  1. All amounts received by any Collector in respect of
    income-tax shall be paid into the Consolidated Fund, and he
    shall account to the Commissioner therefor.
  2. If any agent, importer, consignee, or other person
    shall refuse to make any return, or to produce any book,
    paper, or correspondence, or to answer any questions on
    oath, or to make any statutory declaration, pursuant to these
    regulations, he shall in each instance be liable to a penalty
    of not less than £20 and not more than £50.

Declaring the Spur Road, in Block II., Woodville Survey
District, to be a District Road.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-sixth
day of January, 1895.
Present:
His Excellency the Governor in Council.
I N pursuance and in exercise of the powers vested in him
by "The Public Works Act, 1894," and of all other
powers in anywise enabling him in this behalf, His Excel-
lency the Governor of the Colony of New Zealand, by and
with the advice and consent of the Executive Council of the
said colony, doth hereby order that the road known as the
Spur Road, described in the Schedule below, and which was
made by the Governor under the powers contained in the
said Act, and has hitherto been a Government road, shall,
on and after the date of this Order in Council, become a
district road.

SCHEDULE.

ALL that parcel of land in Hawke's Bay Land District, con-
taining by admeasurement 7 acres and 16 perches, more or
less, being a road 100 links wide, in Sections Nos. 7, 8,
and 16, Block II., Woodville Survey District, the eastern
and north-eastern side of which commences at the north-
eastern corner of said Section No. 16, and proceeds along
the south-eastern boundary of that section to the western-
most corner of Section No. 9; thence to the north-eastern
boundary-line of the said Section No. 7, passing through
said Section No. 8; thence along part of the said north-
eastern boundary of Section No. 7, and then to a point on
the eastern boundary of Section No. 7 distant 200 links
from its north-eastern corner; being a total distance of
7064·6 links: be the aforesaid linkage more or less; as
the same is delineated on the plan marked S.G. 21389A,
deposited in the Head Office of the Department of Lands
and Survey, at Wellington, in the Wellington Land District,
and thereon coloured pink.

Powers delegated to the Mount Victoria Domain Board
under "The Public Domains Act, 1881."

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-sixth
day of January, 1895.
Present:
His Excellency the Governor in Council.
I N exercise and pursuance of the powers and authorities
vested in him by "The Public Domains Act, 1881,"
His Excellency the Governor of the Colony of New Zealand,

by and with the advice and consent of the Executive Council
thereof, doth hereby revoke a certain Order in Council, dated
the fourth day of September, one thousand eight hundred and
eighty-eight, making delegation of certain powers in manner
as therein appears; and doth, with the like advice and con-
sent, by this present Order, delegate, but only with respect
to the piece or parcel of land described in the Schedule
hereto, all the powers conferred by the Act aforesaid, except
the powers under or conferred by sections five and twelve
thereof, to the under-mentioned persons, who shall be known
as the Mount Victoria Public Domain Board, namely,—
WILLIAM BUCHANAN,
WILLIAM HOILE BROWN,
EDWARD BARTLEY,
ROBERT HUMFREY DUDER,
EDWARD WILLIAM BURGESS,
ALEXANDER ALLISON,
JAMES FOWLDS LOGAN, and
His Worship the MAYOR OF DEVONPORT (ex officio)
(herein referred to as "the Board"), subject to the stipula-
tions hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on
    the first Saturday in each month, at three o'clock p.m., at
    the Post-office, Devonport, or at such other time or place as
    may from time to time be fixed by the Board. The first
    meeting shall be held on Saturday, the second day of March,
    one thousand eight hundred and ninety-five.

  2. Special meetings may be convened by the Chairman or
    by any two members of the Board, provided that two days'
    notice of such meeting be given to each member, specifying
    the business to be transacted at such special meeting, and
    no other business than that so specified shall be transacted
    at such meeting.

  3. Any three of the said Board shall form a quorum. Any
    meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting,
    and thereafter at an annual meeting to be held on the first
    Monday in January in every succeeding year thereafter,
    elect one of themselves to be Chairman, who may join in the
    discussion, and shall have an original as well as a casting
    vote. The Chairman shall hold office until the election of
    his successor.

  5. If at any meeting the Chairman is not present at the
    time appointed for holding the same, the members present
    shall choose some one of their number to be chairman of
    such meeting.

  6. If, by resignation, death, or incapacity, or otherwise,
    the office of Chairman shall be or become vacant, the
    members may at any monthly or special meeting appoint
    a Chairman.

  7. All questions shall be determined by the majority of
    votes of the members of the Board present at a meeting.

    SCHEDULE.
    ALL that piece or parcel of land containing by admeasure-
    ment 21 acres 1 rood 36 perches, more or less, and being
    called or known as Mount Victoria Reserve, in the Parish of
    Takapuna, Rangitoto Survey District, Auckland Land Dis-
    trict. Bounded towards the north-east by Lot 17A, 883
    links; towards the south-east by a public road and Lot 17,
    1074 links; towards the south by Lot 20A and a public road,
    969 links; towards the south-west by Lot 26, 1289 links;
    towards the north-west by a line and Lot 26A, 650 links; and
    towards the north by Lot 16 to point of commencement, 752
    links: be all the aforesaid linkages more or less: excepting
    the Flagstaff Reserve, containing by admeasurement 2 roods
    4 perches, more or less, and a right-of-way thereto.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-sixth day of January, 1895.
Present:
His Excellency the Governor in Council.
W HEREAS by the twentieth section of "The Westland and Nelson Coalfields Administration Act, 1877," it is
enacted that the Governor may, by Order in Council, from time to time reserve such portions of the lands therein
mentioned as he shall consider necessary or to be required for the purposes therein set forth:
And whereas the lands described in the Schedule hereto form part of the lands described in the Third Schedule to the
said Act, and such lands are subject to be dealt with under the provisions of section twenty of the said Act:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the above-
recited power, and by and with the advice and consent of the Executive Council of the said Colony, doth hereby reserve
the lands described in the first division of the Schedule hereto for the purpose specified in the second division of the said
Schedule.
