Kauri Timber, Auckland, for Sale by Public Auction.

Auckland, 1st December, 1896.

IT is hereby notified that the under-mentioned kauri timber, standing upon Section 31, Parish of Oruru, Mangonui County, will be offered for sale by public auction, at this office, on Friday, the 22nd January, 1897, at 11 o’clock a.m. :—

103 kauri-trees, containing 510,612 superficial feet approximately. Upset price, £255 6s.

Conditions of Sale.—One-half the purchase-money to be paid in cash or marked cheque on the fall of the hammer, the balance within twelve months thereafter. Two years from date of sale allowed for removal of timber.

Native Land Court Notices.

Application to the Validation Court under “The Native Land (Validation of Titles) Act, 1893.”

IN THE VALIDATION COURT,
HOLDEN AT GISBORNE.

In the application of the Honourable Sir George Stoddart Whitmore for validation of a contract for sale to him of the undivided shares and interests of Henare Potae in the Matakawa, Ahioteatua, Rotokautuku, Tawiti, Tokomaru, Taumatapatiti, Tauwhareparae Nos. 1 and 2, Kourateuhi, Marahea, and Anaura Blocks, situate in the Gisborne District.

THE Honourable George Stoddart Whitmore, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, of Clive, Hawke’s Bay, sheep-farmer, desires to appear before the Validation Court at Gisborne, on Monday, the 15th day of February, 1897, at the hour of half-past 10 o’clock in the forenoon, and to ask that the divided and undivided estates, shares, and interests of Henare Potae, of Tokomaru, in the District of Poverty Bay, aboriginal native, in the under-mentioned blocks of land, conveyed to him, the said George Stoddart Whitmore, by deed of conveyance bearing date the 12th day of January, 1886, made between Carlaw Smith, as creditors’ trustee in bankruptcy of the property of the said Henare Potae, of the one part, and the said George Stoddart Whitmore of the other part, in consideration of the sum of £353, be vested in him, the said George Stoddart Whitmore, as of an estate in fee-simple.

The title of the said Henare Potae at the time of the said alienation was a memorial of ownership issued by the Native Land Court.

The blocks of land above referred to are the Matakawa Block, the Te Ahioteatua Block, the Rotokautuku Block, the Tawhiti Block, the Tokomaru Block, the Taumatapatiti Block, the Tauwhareparae Nos. 1 and 2 Blocks, the Kourateuhi Block, the Marahea Block, and the Anaura Block.

The applicant requires that a copy of this application shall be served on the executors of the estate of the said Henare Potae.

The address for service of the applicant in Gisborne is at the office of Hugh Joseph Finn, his solicitor, situate in Gladstone Road.

Application to the Validation Court under “The Native Land (Validation of Titles) Act, 1893.”

IN THE VALIDATION COURT,
AT GISBORNE.

In the matter of the Piritarau No. 1 Block.

A. SIR GEORGE STODDART WHITMORE, of Napier, a member of the Legislative Council of New Zealand, applies for the validation of the shares and interest acquired by him, as appears by the documents of title hereinafter mentioned, of five Natives in all that piece of land situated in the Gisborne Native Land Court District, containing by admeasurement 7 acres 1 rood 27 perches, more or less, being the land called or known as the Piritarau No. 1 Block.

B. The applicant desires to appear before the Validation Court at Gisborne on Monday, the 1st day of February, 1897, at the hour of 10.30 o’clock in the forenoon, or as soon thereafter as this application can be heard.

C. The nature of the transactions proposed for validation is certain contracts for sale of land by the following deeds :—

Conveyance, dated 2nd August, 1880, from Wi Haereroa to Rawinia Mirina.

Conveyance, dated 31st August, 1880, from Eru Hauraki to Rawinia Mirina.

Conveyance, dated 28th June, 1880, from Te Raana te Ao and Hera Heihi to W. B. and E. Milner.

Conveyance, dated 31st February, 1890, William Milner (as trustee for W. B. and E. Milner, the successors to Rawinia Mirina) to the applicant.

D. The interest in land which is intended to be alienated by the above-mentioned deeds is the fee-simple of the whole of the shares and interests in the said block of the Native persons executing the same; and the title to the said block at the time of such alienation was a memorial of ownership issued by the Native Land Court for the said district, and dated the 14th day of June, 1876, in favour of sixteen Natives.

E. The applicant seeks to obtain through the aid of this Court an estate in fee-simple in the said land.

F. The applicant claims to be invested with the title he now holds through the following documents :—

(1.) The deeds set out in paragraph C hereof.

(2.) Agreement, dated the 21st day of February, 1890, between William Milner and the applicant.

G. The address for service of the applicant is at the office of Messrs. Nolan and Skeet, solicitors, off Gladstone Road, Gisborne.

H. The applicant desires that copies of this application be served upon the said Maori alienors or their representatives, and upon William Milner, of Awanui, hotelkeeper, and upon all other persons interested in the said block.

Application to the Validation Court under “The Native Land (Validation of Titles) Act, 1893.”

In the matter of the application of Arthur Fownes Somerville for validation of a contract for mortgage affecting the shares and interests of Tuta Nihoniho in the Makarika, Taoroa, and Te Ahioteatua Blocks.

A. ARTHUR FOWNES SOMERVILLE, of Dinder Wells, Somerset, England, barrister-at-law, applies for the validation of a certain deed of mortgage dated the 26th day of February, 1890, and made between one Tuta Nihoniho of the one part and William Fownes Somerville of the other part, affecting the estate, shares, and interests of the said Tuta Nihoniho in,—

Firstly, all that piece of land, situated in the Gisborne Native Land Court District, containing by admeasurement 1,298 acres, more or less, called or known as the Makarika Block.

Secondly, all that piece of land, situated as aforesaid, containing by admeasurement 4,330 acres, more or less, called or known as the Taoroa Block.

Thirdly, all that piece of land, situated as aforesaid, containing by admeasurement 2,455 acres, more or less, called or known as the Te Ahioteatua Block.

B. The applicant desires to appear before the Validation Court at Gisborne on Monday, the 8th day of February, 1897, at the hour of 10.30 o’clock in the forenoon, or as soon thereafter as this application can be heard.

C. The nature of the transaction proposed for validation is the before-mentioned deed of mortgage.

D. The interest in land which is intended to be alienated is a mortgage over the estate, shares, and interests of the said Tuta Nihoniho in the before-mentioned blocks of land, charging the same with payment of the sum of £115 and interest thereon, as provided by the said deed of mortgage.

E. The applicant seeks to obtain, through the aid of this Court, a valid mortgage affecting the estate, shares, and interests of the said Tuta Nihoniho in the said blocks of land.

F. The applicant claims to be invested with the title he now holds through the following deeds :—

(1.) The said deed of mortgage.

(2.) Deed of dissolution of partnership dated the 15th day of April, 1896, and made between William Fownes Somerville of the one part and the applicant of the other part.

G. The address for service of the applicant is at the office of Messrs. Nolan and Skeet, solicitors, off Gladstone Road, Gisborne.

H. The applicant desires that copies of this application be served upon the said Tuta Nihoniho.
