Revoking certain Regulations under “The Stock Act, 1895,” and substituting another.—Notice No. 440.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twentieth day of April, 1896.

Present:

THE HONOURABLE A. J. CADMAN PRESIDING IN COUNCIL.

IN exercise and pursuance of the powers and authorities vested in him by “The Stock Act, 1893” (hereinafter termed “the said Act”), His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke the Order in Council, Notice No. 434, made under the provisions of the said Act, dated the ninth day of December, one thousand eight hundred and ninety-five, regulating the introduction of artificial manures, &c., and in lieu thereof doth hereby make the following regulations, namely,—

  1. The introduction into the Colony of New Zealand from any country or colony of artificial manures and hides is hereby allowed, subject to the following conditions, namely:—

(a.) Artificial manures may be landed, but those composed of or containing blood or bones, or bones digested but uncrushed, must be accompanied by a declaration from the owner, secretary, or manager of the works where such blood or bones were treated, that they have been subjected to a heat of at least forty-five pounds indicated steam pressure, equal to two hundred and seventy-four degrees Fahrenheit.

All artificial manures and bones to be put up in new bags.

(b.) Bones in a raw or green and uncrushed state to be landed and taken direct from the ship’s side to the manure-works, and there subjected to a heat from steam of at least forty-five pounds pressure per square inch, equal to two hundred and seventy-four degrees Fahrenheit.

The bags in which such raw or green bones are received must be either immediately destroyed or thoroughly boiled before again being used.

(c.) Hides may be landed, if from cattle slaughtered for human consumption or boiling-down, and not from any animals which have died from a contagious or infectious disease, such hides to be thoroughly salted or otherwise chemically preserved.

Any person importing bones or hides under this regulation may be required by an Inspector to thoroughly disinfect any vehicle in which such bones or hides have been conveyed between the ship and the manure-works or tannery.

The term “owner” shall for the purposes of these regulations have the meaning assigned to that term by “The Stock Act, 1893.”

  1. Any person committing a breach of these regulations shall be liable on conviction to a penalty of not less than five pounds nor more than one hundred pounds.

  2. So much of the General Regulations, dated the thirtieth day of December, one thousand eight hundred and ninety-three, made under “The Stock Act, 1893,” and published in No. 3 of the New Zealand Gazette of one thousand eight hundred and ninety-four, as is inconsistent with the regulations hereby made, is hereby revoked.

And it is hereby declared that this Order in Council shall come into force on and after the first day of May, one thousand eight hundred and ninety-six.

Extending Period within which Commissioners under “The Horowhenua Block Act, 1895,” shall report.


To all to whom these presents shall come, and to JAMES CROSBY MARTIN, of Wellington, Esquire, ROBERT SMELT BUSH, of Auckland, Esquire, Stipendiary Magistrates, and JAMES CRAIG MCKERROW, of Morrison’s Run, Greytown, Esquire, Settler, Greeting:

WHEREAS by a Commission, bearing date the fourth day of February last, you, the said JAMES CROSBY MARTIN, ROBERT SMELT BUSH, and JAMES CRAIG MCKERROW,

were appointed to be Commissioners for the purposes and with the powers in the said Commission, as published in the New Zealand Gazette No. 10, of the thirteenth day of February, one thousand eight hundred and ninety-six, pages 278, 279, and 280, more particularly mentioned: And whereas by the said Commission you were directed and required to report to me on or before the thirtieth day of April then next ensuing your proceedings, and your opinion touching the matters mentioned therein:

And whereas it is expedient that the said period should be extended as hereinafter provided:

Now know ye that I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, in pursuance and exercise of the power conferred upon me by “The Horowhenua Block Act, 1895,” and of all other powers and authorities enabling me in this behalf, and acting by and with the advice and consent of the Executive Council of the said colony, do hereby extend the period within which you shall (using all diligence) report to me as by the said Commission provided to the thirty-first day of May next. And with the like advice and consent, and in further pursuance and exercise of the said powers and authorities, I do hereby confirm the said Commission, except as altered by these presents.

In witness whereof I have hereunto set my hand, and caused these presents to be issued under the seal of the said colony, at Auckland, this sixteenth day of April, in the year of our Lord one thousand eight hundred and ninety-six.

Native Lands proposed to be taken for a Public Work in the Rangipo North Block.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-fifth day of March, 1896.

Present:

THE HONOURABLE W. C. WALKER PRESIDING IN COUNCIL.

WHEREAS by the fourteenth section of “The Reserves Disposal and Exchange Act, 1895” (hereinafter termed “the said Act”), it is enacted that the Governor may take compulsorily, in manner prescribed in “The Public Works Act, 1894,” such of the lands described in the Fifth Schedule of the said Act as from time to time he deems necessary for the purpose of providing accommodation for travellers, and such purpose shall be deemed to be a public work:

And whereas the lands mentioned in the Schedule hereto, being the lands described in the Fifth Schedule to the said Act, are, in the opinion of the Governor, required for the purpose of providing accommodation for travellers:

And whereas the said lands are held or occupied by Native owners under a title which is not derived from the Crown:

And whereas a map in duplicate has been prepared of the said lands, as required by the eighty-eighth section of “The Public Works Act, 1894”:

Now, therefore, in pursuance and exercise of the powers vested in him by the said Act, and by “The Public Works Act, 1894,” and in pursuance of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the lands shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purpose aforesaid, and that the said lands shall vest in Her Majesty as from the sixteenth day of May, one thousand eight hundred and ninety-six.
