Maihi, Epanaia Whanga, Wi Haterei, Hirini Kereru, Hirini Takatoroa, Hirini Maru (as trustee for Wikitoria Kanu), and Wikitoria Kanu, all of Te Mahia aforesaid, aboriginal natives, of the one part, and the East Coast Native Land and Settlement Company (Limited), at the time of the said transaction a joint-stock company, duly incorporated under "The Companies Act, 1868." The consideration agreed upon between the said parties was £1,500.

In the matter of the Kaiwaitau Block: A memorandum of transfer, bearing date the 14th day of October, 1881, and made between Hirini Whanga, Ihaka Maihi, Epanaia Whanga, Te Teira Toheriri, Te Rina te Apatu, Hirini Whanga, and Ihaka Maihi (as trustees for the infant children of Ihaka Whanga, deceased), all of Te Mahia aforesaid, aboriginal natives, of the one part, and the company aforesaid of the other part. The consideration agreed upon between the said parties was £1,000.

In the matter of the Tawapata North No. 2 Block: A memorandum of transfer, bearing date the 14th day of October, 1881, and made between Harata Nohotau mata, Watene Paeoneone, Mihi te Riria, Hirini Tahinakau, Hirini Whanga, Ihaka Maihi, Epanaia Whanga, Hine Kanu, Hirini Whanga, and Ihaka Maihi (as trustees for the infant children of Ihaka Whanga, deceased), all of Te Mahia aforesaid, aboriginal natives, of the one part, and the company aforesaid of the other part. The consideration agreed upon between the said parties was the sum of £1,500.

In the matter of the Tawapata South Block: A deed of conveyance, bearing date the 14th day of October, 1881, and made between Watene Paeoneone, Tamati Matangahia, Maraea Newa Maea, Maata Kuawa, Ihaka Kemara, Tiripa Pokaia, Tamati Matangahia (as trustee for the successors to Wi Kini kini), Maraea te O (as trustee for Herewini Pataru), Ihaka Maihi, Epanaia Whanga, Hirini Whanga, Te Rua Huihui, and Kara Waipukepeka, all of Te Mahia aforesaid, aboriginal natives, of the one part, and the company aforesaid of the other part. The consideration agreed upon between the parties was the sum of £2,500.

In the matter of the Nukutaurua Block: A deed of conveyance, bearing date the 14th day of October, 1881, and made between Raniera Taraira, Ema Kaimoke moke, Hirini Maru, Hirini Maru (as trustee for Wikitoria Kanu), Ihakara Waipakiaka, Tamihana te Waitatakina, Maraea te O (as trustee for Herewini Pataru), Hirini Whanga, Hirini Whanga (as trustee for the infant children of Ihaka Whanga, deceased), Epanaia Whanga, Ahenata te Maire, Wikitoria Kanu, Ihaka Maihi, and Ihaka Maihi (as trustee for the infant children of Ihaka Maihi, deceased), all of Te Mahia aforesaid, aboriginal natives, of the one part, and the company aforesaid of the other part. The consideration agreed upon between the said parties was the sum of £1,500.

In the matter of the Whangawehi No. 1 Block: A deed of conveyance, bearing date the 14th day of October, 1881, and made between Ihaka Kaiwehe, Te Teira Toheriri, Ihaka Maihi, Ihaka Maihi (as trustee for the infant children of Ihaka Whanga, deceased), Epanaia Whanga, Hirini Whanga, Hirini Whanga (as trustee for the infant children of Ihaka Whanga, deceased), Mata Kinikini and Te Teira Toheriri (as trustees for the successors to Wiremu H. Kinikini), all of Te Mahia aforesaid, aboriginal natives, of the one part, and the company aforesaid of the other part. The consideration agreed upon between the parties was £1,500.

In the matter of the Moutere No. 1 Block: A deed of conveyance, bearing date the 14th day of October, 1881, and made between Hirini Maru, Hirini Maru (as trustee for Wikitoria Kanu), Raniera Taraira, Wi Haterei, Mihi te Rina, Hirini Whanga, Ahenata te Maire, Ihaka Maihi, Epanaia Whanga, and Wikitoria Kanu, all of Te Mahia aforesaid, aboriginal natives, of the one part, and the company aforesaid of the other part. The consideration agreed upon between the parties was the sum of £350.

In the matter of the Moutere No. 2 Block: A deed of conveyance, bearing date the 14th day of October, 1881, and made between Aroha Ngawiki and Te Peka Mangungu, both of Te Mahia aforesaid, aboriginal natives, of the one part, and the company aforesaid of the other part. The consideration agreed upon between the said parties was £400.

And in the matter of the Kinikini Block: A deed of conveyance, bearing date the 14th day of October, 1881, made between Hirini Whanga, Hirini Whanga and Ihaka Maihi as trustees for the infant children of Ihaka Whanga, deceased), Ihaka Maihi, and Epanaia Whanga, all of Te Mahia aforesaid, aboriginal natives, of the one part, and the company aforesaid of the other part. The consideration agreed upon between the parties was £150.

D. The lands which were intended to be alienated are the interests and shares of the persons before mentioned in the several blocks of land before mentioned. The areas of the said blocks, and the titles thereto of the respective alienors at the time of the said alienations, were as follows:—
Tawapata North No. 1 Block, 2,734 acres: Title, grant from the Crown bearing date the 7th day of September, 1872.
Kaiwaitau Block, 1,470 acres: Title, grant from the Crown bearing date the 13th day of July, 1872.
Tawapata North No. 2 Block, 3,710 acres: Title, grant from the Crown bearing date the 7th day of September, 1872.
Tawapata South Block, 10,408 acres: Title, grant from the Crown bearing date the 4th day of March, 1868.
Nukutaurua Block, 3,452 acres: Title, grant from the Crown bearing date the 4th day of March, 1868.
Whangawehi No. 1 Block, 3,071 acres: Title, grant from the Crown bearing date the 4th day of March, 1868.
Moutere No. 1 Block, 389 acres: Title, grant from the Crown bearing date the 9th day of February, 1871.
Moutere No. 2 Block, 465 acres: Title, grant from the Crown bearing date the 9th day of February, 1871.
Kinikini Block, 115 acres: Title, grant from the Crown bearing date the 26th day of October, 1871.

E. The estates or interests in the said blocks which the applicants seek to obtain through the aid of the Court are estates or interests of freehold.

F. The manner in which the applicants came to be invested with the titles they now hold to the lands before mentioned is, in regard to each block, as follows:—
(1.) Mortgages, dated the 3rd day of July, 1888, by the said company to the Bank of New Zealand, whereby, in consideration of the sum of £135,000 lent and advanced by the said bank to the said company, the said company mortgaged to the said bank (inter alia) all the estate and interest of the said company in the said blocks of land.
(2.) Assignments, dated the 5th day of August, 1890, by the said bank to the Bank of New Zealand Estates Company (Limited), of all the estate and interest of the said bank in and to, inter alia, the said blocks of land.
(3.) Assignments, dated the 10th day of July, 1891, by the Registrar of the Supreme Court at Gisborne (upon default under the mortgages above mentioned) to the Bank of New Zealand Estates Company (Limited).
(4.) Memorandum of agreement, bearing date the 17th day of February, 1892, between the Bank of New Zealand Estates Company (Limited) of the first part, William Lee Rees, solicitor, of the second part, and the applicants herein of the third part, whereby, for the considerations in the said agreement set forth, the said Bank of New Zealand Estates Company (Limited) agreed to transfer to the applicants herein the estate and interest of the said last-mentioned company, inter alia, to the said blocks of land.

G. The address for service of the applicants in the Town of Gisborne, where notices and other documents may be served upon them by leaving the same at such place for them, is at the office of Messrs. Rees and Day, solicitors, situate in Gladstone Road, Gisborne aforesaid.

H. The applicants desire the estates and interests of the several Native persons mentioned in paragraph C of this application, and all persons claiming through them, bound by the decree of the Court, and for that purpose require that copies of this application shall be served on them. The names of the persons upon whom the applicants require that copies of this application shall be served are set out in the paper-writing hereto annexed. The applicants desire that all other persons who may claim to be interested in the validation applied for shall be treated as parties to these proceedings; but the applicants are unable to specify any names of persons other than those set forth in the list hereto annexed.
