Further Portions of Westport Colliery Reserve set apart for Railway Purposes.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fourth day of September, 1894.

Present:

His Excellency THE GOVERNOR IN COUNCIL.

WHEREAS by section three of “The Westland and Nelson Coalfields Administration Act 1877 Amendment Act, 1893,” it is, inter alia, enacted that the Governor, by Order in Council, shall define such portions of the Westport Colliery Reserve, in addition to the portions thereof already set apart for railway purposes by an Order in Council of the twenty-third day of February, one thousand eight hundred and seventy-six (Gazette, 1876, page 200), as are likely to be required for railway purposes or other public purposes, and shall set apart such further portions for the aforesaid purposes accordingly:

And whereas it is desirable that the portions of the said reserve described in the Schedule hereto should be set apart as aforesaid:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the hereinbefore in part recited Act, and of all other powers and authorities in anywise enabling him in that behalf, and by and with the advice and consent of the Executive Council of the said colony, doth hereby define the portions of the Westport Colliery Reserve mentioned and described in the Schedule hereto as likely to be required for railway purposes, and doth hereby set apart the same for railway purposes accordingly.

SCHEDULE.

ALL that parcel of land in the Borough of Westport, containing by admeasurement 1 rood 33 perches, more or less, bounded towards the north by Kennedy Street; towards the east by Sections Nos. 93 and 100; towards the south by Wallabi Street; and towards the west by the Buller River.

Also all that parcel of land in the Borough of Westport, containing by admeasurement 1 rood 24 perches, more or less, bounded towards the north by Wallabi Street; towards the east by Section No. 114; towards the south by Bright Street; and towards the west by the Buller River.

Also all that parcel of land in the Borough of Westport, containing by admeasurement 2 roods, more or less, bounded towards the north by Bright Street; towards the east by Sections Nos. 48 and 55; towards the south by Lyttelton Street; and towards the west by Wharf Street.

Also all that parcel of land in the Borough of Westport, containing by admeasurement 2 roods 20 perches, more or less, bounded towards the north by Lyttelton Street; towards the east by Sections Nos. 73 and 80; towards the south by Cobden Street; and towards the west by Wharf Street.

Also all that parcel of land in the Borough of Westport, containing by admeasurement 3 roods, more or less, bounded towards the north by Cobden Street; towards the east by Sections Nos. 128 and 135; towards the south by Nelson Street; and towards the west by Wharf Street.

As the same are delineated on the plan marked S.G. 16829, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Land District of Wellington, and thereon coloured yellow.

Rural Lands in the Auckland Land District open for Sale or Selection.

GLASGOW, Governor.

IN pursuance and exercise of the powers and authorities conferred upon me by the one hundred and thirty-sixth section of “The Land Act, 1892,” I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, having received the report of the Surveyor-General in this behalf, as in the said section is provided, do hereby declare that the rural lands described in the Schedule hereto shall be open for sale or selection on and after the fourteenth day of November, one thousand eight hundred and ninety-four; and also that the

lands mentioned in the said Schedule may, at the option of the applicant, be purchased for cash, or be selected for occupation with right of purchase or on lease in perpetuity, or, in respect of any lands containing or supposed to contain any metal, mineral, or valuable stone, be selected on lease in perpetuity only; and I do hereby also fix the prices at which the said lands shall be sold, occupied, or leased, as mentioned in the said Schedule hereto, and do declare that the said lands shall be sold, occupied, or leased under and subject to the provisions of “The Land Act, 1892.”

SCHEDULE.

AUCKLAND LAND DISTRICT.—UNSURVEYED SECOND-CLASS LAND.

Rodney County.

ALL that parcel of land in the Auckland Land District, situate in the Parish of Ahuroa, containing approximately 550 acres. Bounded towards the north generally by Sections Nos. 74 and 95 of the Parish of Ahuroa; towards the east by Sections Nos. 19 and 18 of the same parish; towards the north-east generally by a public road; towards the south by Sections Nos. 83 and 87 of the Parish of Ahuroa aforesaid; and towards the west generally by a public road and by the proposed extension of the Kaipara Railway to the point of commencement.

Description of Land: Broken forest land, sandstone and clay soil; situate about six miles from Komokoriki Post-office, and about nine miles from Puhoi.

Cash price, 10s. per acre; occupation with right of purchase, 6d. per acre; lease in perpetuity, 4·8d. per acre.

Tauranga County.

All that parcel of land in the Auckland Land District, situate in Blocks IV., VIII., and XII., Aroha Survey District, and Blocks I. and IV., Katikati Survey District, containing approximately 7,250 acres. Bounded, towards the north-east generally by the Waihi-Katikati Road and by Sections Nos. 1, 2, 3, 4, 7, 8, and 9 of Block I., Katikati Survey District; towards the south-east by Section No. 95 of the Parish of Katikati, by Sections Nos. 62 and 64 of the Parish of Tahawai, by a public road, and again by Section No. 64 aforesaid; towards the south by Sections Nos. 23, 11, and 15 of Block IV., Katikati Survey District; towards the west by a right line, being the production in a northerly direction of the western boundary of the last-named section; again towards the south by Block IV., Katikati Survey District aforesaid; towards the north-west and again towards the south by Section No. 1 of Block VIII., Aroha Survey District; again towards the west by the western boundary of the block last mentioned; and again towards the north-west by part of the south-eastern boundary of Ohinemuri County to the point of commencement.

Description of Land: About two-thirds open land, one-third bush; situate about a mile from Athenree Post-office.

Cash price, 7s. 6d. per acre; occupation with right of purchase, 4·5d. per acre; lease in perpetuity, 3·6d. per acre.

Manukau County.

All that parcel of land in the Auckland Land District, situate in the Parish of Mangatawhiri, containing approximately 1,975 acres. Bounded towards the north generally by the stream which forms the southern boundary of Sections Nos. 188, 118, and 109 of the Parish of Mangatawhiri, by Sections Nos. 91 and 134 of the same parish, by a public road, and by Section No. 135 of the same parish; towards the north-east by a public road; towards the south generally by Section No. 142 of the Parish of Mangatawhiri aforesaid, by a public road, by Sections Nos. 185A and 185 of the same parish, by a public road, and by Sections Nos. 116, 92, and 114 of the same parish; and towards the north-west generally by a public road and Sections Nos. 233 and 235 of the same parish to the point of commencement.

Description of Land: Broken land of poor quality, mostly forest; situate about six miles from Bombay Post-office.

Cash price, 5s. per acre; occupation with right of purchase, 3d. per acre; lease in perpetuity, 2·4d. per acre.
