A PROCLAMATION.
IN pursuance and in exercise of the powers conferred by
section thirteen of "The Land Act, 1892," I, David,
Earl of Glasgow, Governor of the Colony of New Zealand,
do by this notice hereby proclaim as taken for a street that
portion of Section No. 462, in the City of Nelson, herein-
after described, that is to say:—
All that area in the Nelson Land District, containing by
admeasurement 1 rood 5·5 perches, more or less, situated
in the City of Nelson, being part of Section No. 462.
Bounded towards the North by Trafalgar Square, 198 links;
towards the east by Trafalgar Street South, 287 links; and
towards the south-west by a right line, 348·6 links, to a point
on the south side of Trafalgar Square 198 links distant
westerly from the west side of Trafalgar Street South, being
the point of commencement: be all the aforesaid linkages
more or less; as the same is delineated on the plan marked
S.G. 26233, deposited in the Head Office of the Department
of Lands and Survey, at Wellington, in the Wellington
Land District, and thereon coloured red.
Given under the hand of His Excellency the Right
Honourable David, Earl of Glasgow; Knight
Grand Cross of the Most Distinguished Order of
Saint Michael and Saint George; Governor and
Commander-in-Chief in and over Her Majesty's
Colony of New Zealand and its Dependencies,
and Vice-Admiral of the same; and issued under
the Seal of the said Colony, at the Government
House, at Wellington, this twenty-eighth day of
May, in the year of our Lord one thousand eight
hundred and ninety-five.

Regulations under "The Government Railways Act, 1894."

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-
eighth day of May, 1895.
Present:
His Excellency the Governor in Council.
IN pursuance and exercise of the power and authority
conferred by "The Government Railways Act, 1894"
(hereinafter termed "the said Act"), His Excellency the
Governor of the Colony of New Zealand, acting with the
advice and consent of the Executive Council of the said
colony, doth hereby make the regulations set forth in the
Schedule hereto for the purpose of prescribing the time and
method of the election of elective members of the Boards of
Appeal for the North Island and Middle Island respectively
constituted under the said Act, and also for matters con-
ected with the business of the Boards. And it is hereby
declared that such regulations shall come into force on the
tenth day of June, one thousand eight hundred and ninety-
five.
SCHEDULE.
REGULATIONS.
In these regulations, if not inconsistent with the context,
"the Board" means a Board of Appeal constituted under
"The Government Railways Act, 1894"; "Minister" means
the Minister for Railways holding office for the time being,
and includes any Responsible Minister of the Crown, being a
member of the Executive Council, acting for the Minister.
Voting.

Separate alphabetical lists of the officers and employés
resident in each Island entitled to vote in the election of
the Board shall be prepared by the Under-Secretary for
Railways, and retained at the Head Office of the Railway
Department, Wellington. Such lists shall be revised and
corrected from time to time, and may be inspected prior to
the date of election by officers and employés entitled to vote.
If any officer or employé wishes to take any exception to
the respective lists, such exception must be taken through
his immediate superior officer, who will notify the Under-
Secretary for Railways, Wellington, and give particulars of
the exception taken. If no exception is taken to the lists
within the time allowed, which will be specified on each list,
the lists shall forthwith be closed, and shall be the lists on
which the election will be conducted. A ballot-paper will
be sent to each officer and employé whose name appears on
the lists, and each officer and employé shall immediately on
receiving the ballot-paper sign the receipt-form which will
accompany it, and forward the form to the address marked
upon it. -
All officers and employés resident in the North Island
shall respectively be entitled to vote for an officer or employé
to act as a member of the Board to be elected for the North
Island. All officers and employés resident in the Middle
Island shall in like manner respectively be entitled to vote
for an officer or employé to act as a member of the Board
to be elected for the Middle Island. -
No officer or employé shall in any case be compelled to
record his vote, and no officer or employé shall canvass for
votes, or attempt in any way to influence voters. -
The Returning Officer for the election shall be the
Under-Secretary for Railways, Wellington, or other person
for the time being performing the duties of such Under-
Secretary. There shall be two Scrutineers—namely, the
Chief Clerk of the Railway Accountant's Office, and the
Chief Clerk of the Stores Manager's Office, Wellington; but
if either of these officers shall be a candidate for election to
the Board the Under-Secretary shall appoint some other
officer (not a candidate) to act in his stead. -
Nominations, made in writing by not less than three
officers or employés respectively entitled to vote, must reach
the Returning Officer at Wellington on or before Monday,
the 15th day of July, 1895. -
Should there be only one nomination for a member to
represent the officers or employés on either Board, the officer
or employé nominated, as the case may be, shall be declared
to be duly elected. -
Should there be more than one nomination from officers
or employés respectively for either Board a poll shall be
taken on a day appointed by the Returning Officer, which
shall not be less than four weeks from the date of receipt of
nominations in Wellington. -
As soon as possible after the date for receiving nomina-
tions is past the Returning Officer shall cause ballot-papers
in the form or to the effect following to be printed and sup-
plied to every officer and employé entitled to vote:—
Election of an Officer [or Employé] for Member of Appeal
Board (North or Middle Island) under "The Government
Railways Act, 1894."
Candidates for Election.
Jones, John.
Robinson, George.
Smith, William.
Directions.—The voter can only vote for one candidate. The
voter is to strike out with pen-and-ink or pencil the name of every
candidate for whom he does not intend to vote.
The voter must take care not to leave uncancelled the names of
more than one candidate, or this paper will be invalid. The ballot-
paper is to be folded up so that the contents cannot be seen, and
then forthwith transmitted to the Returning Officer.
The voter's name must not be written on the voting-paper.

The ballot-paper shall contain a list of all the persons
nominated in the class to which the voter to whom it is sent
belongs (and of no other persons), arranged alphabetically
in the order of their surnames. Each paper shall have a
number corresponding with that on the list. The number
shall be written in the left-hand bottom corner of the paper
by the Returning Officer, and the corner folded and gummed
down before being sent out. -
All ballot-papers shall be transmitted by post or other-
wise to the Returning Officer at Wellington, in envelopes
which will be provided for the purpose, and must reach him
not later than the ordinary course of post computed from
the day after the polling-day. -
Immediately after the last day fixed for the receipt at
Wellington of ballot-papers, the Returning Officer shall forth-
with, in the presence of the Scrutineers, proceed to ascertain
the total number of votes recorded for each candidate, and
the Returning Officer shall cause the result to be published
in an Official Circular, and shall declare the candidates
obtaining the majority of votes in the respective classes in
the respective Islands duly elected. The voting-papers shall,
after being counted, be enclosed in a sealed packet, and be re-
tained by the Returning Officer. They shall not be opened
unless a scrutiny be demanded, when such scrutiny shall be
conducted by the Returning Officer and the two Scrutineers.
The papers will remain in the Returning Officer's custody
for two months, and will then be destroyed. If a scrutiny
be demanded, application therefor must be made in writing
to the Returning Officer by not less than seven voters within
fourteen days after the publication of the result aforesaid. -
Whenever there is an equality of votes at the election,
and the addition of one vote will entitle any of the candi-
dates to be elected, the Returning Officer shall himself record
such additional vote. -
The term "officer" comprises all members of the
management, clerical, engineering, and drafting staffs, and
inspectors and foremen. -
The term "employé" comprises all other servants of
every grade permanently employed on the railways. -
In the event of any dispute or question arising as to
the meaning of these regulations or any portion thereof, the
same shall be referred to the Minister for Railways for
determination, and his decision shall be final and conclusive.
