Additional Regulations for granting Assistance towards Prospecting at Deep Levels, the Use of Diamond Drills, and the Construction of Water-races and Storage Reservoirs.

ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day of August, 1896.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN exercise of the powers in this behalf vested in him by section two of "The Mining Act 1891 Amendment Act, 1894," His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, hereby makes the following regulations prescribing the terms and conditions subject to which assistance may be given towards any mining operation referred to in that section, and declares that they shall form part of and be read together with the regulations made in manner aforesaid by him under the same section on the twenty-ninth day of November, one thousand eight hundred and ninety-four, and published in the Gazette of that date.

REGULATIONS.

  1. EVERY grant or subsidy made or promised to be made by the Minister shall be deemed to be so made or promised subject to the express conditions following, that is to say,--

(1.) That the applicants for assistance will themselves apply the grant or subsidy in carrying out the mining operations to which the application relates.

(2.) That the applicants will not, without the previous consent in writing of the Minister, in any way, directly or indirectly, sell, charge, encumber, or otherwise dispose of or part with the ground, claim, or works upon which the mining operations towards which the assistance is given are being carried on.

(3.) That, if the applicants make default in full and faithful compliance with any of the provisions of the two last-preceding clauses hereof, all unpaid instalments of any such grant or subsidy as aforesaid shall forthwith cease to be payable, and all sums theretofore paid in respect of such grant or subsidy shall be recoverable from the applicants, jointly and severally, as a debt due to the Crown, and until fully repaid shall be a first and paramount charge in favour of Her Majesty upon the ground, claim, and works whereon such sums were expended.

Whangarei County Council subject to the Provisions of "The Public Bodies' Powers Act, 1887."

At the Government House, at Wellington, this seventeenth day of August, 1896.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Whangarei County Council, being a leasing authority within the meaning of "The Public Bodies' Powers Act, 1887" (hereinafter termed "the said Act"), has requested that these presents should issue, and it appears expedient to make the order hereinafter contained:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the Whangarei County Council shall, as from the date of the publication hereof in the New Zealand Gazette, be subject to the provisions of the said Act.

WHEREAS the Whangarei Harbour Board, being a leasing authority within the meaning of "The Public Bodies' Powers Act, 1887" (hereinafter termed "the said Act"), has requested that these presents should issue, and it appears expedient to make the order hereinafter contained:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers conferred upon him by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the Whangarei Harbour Board shall, as from the date of publication hereof in the New Zealand Gazette, be subject to the provisions of the said Act.

Amending Boundaries of Otahuhu and Mangare Road Districts, County of Manukau.

ORDER IN COUNCIL.
At the Government House, at Wellington, this seventeenth day of August, 1896.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section 20 of "The Counties Act, 1886" (hereinafter termed "the said Act"), it is provided that all the powers of a County Council relating to the alteration of the boundaries of any road or town districts within a county, or of amalgamating such districts, or of merging any of them into the county, and all other powers in relation to such districts exercisable by the Council by special order or on petition, may be exercised by the Governor in Council in respect of any of the counties in which the said Act is suspended: And whereas the said Act is suspended in the County of Manukau: And whereas, in pursuance of "The Road Boards Act, 1882," and "The Road Boards Act 1882 Amendment Act, 1883," petitions have been presented to His Excellency the Governor praying him to alter the boundaries of the Otahuhu and Mangare Road Districts:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities vested in him by the said Act, and of all other powers and authorities enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that from and after the twenty-second day of September, one thousand eight hundred and ninety-six, the boundaries of the said districts as at present constituted shall cease to be the boundaries of the said districts, and that the boundaries of the said districts shall be those which are specified in the Schedule hereto; and also that the Road Boards of the said districts shall be dissolved upon the said twenty-second day of September, one thousand eight hundred and ninety-six; and that the Road Board of each of the said districts, as altered by this Order in Council, shall consist of five members; and, further, that the first election of members of the new Boards shall be conducted in accordance with "The Regulation of Local Elections Act, 1876": and doth, by and with the advice aforesaid, further appoint Augustus Joseph Shackell to be the Clerk and the Returning Officer to conduct the first elections of the Road Board of the Otahuhu Road District: and doth appoint Wednesday, the twenty-third day of September, one thousand eight hundred and ninety-six, to be the day for holding such first elections; and that the first meeting of the new Board of the said Otahuhu Road District shall be held at the Otahuhu Road Board Office, Great South Road, on Friday, the twenty-fifth day of September, one thousand eight hundred and ninety-six, at eight o'clock in the evening:
