*Application to the Valdation Court under "The Ntive
Lad (Valdation of Tites) Act, 1893.**
IN THE VALDATION COURT,
HOLDEN AT GISBORNE.
In the matter of "The Ntive Land (Valdation of Tites)
Act, 1893"; and in the matter of the Paitu No. 4 Block.
A. I, WLLAM COOER, of Wainui, in the County of
Cook, in the Provinial District of Auckland, shee-farmer, apply, under the above-mentioned Act, for the valdation of six of the interests in 822 acers, more or less, being all
that paecel of land situate in the County of Cook, in the
Ditict of Povey Bay, and being Subdision No. 4 of the
Paitu Block, and being a portion of the land compised
and described in certificate of tite, Vol. xv., folio 168, in the
books of the Registar of Lands for the District of Hawke's
ay, and being the land more paiculaly delineated and
desribed on deposited Plan No. 785.
B. The applicat deires to appear before the Valdation
Cout on Tuesday, the 1st day of December, 1896, at the hour
of 10.30 o'clock in the forenoon, or at the first sitting of the
Cout thereafer.
C. The nature of the transaction proposed for valdation
are certain agremets or conacts beaing date in or about
the month of March, 1883, and made between Eru Pohatu,
Wi Kainuke, Hema Waka, Keita Kenana, all of Gisbore,
Ote Pomare and Aret Apatu, both of Wai, Hawke's
ay, all aboriginal nates, of the one part, and Robert
Cooper, late of Gisbore, setler, decesed, of the other part.
The conideration agreed upon between the said parties was
the amounts set out in the agremets or conacts herei
before mentioned.
D. The land which is intended to be alieated is a sub
dision of the Paitu Block, called Paitu No. 4, such
subdision containing by admeasurment 822 acers, more
or less; and the tite thereto of the alieors at the time of
the said alieation was found on a memorial of ownership
dated the 3rd day of March, 1883.
E. The estate or interest in the said Paitu No. 4
Block which the applicat sees to obtain through the aid
of the Court is an estate of freehold.
F. The manner in which the applicat came to be invested
with the tite he now holds is as follows:—
(1.) The agremets or conacts herei fore recited, of in
or about the month of March, 1883,
(2.) Deed of conveance and confimation, date the 1st
day of June, 1892, made between Hami te Hau
and Ote Pomare, both of Nuhaka, in the
Provincial District of Hawke's Bay, aboriginal
nates, of the one part, and the said Robert
Cooper of the other part.
(3.) Deed of conveance and confimation, date the 2nd
day of July, 1892, made between Matutaera Kai
puke and Wremu Kainuke, both of Murewai, in
the Provinial District of Auckland, aboriginal
nates, of the one part, and the said Robert
Cooper of the other part.
(4.) Deed of conveance and confimation, date the
2nd day of July, 1892, made between Keita
Kena (Kae Gann), of Gisbore, wife of
Micael Joseph Gann, of Gisbore aforesaid,
icensed interpreter, of the one part, and the
said Robert Coper of the other part.
(5.) Proate of the will of the said Robert Coper, issued
in favour of the applicat.
G. The address for service of the applicat in the Town of
Gisbore, where notices, orders, and other documents may
be served upon him by leaving the same for him at such
place, is at the offces of Mesrs. Rees Brothers, solictors,
sitaute in Lowe Street, Gisbore aforesaid.
H. The applicat deires the estates and interests of the
seveal Ntive persons mentioned in paragraph c of this ap
plication as being the persons excuting the said agremets
or conacts of in or about the month of March, 1883,
together with their represenatives, bound by the decrees of
the Court, and for that purpose requires that copies of this
application shall be served on them. The names of the
person upon whom the applicat requires that copies of the
application shall be served are the persons mentioned in
paagraph c hereof and also the following persons: Duncn
Birell Mc Donald, of Auckland, sharebroker, the National
ank of New Zealnd, Hamiora Mangakahaia, Merenia Nga
rangione, Tiopea Pohatu, Henare Pohatu, Hamahona
Pohatu, Nri Pohatu, Matutaera Pohatu, Tuhauariti Po
hatu, Mere Aia Pohatu, Taki Pohatu, Eren Pohatu,
Renata Pohatu, Wairakau Pohatu, Peneamie Pohatu.
The applicat deires that all other persons who may
claim to be interested in the valdation applied for shall be
treated as parties to these proceings, but the applicat is
unale to specify any names of persons other than those set
for herein.
