Defining the Middle Line of Further Portion of the Railway from the Main Line of the Waitaki-Bluff Railway to Oteramika and Toitois (Seaward Bush Branch, Mataura Section).

A PROCLAMATION.
WHEREAS the railway from the main line of the Waitaki-Bluff Railway to Oteramika and Toitois is one of the railways specified in the Schedule to "The Railways Authorisation Act, 1881," which Act is, in the fifth section thereof, declared to be a special Act authorising the construction of such railway; and such railway is unfinished, and it has been determined to construct and maintain a further portion of the same:
Now, therefore, I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities conferred on me by the aforesaid section five of "The Railways Authorisation Act, 1881," and by sections one hundred and sixty-six and one hundred and sixty-seven of "The Public Works Act, 1894," and in exercise of every other power and authority in anywise enabling me in that behalf, do hereby proclaim and declare that the middle line of the said further portion of the said railway shall be as defined and set forth in the Schedule hereto.
SCHEDULE.
SEAWARD BUSH RAILWAY.
COMMENCING at a point in Bush Reserve, Block VII., Oteramika Hundred, distant about 26 chains in a north-westerly direction from the south-western corner of Section No. 18 of said Block VII., which point is also the point of termination of a portion of the said railway, as described in a Proclamation dated the 3rd February, 1892, and published in the New Zealand Gazette, No. 34, of 28th April, 1892; proceeding thence generally in an easterly direction for a distance of about 6 miles 17 chains 66 links, passing in, into, through, or over the following lands—viz., Bush Reserve and Section No. 18, Block VII.; Sections Nos. 4, 13, 14, 34, 33, and 38, and Reserve Block IX., Oteramika Hundred; Sections Nos. 34, 33, 15, 14, and 25, Block I., Toitois Survey District; Sections Nos. 29, 22, 7, 12, and 24, Block IV., Toitois Survey District—and terminating in said Section No. 24, Block IV., Toitois Survey District, at a point on the Edendale-Toitois Branch of the Waitaki-Bluff Railway distant about 13 chains in a north-easterly direction from the southernmost corner of said Section No. 24; including all adjoining and intervening places, roads, reserves, streams, and watercourses; all in the Provincial District of Otago: in the manner delineated on the plan marked P.W.D. 17374, a copy of which is deposited in the office of the Registrar of the Supreme Court at Invercargill, in the said Provincial District of Otago.
Given under the hand of the Honourable Sir James Prendergast, Knight, Chief Justice, for and on behalf of His Excellency the Governor, and as his duly-appointed Deputy in and over Her Majesty's Colony of New Zealand and its Dependencies;

Proclaiming certain Rivers and Creeks, together with all their Tributaries, in the Provincial Districts of Nelson and Westland to be Watercourses.

A PROCLAMATION.
WHEREAS by the one hundred and fifty-second section of "The Mining Act, 1891" (hereinafter termed "the said Act"), it is enacted that the Governor in Council may from time to time, by Proclamation published in the Gazette, proclaim and declare that any watercourse shall be a watercourse into which tailings, mining débris, and waste water of any kind used in, upon, or discharged from any claim or licensed holding shall be suffered to flow or be discharged:
And whereas not less than ninety days' notice has been published, in the manner provided by the said section, that application has been made to the Governor to proclaim the watercourses hereinafter mentioned, and their tributaries, to be watercourses for the purposes of the said section mentioned:
And whereas no objection to the issue of this Proclamation has been transmitted to the Governor, and His Excellency has decided to exercise the powers conferred upon him by the said Act:
Now, therefore, His Excellency the Right Honourable David, Earl of Glasgow, the Governor of the Colony of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby proclaim and declare that the following rivers and creeks, and all their tributaries, in the Provincial Districts of Nelson and Westland, shall be watercourses into which tailings, mining débris, and waste water of every kind used in, upon, or discharged from any claim or licensed holding adjacent to such watercourse shall be suffered to flow or be discharged; and, with the like advice and consent, His Excellency doth hereby prescribe that this Proclamation shall take effect on and after the first day of June, one thousand eight hundred and ninety-five.
NELSON PROVINCIAL DISTRICT.

That river known as the Matakikaki River, and all its tributaries, from its source to where it discharges into the Buller River.

That creek known as Black Ball Creek, and all its tributaries, from its source to the point where it discharges into the Grey River, on the north side, opposite Nelson Creek.

That creek known as Ford's Creek, and all its tributaries, from its source to the point where it discharges into the Grey River, on the north side, opposite Nelson Creek.
WESTLAND PROVINCIAL DISTRICT.

That river known as the Mikonui River, which flows westerly, from its source east of Bald Hill, for a distance of about eighteen miles, to the ocean; and also the several tributaries thereof.

That river known as the Waitaha River, which flows westerly, from its source in the Waitaha Glacier, for a distance of about twenty-five miles, to the ocean; and also the several tributaries thereof.

That river known as the Wanganui River, which flows westerly, from its source in the Evans Glacier, for a distance of about thirty-seven miles, to the ocean; and also the several tributaries thereof.

That river known as the Poerua River, which flows westerly, from its source near Mount Peterman, on the Southern Alps, for a distance of about twenty-six miles, to the ocean; and also the several tributaries thereof.

That river known as the Wataroa River, which flows westerly, from its source in the Whymper Glacier, for a distance of about thirty-two miles, to the ocean; and also the several tributaries thereof.

That river known as the Waitangitaona River, which flows westerly, from its source in the Price Range, for a distance of about thirty-two miles, to the ocean; and also the several tributaries thereof.

That river known as the Waitangiroto River, which flows westerly, from its source in the Bird Hills, for a distance of about four and a half miles, to its confluence with the Waitangitaona; and also the several tributaries thereof.
