Regulations under “The Sea-fisheries Act, 1894.”

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirtieth day
of July, 1895.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by “The Sea-fisheries Act, 1894” (herein-
after termed “the said Act”), it is, among other
things, enacted that the Governor in Council may from time
to time make regulations for the purposes therein mentioned,
which shall have general force and effect throughout the
colony, or particular force and effect only in any waters or
places specified therein:

And whereas it is expedient to make the regulations herein-
after set forth with respect to the indigenous fish known as
whitebait inhabiting the waters of the colony herein men-
tioned:

Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in pursuance and exercise of the powers
conferred upon him by the said Act, and by and with the
advice and consent of the Executive Council of the said
colony, doth hereby make the following regulations; and
with the like advice and consent doth order that these regu-
lations shall have force and effect in the brackish waters of
the Waimakariri River, in the Provincial District of Canter-
bury, and shall supersede all regulations respecting the nets
to be used for taking whitebait heretofore in force so far as
that river is concerned.

REGULATIONS.

  1. No scrim or whitebait-net shall be used as a set-net or
    be set or placed in openings made in the banks of the Wai-
    makariri River or its tributaries, or in dams constructed
    therein, and no scrim hand-net having an opening of more
    than 9 square feet shall be used for the purpose of catch-
    ing whitebait.

  2. Any person committing a breach of the above regula-
    tion shall be liable to a penalty of not less than £1 and not
    exceeding £20.

  3. Nothing in these regulations contained shall be deemed
    or be construed to affect or interfere with the operation of
    any regulations for the time being in force under “The
    Fisheries Conservation Act, 1884,” in relation to the taking
    or fishing for salmon or trout in the said river.

Revoking Order in Council licensing the Union Steam Saw,
Moulding, Sash, and Door Company (Limited) to occupy
a Part of Foreshore of Waikahikatea Creek.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirtieth day
of July, 1895.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by Order in Council dated the eighteenth
day of October, one thousand eight hundred and
eighty-three, and published in the New Zealand Gazette,
No. 110, of the twenty-fifth day of the same month, His
Excellency the Governor in Council did, in pursuance of the
provisions of “The Harbours Act Amendment Act, 1883,”
license the Union Steam Saw, Moulding, Sash, and Door
Company (Limited) to use and occupy a part of the fore-
shore of the Waikahikatea Creek, Kaipara Harbour, for the
purpose of erecting and maintaining thereon booms in the
position shown on and in accordance with plan marked M.D.
840, and deposited in the office of the Marine Department at
Wellington:

And whereas the said company has committed a breach
of clause 2 of the conditions of the said Order in Council, by
failing to pay the annual sum specified in that clause, and
has ceased to use or occupy the said booms:

Now, therefore, His Excellency the Governor of the Colony
of New Zealand, acting by and with the advice and consent
of the Executive Council of the said colony, and in exercise
of all the powers enabling him in that behalf, doth hereby
revoke and determine the said recited Order in Council, and
every right, power, and privilege conferred thereby or in-
tended so to be.

Revoking Order in Council licensing J. Darrow to occupy
a Part of Foreshore of Kirikiri River.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirtieth day
of July, 1895.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by Order in Council dated the fifth day of
July, one thousand eight hundred and eighty-seven,
and published in the New Zealand Gazette, No. 45, of the
fourteenth day of the same month, His Excellency the Go-
vernor in Council did, in pursuance of the provisions of
“The Harbours Act Amendment Act, 1883,” license James
Darrow, of the Thames, to use and occupy a part of the
foreshore of the Kirikiri River, Thames, for the purpose of
erecting and maintaining thereon a certain boom in the posi-
tion shown on and in accordance with plan marked M.D.
1337, and deposited in the office of the Marine Department
at Wellington:

And whereas the said James Darrow has committed a
breach of clause 2 of the conditions of the said Order in
Council, by failing to pay the annual sum specified in that
clause, and has ceased to use or occupy the said boom:

Now, therefore, His Excellency the Governor of the Colony
of New Zealand, acting by and with the advice and consent
of the Executive Council of the said colony, and in exercise
of all the powers enabling him in that behalf, doth hereby
revoke and determine the said recited Order in Council, and
every right, power, and privilege conferred thereby or in-

Akaroo High School to be subject to the Provisions of “The
Public Bodies’ Powers Act, 1887.”

GLASGOW, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirtieth day
of July, 1895.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section four of “The Public Bodies’
Powers Act, 1887” (hereinafter termed “the said
Act”), it is provided that the Governor, by Order in Council,
may from time to time declare that any leasing authority
shall be subject to the provisions of the said Act, but that no
such order shall have any effect unless it be issued at the
request or upon the recommendation of the leasing authority
on whose behalf such order is issued:

And whereas it has been made to appear that the Board
of Governors of the Akaroo High School are a leasing
authority within the meaning of the said Act, and have
requested that they may be brought under the provisions
thereof:

Now, therefore, His Excellency David, Earl of Glasgow,
the Governor of the Colony of New Zealand, by and with
the advice and consent of the Executive Council of the said
colony, and in pursuance and exercise of the powers and
authorities conferred on him by the said Act, doth hereby
order and declare that from and after the date hereof the
Board of Governors of the Akaroo High School shall be sub-
ject to the provisions of “The Public Bodies’ Powers Act,
1887.”

Regulation concerning Regulations made by Education Boards.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirtieth day
of July, 1895.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN exercise and pursuance of the powers and authorities
vested in him by “The Education Act, 1877,” His Ex-
cellency the Governor, with the advice and consent of the
Executive Council of the colony, doth hereby make the
regulation hereto annexed regarding the revoking of regula-
tions made by Education Boards, and doth hereby prescribe
that this Order shall come into force on the date of the first
publication thereof in the New Zealand Gazette.

REGULATION.

His Excellency the Governor may at any time, with the
advice and consent of the Executive Council of the colony,
revoke or alter any regulation which, under the authority of
an Order in Council, has been made by any Education
Board.
