Declaring that Coromandel County Council shall exercise the Powers of a Harbour Board in Coromandel Harbour.

ORDER IN COUNCIL.

At the Parliament Buildings, at Wellington, this twenty-first day of September, 1896.

Present:

THE HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.

WHEREAS it is among other things provided by section 242 of “The Counties Act, 1886,” that, in any place where there is no Harbour Board, the Governor, on the request of the Council of any county bordering on any estuary or arm of the sea, may, by Order in Council duly gazetted, declare that such Council shall, from a date to be fixed in such Order, exercise all the powers of a Harbour Board within such limits of such estuary or arm aforesaid as the Governor may define for that purpose:

And whereas the Council of the County of Coromandel, which borders on the estuary or arm of the sea known as Coromandel Harbour, in the Provincial District of Auckland, has requested that it may be declared that it shall exercise all the powers of a Harbour Board within that estuary or arm of the sea:

And whereas it is desirable that such request should be acceded to, and that the limits of such estuary or arm of the sea should be defined as hereinafter appears:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the hereinbefore-recited power and authority, and by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that, from and after the first day of October, one thousand eight hundred and ninety-six, the said Council shall exercise all the powers of a Harbour Board within the limits of the estuary or arm of the sea hereinafter set forth, and which said estuary or arm of the sea is called Coromandel Harbour.

And in further pursuance and exercise of the hereinbefore-recited power and authority, His Excellency, with the advice and consent aforesaid, doth hereby define the limits of the said estuary or arm of the sea within which the Council of the County of Coromandel is to exercise the powers aforesaid as follows, that is to say:—

All that area in the Auckland Land District, known as Coromandel Harbour, bounded towards the south, east, and north-west generally by high-water mark of Coromandel Harbour, from the north-western extremity of Te Kouma No. 1 Block, at the South Head of Coromandel Harbour, to the extreme west point of Crown Land block on Beeson’s Island, at the North Head of Coromandel Harbour; and thence towards the west by a right line to the north-western extremity of Te Kouma No. 1 Block aforesaid, the place of commencement.

The hereinbefore-mentioned line of high-water mark shall be deemed to cross the mouths of any rivers and streams that may flow into the Coromandel Harbour and inlets, as is delineated on plan signed by the Governor marked M.D. 2087, and deposited in the office of the Marine Department at Wellington.

Increasing the Holding-area of Land to Settlers in the Sutton Village-homestead Settlement.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth day of September, 1896.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by an Order in Council issued on the first day of August, one thousand eight hundred and ninety-three, under the authority of the one hundred and sixty-ninth section of “The Land Act, 1892,” fixing the terms and conditions upon which certain village-homestead allotments therein enumerated should be disposed of, it was provided that no person should hold more than one allotment:

And whereas it is expedient to allow one person to hold and acquire two allotments of land in the Sutton Village-homestead Settlement, which comprises Sections 51 to 68, inclusive, of Block IV., Sutton Survey District:

Now, therefore, His Excellency the Governor, in pursuance of all powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth hereby amend the Order in Council aforesaid so far as it affects the areas in which the land in the Sutton Village-homestead Settlement shall be held, and doth by this present Order declare that any settler in the village settlement aforesaid may apply for and acquire not more than two allotments of land therein. And it is hereby further declared that all the provisions of the Order in Council of the first day of August, one thousand eight hundred and ninety-three, aforesaid, shall apply, except as regards the area in which the land may be held, to the Sutton Village-homestead Settlement aforesaid.

Tupua Recreation-ground brought under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth day of September, 1896.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

BY virtue of the powers and authorities vested in me by the twenty-fourth section of “The Public Reserves Act, 1881,” I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, do hereby order and declare that the reserve made for public recreation in the Land District of Auckland, and known as the Tupua Recreation-ground, and described in the Schedule hereto, shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of “The Public Domains Act, 1881”; and such domain shall hereafter be managed, administered, and dealt with in manner directed by the said Act.

SCHEDULE.

ALL that piece or parcel of land, called or known as Section No. 119 of the Parish of Whangarei, situate in the Purua Survey District, Auckland Land District, and containing by admeasurement 10 acres, more or less. Bounded towards the north-east by a public road, 130 links, 502 links, 575 links, and 680 links; towards the south-east by Section No. 120 of the Parish of Whangarei aforesaid, 867 links; towards the south-west by the Te Tupua Block (No. 50), 1905 links; and towards the north by Section No. 123 of the Parish of Whangarei aforesaid, 184 links, to the point of commencement: be all the aforesaid linkages more or less.

Powers delegated to the Tupua Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth day of September, 1896.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the twelfth section of “The Public Domains Act, 1881,” it is, inter alia, enacted that the Governor, by Order in Council, may from time to time delegate all or any of the powers by the said Act conferred, save as is therein mentioned, to any person or persons, for any period, and subject to such stipulations as may be specified in such Order, and that every such delegation may from time to time in like manner be altered or revoked: And whereas, pursuant to “The Public Reserves Act, 1881,” by an Order in Council of even date herewith, the land described in the Schedule thereto is declared to be brought under the operation of and to be subject to the provisions of the said “Public Domains Act, 1881”:

Now, therefore, His Excellency the Governor, by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth by this present Order delegate all the powers conferred by the Act first above mentioned, except the powers under or conferred by sections five and twelve thereof, to

THE WHANGAREI COUNTY COUNCIL,

which shall be known as the Tupua Domain Board (hereinafter referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the second Tuesday in each month, at eleven o’clock a.m., at the office of the County Council at Whangarei, or at such other time or place as may from time to time be fixed by
