Regulations for First Election of Members of the Middle District of New Zealand University College Council.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this nineteenth day of February, 1895.

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.
BY virtue of the powers and authorities vested in me by "The Middle District of New Zealand University College Act, 1894," I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, do hereby order that the regulations specified in the Schedule hereto shall be regulations under and subject to which the first election shall be conducted of persons to be elected to be members of the Middle District of New Zealand University College Council by members of the General Assembly.
SCHEDULE.

THE Secretary for Education shall be the Returning Officer, and shall forthwith prepare a roll containing the names and addresses of the members of the General Assembly who are electors within the meaning and for the purposes of section 4 of the said Act.

Such roll shall be open for inspection at the Education Office, Government Buildings, Wellington, for seven days before the 28th February, 1895.

Claims for enrolment and objections to names enrolled must be made to the Returning Officer, in writing, on or before the 28th February, 1895.

All claims and objections so made shall be determined by the Returning Officer, by notice in writing given or posted to the claimant or objector on or before the 4th March, 1895.

Any person aggrieved by such determination may appeal to the Stipendiary Magistrate at Wellington by summons to be issued from the Magistrate's Court within seven days after the giving or posting of such notice as aforesaid.

Such summons shall be served on the Returning Officer at least two days before the day of hearing, which shall be not later than the 18th March, 1895.

Such summons shall set forth the particulars of the claim or objection, the grounds upon which it is based, and shall call on the Returning Officer to show cause why it should not be allowed.

The Magistrate shall hear and finally determine the appeal at Wellington. No Court fees shall be charged or costs allowed in connection therewith.

So soon as all appeals have been disposed of, the roll shall be made up and closed, and the Returning Officer shall forthwith send to every elector a copy of these regulations and a nomination-paper in the form following:—

Every elector may nominate four candidates, and no more.

Nomination-papers, duly filled up and signed, may be sent to the Returning Officer at Wellington, and may there be received by him not later than the 31st day of March, 1895.

No person shall be eligible for election unless he shall send, and the Returning Officer shall receive from him, not later than the 8th day of April, 1895, his consent in writing to be nominated for election.

On or before the 11th day of April, 1895, the Returning Officer shall send to each elector a voting-paper containing a list of all the candidates that have been duly nominated and have given their consent as aforesaid, and such voting-paper shall be in the form or to the effect following :—
NAMES of Candidates for Election to be Members of the Middle District of New Zealand University College Council, April, 1895.
[Insert the Christian names and surnames of all the candidates, arranged in alphabetical order.]
N.B.—The voter must draw a line through the name of every candidate for whom he desires not to vote. He must leave not more than four names uncanceled, or the voting-paper will be invalid.

Voting-papers, duly filled up and signed, may be sent to the Returning Officer at Wellington, and may there be received by him not later than the 22nd day of April, 1895, on which day he shall proceed to ascertain the number of votes duly recorded for each candidate.

The four candidates that have then received the highest number of votes shall be elected. If by reason of an equality of votes given for two or more candidates the election is not complete, the Governor shall choose between the candidates that have equal numbers of votes, and his choice, signified to the Returning Officer, shall determine which of them shall be elected. The Returning Officer shall forthwith, after the election, notify in the New Zealand Gazette the names of the persons elected.

If any dispute or difference shall arise in respect of such election the same shall be determined by the Governor, by writing under his hand, a copy whereof shall be published in the New Zealand Gazette.
