✨ Licensing and Regulations




  1. Any person authorised by the Minister may at all reasonable times enter upon the said wharf and view the state of repairs thereof; and upon such Minister leaving at or posting to the last known address of the Board a notice in writing of any defect or want of repair in such wharf, requiring it, within a reasonable time, to be therein prescribed, to repair the same, it shall with all convenient speed cause such defect to be removed or such repairs to be made.

  2. Nothing herein contained shall authorise the Board to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs, or any regulation of the Commissioner of Trade and Customs, or with any provisions of "The Harbours Act, 1878," or its amendments, or any regulations made thereunder, and that are now or may hereafter be in force.

  3. The ballast of all vessels loading at the said wharf shall be taken away by the Board and deposited above high-water mark, or at such place as may be approved of by the Minister, by the Harbourmaster for Manukau, or by any person appointed by the Minister for that purpose.

  4. The rights, powers, and privileges conferred by or under this Order in Council shall continue to be in force for fourteen years from the date hereof, unless in the meantime such rights, powers, and privileges shall be altered, modified, or revoked by competent authority; and the Board shall not assign, charge, or part with any such right, power, or privilege without the previous written consent of the Minister first obtained.

  5. The said rights, powers, and privileges may be at any time resumed by the Governor, without payment of any compensation whatever, on giving to the Board six calendar months' previous notice in writing. Any such notice shall be sufficient if given by the Minister, and delivered at or posted to the last known address of the Board.

  6. The Board shall keep a separate account of the receipts and expenditure on account of the wharf, and shall appoint all officers necessary for the control and management of the wharf.

  7. The Board shall be liable for any injury which the said wharf may cause any vessel or boat to sustain through any default or neglect on its part.

  8. In case the Board shallβ€”

(1.) Commit or suffer a breach of the conditions hereinbefore set forth, or any of them; or

(2.) Cease to use or occupy the said wharf for a period of thirty days;

then and in either of the said cases this Order in Council, and every license, right, power, or privilege, may be revoked and determined by the Governor in Council without any notice to the Board or other proceeding whatsoever; and publication in the New Zealand Gazette of an Order in Council containing such revocation shall be sufficient notice to the Board, and to all persons concerned or interested, that this Order in Council, and the license, rights, and privileges thereby granted and conferred, have been revoked and determined.

WHEREAS by the third section of "The Lunatics Act, 1882," it is enacted, inter alia, that the Governor, by Order in Council, may from time to time direct that all or any of the powers, functions, duties, and authorities by the said Act vested in or required to be performed by the Colonial Secretary shall be exercised by any person the Governor may think fit: And whereas it is expedient that the said powers should be vested in the person and in the manner hereinafter expressed:

Now, therefore, His Excellency the Governor, by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth hereby direct that the powers granted to the Colonial Secretary by the sixth section of the said Act shall be exercised by

HENRY WILLIAM NORTHCROFT, Esq., of Auckland, within the Provincial District of Auckland, in the said colony.

Regulation under "The Fisheries Conservation Act, 1884."

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-seventh day of January, 1894.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS by "The Fisheries Conservation Act, 1884," it is, among other things, provided that the Governor in Council may from time to time make, alter, and revoke regulations providing for the more effectual protection and improvement of fish, and the management of any waters in which fishing is carried on: And whereas fishing is carried on in the several waters and streams hereinafter mentioned, and it is expedient to make further provision for the protection of fish in such waters:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the regulation set forth in the First Schedule hereto, and doth hereby declare that such regulation shall have effect in the several waters, streams, and places set forth in the Second Schedule hereto.

FIRST SCHEDULE.

REGULATION.

It shall be lawful for any Collector of Customs, constable, or officer appointed under "The Fisheries Conservation Act, 1884," to inspect and examine the contents of any creel, bag, basket, or other receptacle used by or in possession of any person found in, upon, or in the neighbourhood of any stream or water in which trout or salmon have been liberated, with a view to ascertaining whether any salmon or trout have been unlawfully taken from such stream or water.

SECOND SCHEDULE.

THE waters, streams, and places in which the foregoing regulation shall have effect are the following, viz.:-

The waters and streams in the Counties of Collingwood, Waimea, Sounds, Marlborough, Kaikoura, Amuri, Cheviot, Ashley, Selwyn, Akaroa, Ashburton, Mackenzie, Geraldine, Waimate, Waitaki, Vincent, Maniototo, Waihemo, Wai-kouaiti, Peninsula, Taieri, Tuapeka, Bruce, Clutha, Lake, Southland, Wallace, and Fiord.

Vesting a Reserve in the Southland County Council.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-seventh day of January, 1894.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto was reserved permanently for a gravel-pit on the twelfth day of October, one thousand eight hundred and ninety-three:

And whereas in the opinion of the Governor it is expedient to vest the said land in the Southland County Council:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of "The Public Reserves Act, 1881," doth hereby declare that from and after the day of the date hereof the reserve mentioned in the Schedule hereto shall become vested in the Chairman, Councillors, and inhabitants of the Southland County, and under the control and management of the Council of such county, in trust, for a gravel-pit.

SCHEDULE.

ALL that parcel of land in the Provincial District of Otago, containing by admeasurement 7 acres 1 rood 8 perches, more or less, being Section No. 50, Block II., Oteramika Survey District, and bounded as follows: On the north-east by Block XI., 1500 links; on the south-east by a road-line, 500 links; on the south-east by Section No. 27, 1500 links; and on the north-west by Section No. 27, 500 links: be all the aforesaid linkages more or less; as the same is delineated on the plan deposited in the office of the Chief Surveyor, Invercargill.
