And whereas I have occasion to be temporarily absent from the seat of Govern-
ment at Wellington for a short period, and during part of such period will also be
temporarily absent from the said colony, and, there being no Lieutenant-Governor
in the Colony of New Zealand, I have deemed it expedient to appoint a Deputy
during such temporary absence, with such powers and authorities on my behalf
as are hereinafter mentioned :
Now, therefore, know ye that, for the purposes aforesaid, and in pursuance and
exercise of the power and authority vested in me by the hereinbefore in part recited
Letters Patent, and of every other power and authority enabling me in that behalf,
I, the said DAVID, Earl of Glasgow, as such Governor as aforesaid, do, by these
presents issued under the Public Seal of the Colony of New Zealand, constitute and
appoint Sir JAMES PRENDERGAST, Knight, Chief Justice of the said colony, to be
my Deputy during the period of my temporary absence as aforesaid, and in that
capacity for me and on my behalf to exercise, perform, and execute all the powers
and authorities vested in me as such Governor by the said Letters Patent, except
that my said Deputy shall not, by virtue hereof, do any act to signify the pleasure
of the Governor under βThe Criminals Execution Act, 1883,β with respect to any
sentence of death pronounced by any Court or Judge.
And I hereby declare that the power and authority hereby conferred shall com-
mence and take effect upon and after my departure from the said seat of Government.
And I expressly direct that my said Deputy shall, in the exercise of all or any
of the said powers and authorities, conform to and abide by the requirements of any
law, statute, or regulation in force in the colony respecting the same, and also to the
hereinbefore in part recited Letters Patent and the Royal Instructions accompanying
the same so far as they are applicable.

In witness whereof I have caused these presents to be passed under the
Public Seal of the Colony of New Zealand, and have hereunto set my
hand this twenty-sixth day of January, in the year of our Lord
one thousand eight hundred and ninety-five.
