Inspection, &c., of Milk and Dairies in Auckland.

ORDER IN COUNCIL.

At the Government House, at Wellington, this ninth

day of December, 1895.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the third section of "The Public Health

Act 1876 Amendment Act, 1881," it is enacted that

the Governor in Council may from time to time make such

regulations as he shall think fit for the following purposes

or any of them, and so that such regulations may either be

of general application throughout the whole colony or may

only apply to one or more districts:—

(1.) For the registration with the Local Board of all per-

sons carrying on the trade of cowkeepers, dairy-

men, or purveyors of milk:

(2.) For the appointment of Inspectors of Milk and

Dairies:

(3.) For the inspection of cattle in dairies, and for pre-

scribing and regulating the lighting, ventilation,

cleansing, drainage, and water-supply of dairies,

and cowsheds, and yards in the occupation of

persons following the trade of cowkeepers or

dairymen, or used by them in connection with

such occupation:

(4.) For securing the cleanliness of milk-shops, milk-

stores, and of milk-vessels used for containing

milk for sale by such persons:

(5.) For prescribing precautions to be taken for protect-

ing milk against infection or contamination, and

for prohibiting the sale of milk in cases where the

public health would be likely to be endangered by

such sale:

(6.) For authorising Local Boards to make regulations

for the purposes aforesaid, or any of them, sub-

ject to such conditions, if any, as the Governor in

Council may prescribe:

And whereas it is desirable that regulations should be

made for the aforesaid purposes, such regulations to be in

force in the districts hereinafter mentioned:

Now, therefore, His Excellency the Governor of the Colony

of New Zealand, in pursuance and in exercise of the powers

and authorities contained in the above-recited Act, and of

all other powers and authorities in anywise enabling him in

this behalf, and by and with the advice and consent of the

Executive Council of the said colony, doth hereby make the

regulations hereinafter set forth, and doth hereby declare

that such regulations shall, on and after the first day of

January, one thousand eight hundred and ninety-six, apply

to and be in force in the following districts, namely:—

The Borough of the City of Auckland.

The Borough of Newton.

The Borough of Newmarket.

The Borough of Parnell.

The Road District of Arch Hill.

The Road District of Avondale.

The Road District of Eden Terrace.

The Road District of Epsom.

The Road District of Howick Township.

The Road District of Mangere.

The Road District of Manurewa.

The Road District of Mount Albert.

The Road District of Mount Eden.

The Road District of Mount Roskill.

The Road District of Mount Wellington.

The Road District of One-Tree Hill.

The Road District of Pakuranga.

The Road District of Panmure Township.

The Road District of Papakura.

The Road District of Papatoitoi.

The Road District of Pukekohe East.

The Road District of Pukekohe West.

The Road District of Point Chevalier.

The Road District of Remuera.

The Road District of Otahuhu.

The Road District of East Tamaki.

The Road District of Tamaki West.

REGULATIONS.

  1. In these regulations the following words and expres-

sions shall have the meaning hereby assigned to them,

unless there be something in the subject or context repug-

nant to such construction:—

Interpretation.

"Principal Board" means the Local Board of Health

for the District of the City of Auckland, as con-

stituted by "The Public Health Act, 1876":

"Local Board" means the Local Board of Health con-

stituted by "The Public Health Act, 1876":

"District" means the area comprised within the juris-

diction of the Principal Board or of a Local Board:

"Inspector" means the person from time to time ap-

pointed under these regulations, by the Principal

Board, to act as Inspector of milk, and of dairies,

cowsheds, and milk shops or stores, and includes

any person to whom he may delegate his powers

or any of them:

"Contributing Board" means any Local Board herein

mentioned which, on or before the 31st January,

1896, and thereafter annually on or before the 31st

December in each year, notifies the Principal Board

that it intends to contribute towards cost of inspec-

tion a sum equal to ten shillings (10s.) per one

hundred pounds (£100) of its revenue as at the

financial year ending the 31st March preceding (but

in no case a sum less than one pound), and within

seven days of such notification pays to the Princi-

pal Board such contribution:

"Clerk" means any person appointed as Town Clerk

under "The Municipal Corporations Act, 1886," or

holding an analogous appointment under any body

included in the term "Local Board":

"Dairy" means any building, shed, or place used for

the purpose of depositing, keeping, or storing milk

or cream:

"Cowshed" means any building, shed, stall, or covered

place used for the purpose of milking, stalling, or

stabling of cattle:

"Dairy premises" means any building, shed, land, or

place used for stalling, grazing, feeding, or milking

cattle for producing milk or cream to be sold or

supplied, or any building for the deposit, keeping,

or storing of milk or cream when so produced:

"Milk shop or store" means any building, shed, or place

used for the purpose of depositing, storing, or ex-

posing milk or cream for the purpose of selling or

disposing thereof:

"Dairyman" means the occupier of any dairy premises

as herein defined, or any person engaged in the pro-

duction of milk for sale or supply for profit to other

persons:

"Milk-vendor" means the occupier of any milk shop or

store as herein defined, or any person engaged in the

distribution or storage of milk for sale or supply for

profit to other persons:

"Keep" means keep, retain, or to permit to remain,

whether permanently or temporarily.

Registration.

  1. It shall not be lawful for any person to carry on in any

district the trade of cowkeeper, dairyman, or purveyor of

milk unless he is registered as such in accordance with these

regulations.

  1. There shall be kept at the office of the Local Board a

register of all persons from time to time carrying on in the

district the trade of cowkeeper, dairyman, or purveyor of

milk, and such register shall from time to time be revised

and corrected.

  1. The Local Board shall, or the Principal Board may, in

manner hereinafter mentioned, register every such person ;

but the fact of such registration shall not be deemed to

authorise such person to occupy as a dairy, cowshed, milk

shop, or store any particular building, or in any way preclude

any proceedings being taken against such person for non-

compliance with or infringement of any of these regulations

or any further regulations which may hereafter be made for

any of the purposes specified in the 3rd section of "The

Public Health Act 1876 Amendment Act, 1881."

  1. Every person desiring to be registered shall fill in with

the required particulars, and hand to the Clerk at the office

of the Local Board or Local Boards within whose district or

districts such person carries on, or proposes to carry on, the

trade of dairyman or milk-vendor, an application to be pro-

vided for that purpose by the Local Board free of expense.

The particulars required to be stated in such application

shall be,—

(a.) The occupation of the applicant, whether cow-

keeper, dairyman, or purveyor of milk ;

(b.) The exact address of the place where he exercises or

proposes to exercise such occupation ;

(c.) The dimensions of his dairies, cowsheds, and milk

shops or stores ;

(d.) The accustomed number of cattle milked or proposed

to be milked on his dairy premises.

Such application shall be in the Form A in the Schedule

hereto.

  1. Within a reasonable time after the receipt by the Local

Board of such application, and upon the Inspector being

satisfied that the dairy premises or milk shop or store of the

applicant are in accordance with these regulations, the appli-

cant shall be entitled to receive from the Local Board, free of

expense, a certificate under the hand of the Clerk that he

has been registered in accordance with the particulars so fur-
