Notice of Request to Amend Specification, &c.

Patent Office,
Wellington, 3rd February, 1897.

A REQUEST for leave to amend the specification (including drawings) of Letters Patent No. 2388, of 14th June, 1887, granted to Henry Ely Shacklock, of Dunedin, New Zealand, Ironfounder, for an invention entitled “Locked and Curved Furnace-mountings,” together with the memorandum of alterations (including drawings) in connection therewith, has been received, and is open to public inspection at this office. Any person may, at any time within one month from the date of this Gazette, give me notice in writing of opposition to the amendments. Such notice must set forth the particular grounds of objection, and be in duplicate. A fee of 10s. is payable thereon.

The following is a copy of such request, viz:—
“In the matter of ‘The Patents, Designs, and Trade Marks Act, 1889.’
“Whereas Her Majesty the Queen, by Letters Patent issued under ‘The Patents Act, 1883,’ under the seal of the Colony of New Zealand, and bearing date the 14th day of June, 1887, granted to me, Henry Ely Shacklock, special license and authority to make, use, and vend a certain invention for locked and curved furnace-mountings within the said colony and its dependencies for the term of fourteen years computed from the date of the said Letters Patent: And whereas my application for the said Letters Patent was accompanied by specification and drawings: And whereas, pursuant to the provisions of ‘The Patents, Designs, and Trade-marks Act, 1889,’ I applied for, and on the 17th day of April, 1888, obtained, leave to amend the said specification and drawings, and the same were amended accordingly: And whereas, by the decision of his Honour Mr. Justice Williams, in an action, number 2486, in the Supreme Court of New Zealand, Otago and Southland District, at Dunedin, wherein I was plaintiff and Richard Brinsley and Alexander George Christopher were defendants, it appears that some of the matters which I have by the said specification and drawings, and the matters which I have by the writing and drawing setting forth the said amendment, claimed as my inventions were or are not proper subject-matter for Letters Patent: And whereas I am desirous of amending in manner hereinafter appearing the said original specification and drawings upon which the said Letters Patent were granted, and the writing and drawing setting forth the said amendment:
“Now I request leave to amend the said original specification and drawings, and the said writing and drawing, as follows:—
“By disclaiming as my invention, as I hereby do, all matters claimed by me as inventions in the said original specification and drawings, and the said amending writing and drawing, save and except the construction as shown in the drawings thereof which accompanied my said application for Letters Patent of a furnace-door frame with flat instead of bevelled flanges projecting in front of the frame in combination with the locking-together by a locking device of the frame and grate.
“For the purpose of clearly illustrating the effect of the proposed amendment upon the said original specification and drawings, and the said amending writing and drawing, I strike out the whole of the said amending writing and drawing, and I annex hereto a copy of the said original specification and drawings, and struck out all the said drawings except those enclosed in a square of red-ink lines; and I have amended the said specification in red ink.
“And I say I claim as my invention of improvements in furnace-mountings the construction of a furnace-door frame with flat flanges projecting in front of the frame, in combination with the locking-together by a dovetail device of the frame and grate, and I limit my claim accordingly.
“Dated at Dunedin, this 20th November, 1896.
“H. E. SHACKLOCK.”

The proposed amendments, shown in red in the copy accompanying the request, are as follows, viz:—
(1.) To strike the words “and curved” out of the title.
(2.) To so amend the whole of the descriptive portion of the specification that it shall read as follows, viz.:—
“This invention consists of improvements in furnace-mountings, constructed as shown in the drawings enclosed within a square of red-ink lines, and to be called or known as ‘L Mountings,’ L meaning locked.
“The novelty and some advantages of this invention are that the articles are in several respects better adapted for the purposes for which they are made than other patterns previously in use.
“The frame will stand erect as shown without other support; the bottom and top flanges allow of the flat surfaces of the brick-setting being brought into close contact with the said flanges, thereby giving neater and stronger work than other patterns at present in use. Should brickwork get out of repair the ironwork will continue to hold together and remain in position as shown.”
