Application to the Valuation Court under "The Natives Land (Validation of Titles) Act, 1893."

In the matter of "The Natives Land (Validation of Titles) Act, 1893"; and in the matter of the Nukutaurua Block and also of the Moutere No. 1 Block.
A. G EORGE CANNING ORmond, of Mahia, in the
Provincial District of Hawke's Bay and
Colony of
New
Zealand,
skeep-farmer,
applies under the above-men-tioned Act for the validation of the interests hereinafter
mentioned in those parcels or blocks of land situate at Te
Makia, in the
Provincial District of Hawke's Bay, called or
known respectively by the names of the Nukutaurua Block
and the Moutere No. 1 Block.
B. The
applicant
desires to have himself found
entitled to
relief in respect of the said Nukutaurua Block and the said
Moutere No. 1 Block, which are already the subject of an
application by the
Hoh. James
Carroll and Wite
Pare,
and
desires to appear before the Valuation Court on Monday,
the 18th day of February, 1895, at the hour of 10.30 o'clock
in the forenoon, or at the first sitting of the Court there-
after.
C. The nature of the several transactions proposed for
validation are as follows:—
In the matter of the Nukutaurua Block,—
(1.) Deed of
conveyance,
bearing date the 23rd day of
February, 1889, and made between Thakara Wai-pakiaka of the one part and the said George
Canning Ormond of the other part. The con-sideration agreed upon between the said parties
was £70, and such further sum as should be found
payable by virtue of a certain deed of covenant,
bearing date the 23rd day of February, 1889, and
ma
debetween the said George Canning Ormond
of the one part and the said Thakara W aipakiaka
of the other part, wherehy the said George
Canning Ormond covenanted (inter alia) for pay-ment to the said Thakara W aipakiaka of £1 for
every
acres over and above 70
acres allotted in
respe
ct of the said interest on partiton.
(2.) Deed of
conveyance,
bearing date the 11th day of
Mar
ch, 1889, and made between Heta Kau of
the one part and the said George Canning Ormond
of the other part. The
con
sideration agreed upon
be
tween the said parties was the sum of £40, and
suc
h further sum as should be found
payable by

rtue of a certain deed of covenant,
bearing
date the said 11th day of March, 1889, and made
be
tween the said George Canning Ormond of the
one part and the said Heta Kau of the other
part, wherehy the said George Canning Ormond
covenanted (inter alia) for payment to the said
Heta Kau of £1 for every
acres over and above

acres allotted in respect of the said interest on
partiton.
In the matter of the Moutere No. 1 Block,—
Deed of
conveyance,
bearing date the 2nd day of April,
1889, and made between the said Heta Kau of
the one part and the said George Canning Ormond
of the other part. The

sideration agreed upon

tween the said parties was £25, and such further
sum as should be found
payable by virtue of a
certain deed of covenant,
bearing date the said
2nd day of April, 1889, and made between the said
George Canning Ormond of the one part and the
said Heta Kau of the other part, wherehy the
said George Canning Ormond covenanted (inter
al
ia) for payment to the said Heta Kau of £1
for every
acres over and above 70
acres allotted in
respe
ct of the said interest on partiton.
D. The lands which were intended to be
alienated are the
interests and shares of the Natives before mentioned in the
t
w
o blocks of land before mentioned. The areas of the said
b
locks, and the titles thereto of the
respective
aliens at the
time of the said
alienations, were as follows:—
Nukutaurua Block, 3,452
acres. Title, grant from the
Crown,
bearing date the 4th day of March, 1868.
Moutere No. 1 Block, 389
acres. Title, grant from the
Crown,
bearing date the 9th day of February, 1871.
E. The estates or interests in the said blocks which the

pplicant

eks to obtain by the aid of the Court are estates
or interests of freehold.
F. The manner in which the
a
pplicant came to be
i
nvested
with the titles he now holds to the lands before mentioned
is, in regard to each block, as follows:—
(1.) Proclamation by His Excellency the

dated the 24th day of December, 1886, purporting
to remove from the said Nukutaurua Block and
the said Moutere No. 1 Block the restrietions
a

ainst aliensation.
(2.) The deeds of
conveyance
