upon all rateable property in the borough as security for the interest on such loan, and for the purpose of providing such sinking fund, such special rate to be made previously to the receipt by the Council of any part of the loan; and that debentures be issued for such loan, each to be for a term of twenty years, with interest at the rate of £5 per centum per annum.

And I also give you notice that the following was the result of the said poll: Number of burgesses who voted in favour of the proposal, 415; number of votes to which the said burgesses were entitled, 693; number of burgesses who voted against the proposal, 8; number of votes to which the said last-mentioned burgesses were entitled, 8; number of informal votes, 3: and that, the total number of burgesses upon the roll being 625, and the total number of votes to which they were entitled being 959, I declared the said proposal carried; and I hereby also give you notice that the said proposal was carried.

In the matter of “The Municipal Corporations Act, 1886,” Part IX.

I, Freeman Rayney Jackson, of the Town of Wanganui, auctioneer, Mayor of the Borough of Wanganui, do solemnly and sincerely declare,—1. That all proceedings required by the said Act to be taken in or towards obtaining the sanction of the burgesses of the Borough of Wanganui to a proposal of the Council of the said borough to borrow the sum of £55,000 by way of special loan under the provisions of the said Act (a copy of which proposal is contained in the voting-paper hereto annexed, and marked “A”) have been duly taken. 2. That upon a poll of the said burgesses, taken on the 7th day of April, 1894, the said proposal was duly carried.

And I make this solemn declaration conscientiously believing the same to be true, and by virtue of the provisions of an Act of the General Assembly of New Zealand intituled “The Justices of the Peace Act, 1882.”

Result of Poll for Proposed Loan, County of Wairarapa North.

THE following notice, received from the Chairman of the Wairarapa North County Council, is published in accordance with the provisions of “The Local Bodies’ Loans Act, 1886.”

RESULT of a poll taken upon the 25th April, 1894, on a proposal to raise a loan of £500 for metalling on the Te Oreore-Bideford Road :—

Number of ratepayers on special roll, 30, exercising 63 votes: Number of ratepayers who voted in favour of the proposal, 21, exercising 45 votes; number of ratepayers who voted against the proposal, nil.

As a majority in number of the ratepayers voted in favour of the proposal, and the number so voting are entitled to more than one-half in number of the votes which can be exercised by the whole number of ratepayers, I declare the proposal to be carried.

Special Order made by the Waipipi Road Board, County of Manukau.

THE following special order, made by the Waipipi Road Board, is published in accordance with the provisions of “The Road Boards Act, 1882.”

SPECIAL ORDER made by the Waipipi Road Board on the 10th February, 1894, and confirmed on the 17th March, 1894.

THAT a special rate of ½d. in the pound be made on all the rateable property in the No. 4 Subdivision of the Waipipi Road District, for the purpose of paying interest and sinking fund on a loan of £80, to be obtained under the provisions of “The Government Loans to Local Bodies Act, 1886,” for the purpose of extending and improving the Waipipi Wharf; the said rate to be an annually-recurring rate for twenty-six years.

I certify the foregoing to be a true copy of a special order made by the Waipipi Road Board on the 10th February, 1894, and confirmed on the 17th March, 1894.

Additional Regulations for the Conduct of Legal Business.

REGULATIONS, additional to those of 3rd March, 1890, respecting the employment of counsel and solicitors on behalf of the Government, &c., which have been approved by His Excellency the Governor in Council:—

Costs of Trials.

  1. Nos. 38, 39, 41, and 51 of the said regulations are hereby revoked, and the following regulations are made in lieu thereof:—

In proceedings on trials of indictable offences, fees and costs to Crown Solicitors will be allowed as follows:—

As solicitor—
(1.) Preparing case for and attending trial .. £ s. d.

(2.) For each separate indictment in respect of which separate depositions have been taken, the above fee will be allowed.
(3.) But where there are several prosecutions against the same person or persons, and one set of depositions only has been taken, the solicitor will be allowed for each case going to trial after the first case .. 1 1 0
(4.) And where the prosecution is against some person or persons upon facts elicited by depositions taken in respect of a charge made against some other person or persons; or on facts which have in any manner come to the knowledge of the solicitor during, or in consequence of, his investigation of a charge made against some other person or persons upon depositions taken in respect of such charge .. .. .. .. 1 1 0

The fees above prescribed will cover all charges for issue of subpoenas, for procuring and issue of process to bring up witnesses in custody, entry of nolle prosequi, and all other proceedings directly connected with or incidental to the trial.

(7.) If the Crown declines to offer any evidence or enters a nolle prosequi without evidence being given in support of the indictment .. 1 1 0
(8.) In cases where the jury is unable to agree, and there is another trial, no additional fee will be allowed to the solicitor, but fees according to scale will be allowed to counsel.

Allowances to Witnesses.

  1. Allowances will be made to prosecutors and witnesses for the Crown as follows:—

To medical practitioners giving evidence strictly as experts, for every day’s attendance at Court, or necessary absence from usual place of abode .. £ s. d.

Except as above, to every prosecutor and witness, for every day’s attendance at Court or necessary absence from usual place of abode .. 0 6 0

And in addition thereto, for every night’s necessary absence from such place of abode .. 0 4 0

Persons in receipt of salary or wages from the Government or from the New Zealand Railway Commissioners, or from any Council, Board, or other authority, however designated, which receives pecuniary aid or subsidy out of moneys appropriated or provided by the General Assembly under any law now or hereinafter in force, will be entitled to such allowances if necessarily absent at night from their usual place of abode. If not absent at night from their usual place of abode such persons will be allowed only their actual personal expenses.

Medical practitioners being officers of hospitals giving expert evidence will be paid at the same rate as other medical practitioners; but this provision shall not apply to any medical practitioner employed in the Civil Service of the colony.
