Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in pursuance and exercise of the powers
and authorities conferred by the said Act, and by and
with the advice and consent of the Executive Council of
the said colony, doth hereby fix the terms and conditions
on which the lands mentioned in the First Schedule hereto
shall be disposed of by way of lease in perpetuity, and which
said terms and conditions are set forth in the Second Sche-
dule hereto, and also doth direct that the land shall be
leased as village-homestead allotments only.
FIRST SCHEDULE.

from Ratanui and about ten miles from Owaka, on the main
Waikawa Road.
SECOND SCHEDULE.
TERMS AND CONDITIONS OF LEASE.

THE lands enumerated in the First Schedule hereto are
first-class lands, and are village-homestead allotments open
for selection on lease in perpetuity, under the provisions of
"The Land Act, 1892" (hereinafter referred to as "the said
Act"). -
The day on which the land shall be open for selection
shall be Wednesday, the 14th day of August, 1895. -
The rental stated in the First Schedule hereto shall be
the price at which the land shall be open for selection. -
Applications for leases shall be made in manner as
provided in Part I. of the said Act; and all such applica-
tions shall be made to the Commissioner of Crown Lands,
Dunedin; and leases will be issued in accordance with the
provisions of Part I. aforesaid. -
Each applicant shall state his or her residence, occu-
pation, and condition in life (namely, whether married or
single), and will be required to make the declaration pre-
scribed in Schedule C to the said Act. -
Each applicant shall also undertake to pay, imme-
diately upon being declared the successful applicant, the
first half-year's rent, together with the lease and registra-
tion fee. -
All rents must be paid half-yearly, in advance, on the
1st days of January and July in each year, as provided in
section 157 of the said Act; and the first half-year's rent is
payable as before provided. -
Improvements and residence on the land comprised in
the lease shall be as provided in Part III. of the said Act.
The provisions of section 144, and all other provisions of the
said Act with respect to substantial improvements, shall
apply accordingly to lessees under these regulations. The
provisions of section 141, and all other provisions of the said
Act in respect of compulsory residence, shall apply accord-
ingly to lessees under these regulations. -
No lessee shall subdivide, sublet, or transfer the land
held by him under these regulations, except under and sub-
ject to the provisions of Part I. of the said Act. -
No lessee shall hold more than one allotment, and
such allotment shall be held for his sole use and benefit,
and not for the use or benefit of any other person whom-
soever. No married woman shall be eligible as a selector;
but this provision shall not apply to any married woman
who may become a transferee under a will or by virtue of
an intestacy. -
All the provisions of the said Act, so far as applicable,
shall extend and apply to the lands affected by these regula-
tions, and to the applications and leases to be made and
issued thereunder, and generally to the interests created,
and the persons whose rights, liabilities, or interests are
thereby affected; and the mention of any particular provision
of the said Act shall not be deemed to exclude any other
provision of the said Act applicable to the particular case.

ORDER IN COUNCIL.
At the Government House, at Wellington, this eighteenth
day of June, 1895.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN exercise and pursuance of the powers and authorities
vested in him by "The Education Act, 1877," His
Excellency the Governor, with the advice and consent of
the Executive Council of the colony, doth hereby make the
regulation hereto annexed regarding certain payments of
capitation allowance to Education Boards; and, with the
like advice and consent, doth hereby prescribe that this
Order shall come into force on the date of the first publica-
tion thereof in the New Zealand Gazette.
REGULATION.
NOTWITHSTANDING anything to the contrary contained in an
Order in Council made on the 5th day of January, 1888,
under the provisions of "The Education Act, 1877," relating
(inter alia) to attendance registers and returns, the payment
of capitation allowance to Education Boards for the quarter
ending on the 30th day of September, 1895, shall be accord-
ing to the working-average attendance of the quarter ending
on the 30th day of June, 1895, as working average is defined
by Order in Council dated the 5th day of July, 1887, and
made under the provisions of the before-mentioned Act.

Rural Lands in the Auckland Land District open for
Sale or Selection.
GLASGOW, Governor.
IN pursuance and exercise of the powers and authorities
conferred upon me by the one hundred and thirty-sixth
section of "The Land Act, 1892," I, David, Earl of Glasgow,
the Governor of the Colony of New Zealand, having re-
ceived the report of the Surveyor-General in this behalf, as
in the said section is provided, do hereby declare that
the rural lands described in the Schedule hereto shall be
open for sale or selection on and after the fourteenth
day of August, one thousand eight hundred and ninety-
five; and also that the lands mentioned in the said
Schedule may, at the option of the applicant, be purchased
for cash, or be selected for occupation with right of pur-
chase or on lease in perpetuity, or, in respect of any
lands containing or supposed to contain any metal, mineral,
or valuable stone, be selected on lease in perpetuity only;
and I do hereby also fix the prices at which the said lands
shall be sold, occupied, or leased, as mentioned in the said
Schedule hereto, and do declare that the said lands shall be
sold, occupied, or leased under and subject to the provisions
of "The Land Act, 1892."
SCHEDULE.
AUCKLAND LAND DISTRICT.—COROMANDEL COUNTY.
Unsurveyed Second-class Land.
ALL that parcel of land in the Auckland Land District,
situate in Blocks I. and II., Cape Colville Survey District,
containing approximately 1,275 acres. Bounded towards the
north and east generally by the sea; towards the south-east
by a block of 1,400 acres, now open as "unsurveyed land";
towards the south by a right line running due west from the
westernmost angle of the said block; and towards the north-
west generally by the Pohakene No. 2 Block, to the point of
commencement.
Description of Land: Broken land of good quality, black
soil, about one-half forest, remainder open, situate on the
coast near Cape Colville, about six miles from Port Charles.
Cash price, 10s. per acre; occupation with right of pur-
chase, 6d. per acre per annum; lease in perpetuity, 4·8d. per
acre per annum.
As witness the hand of His Excellency the Governor,
this seventeenth day of June, one thousand
eight hundred and ninety-five.
