the
second part, and ourselves (the applica nts) of the
third part.

G. Our address for service in the Town of Gis borne is at
the office of Mes srs. Rees and Day, soli citors, in Gladstone
Road.

H. We desire the estates and interests of the Nati ve owners
of the said land, and the estates and interests of all the
several parties mentioned in paragraph F of this applica -
ti on, through whom we claim, to be bound by the decrees of
this Court, and for that purpose require that copies of this
applica ti on be served on them or their repre sentatives ac -

between the owners of the M atarau No. 2 Block (which said

Gis borne, and contains 405 a c res 2 ro ods 16 perches, more or
less) and the New Zea land Nati ve Land Settle ment Com -
pany (Lim ited).

B. We desire to appear before the Vali dation Court on the
