  1. In case any doubt at any time arises as to the sufficiency of the compliance with these regulations, with reference to the selection, occupation, or improvement of any land, or otherwise arising thereunder respectively, the same shall be settled by the Land Board.

  2. Excepting as expressly modified by these regulations, the provisions of “The Land Act, 1892,” and its amendments shall be deemed to have full force and effect over and upon the land herein referred to, and shall, mutatis mutandis, be read as if these regulations formed part of the Act.

Schedule.

All that parcel of land, containing by admeasurement 11,025 acres, more or less, and comprising Sections 1, 2, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, Block VII., Omona Survey District; Sections 1, 2, 3, 4, 5, 6, Block VIII., Omona Survey District; Sections 1, 2, 3, 4, 5, 6, 7, 8, 10, 11, Block X., Omona Survey District; Sections 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 16, 17, 18, 19, 20, 21, 23, 24, Block XI., Omona Survey District, in the Land District of Taranaki.

Bringing Land in Town of Chertsey under the Provisions of “The Public Domains Act, 1881.”

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fourth day of August, 1896.

Present:

His Excellency the Governor in Council.

BY virtue of the powers and authorities vested in me by the twenty-fourth section of “The Public Reserves Act, 1881,” I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, do hereby order and declare that the reserve made for public recreation in the Land District of Canterbury, and known as the Chertsey Recreation-ground, and described in the Schedule hereto, shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of “The Public Domains Act, 1881”; and such domain shall hereafter be managed, administered, and dealt with in manner directed by the said Act.


SCHEDULE.

All that area of land, containing 2 acres 2 roods 27 perches, being Reserve No. 3057 (formerly known as Sections Nos. 31, 32, 33, 34, 36, 46, 47, 48, 49, 50), situate in the Town of Chertsey, Canterbury Land District: as the same is delineated on the plan deposited in the office of the Chief Surveyor, Christchurch.

Resumption of Land at Port Charles, Coromandel, for Gold-mining Purposes.

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fourth day of August, 1896.

Present:

His Excellency the Governor in Council.

WHEREAS pursuant to agreement with the occupier of the land described in the Schedule hereto, held for occupation with the right of purchase under the provisions of “The Land Act, 1892,” the said land has been resumed for gold-mining purposes, and the amount of compensation as agreed upon has been paid:

Now, therefore, I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, do hereby declare, in pursuance of the provisions of “The Mining Act, 1891,” that the said land has been resumed for mining purposes by Her Majesty.


SCHEDULE.

All that parcel of land in the Provincial District of Auckland and Colony of New Zealand, situate at Port Charles, and being Section 10 of Block I. of the Harataunga Survey District, containing by admeasurement 200 acres, more or less, and bounded on the north-west by Crown lands, on the south-west by Crown lands, on the north-east by Section No. 7 of the said block and the Okahutahi Block, and on the south-east by the Okahutahi Stream.

Clutha County Council subject to the Provisions of “The Public Bodies’ Powers Act, 1887.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fourth day of August, 1896.

Present:

His Excellency the Governor in Council.

WHEREAS the Clutha County Council, being a leasing authority within the meaning of “The Public Bodies’ Powers Act, 1887” (hereinafter termed “the said Act”), has requested that these presents should issue, and it appears expedient to make the order hereinafter contained: Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the Clutha County Council shall, as from the date of the publication hereof in the New Zealand Gazette, be subject to the provisions of the said Act.

Powers delegated to the Arundel Domain Board under “The Public Domains Act, 1881.”

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fourth day of August, 1896.

Present:

His Excellency the Governor in Council.

IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twenty-eighth day of August, one thousand eight hundred and ninety-four, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present Order, delegate, but only with respect to the piece or parcel of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Arundel Domain Board, namely,—

GEORGE HENRY PATRICK,
GEORGE HERBERT HIBBARD,
EDWARD EVANS,
HERBERT NICHOL,
JOHN COOK,
HUGH McMASTER, and
JOSEPH BRYAN

(hereinafter referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the third Thursday in each month, at half-past seven o’clock p.m., at Arundel, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Thursday, the seventeenth day of September, one thousand eight hundred and ninety-six.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the third Thursday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

  6. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.
