the Westport Cardiff Coal Company (Limited) and (subject to the company obtaining the consent of the lawful authority in that behalf) its assigns, and its or their servants and workmen, full and free liberty of making, and using when so made, a railway and tramway over the lands described in the Schedule hereto for the purpose of connecting any coal-mines on lands subject to the said Act with the railway of the Mokihinui Coal Company (Limited); such railway and tramway to be constructed in accordance with the approved plans and specifications of same already deposited in the office of the Minister for Public Works at Wellington: Provided, however, that the authority hereby given shall be concurrent with the company's coal-mining lease from the Queen, dated the tenth day of March, one thousand eight hundred and ninety-three, and being for a term of sixty-six years from the first day of March, one thousand eight hundred and ninety-three; and such authority shall determine without further notice at the expiration of the said sixty-six years, or at such prior time as the term created by the said lease may expire or in any manner be determined: Provided, further, that the right is hereby reserved to Her Majesty, or any of her officers, servants, or agents on her behalf, at any time to construct and maintain for the public use roads or public highways over any portion of the lands mentioned in the Schedule hereto that is not occupied by the railway or tramway aforesaid, and to construct such roads or public highways across the said railway or tramway, if necessary, at any point or points that may be considered by Her said Majesty, or any of her officers, servants, or agents, to be convenient or suitable for the purpose; and also that the Governor, on behalf of Her said Majesty, may at any time permit the Council of the County of Buller, or any Road Board or local authority which is now or may hereafter be legally constituted in the district in which the said lands are situated, to construct and maintain for the public use roads or public highways over such lands upon the like condition: Provided also that in the event of the company or its assigns obstructing the making or use of such roads or public highways, or in any way refusing to carry out or comply with the provisions of this order, the Governor may determine the authority hereby given by serving the company or its assigns with a notice in writing in that behalf, and, upon the service of such notice upon the company at its last known registered office or at the last known place of residence or business of its assigns or any of them, as the case may require, the said authority shall absolutely determine.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-fourth day of April, 1894.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

IN exercise and pursuance of the powers and authorities vested in him by "The Public Domains Act, 1881," His Excellency the Governor of the Colony of New Zealand, acting with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the second day of April, one thousand eight hundred and eighty-three, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present Order, delegate, but only with respect to the piece or parcel of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to

THE MAYOR, COUNCILLORS, AND BURGESSES OF THE BOROUGH OF WINTON,

which shall be known as the Winton Domain Board (herein referred to as "the Board"), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the third Monday in each month, at three o'clock p.m., at the Borough Council Offices, Winton, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Monday, the twenty-first day of May, one thousand eight hundred and ninety-four.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days' notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the third Monday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

  6. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

SCHEDULE.

ALL that parcel of land in the Land District of Southland, containing by admeasurement 3 acres 2 roods, more or less, being Sections Nos. 7, 8, 9, 10, 11, 12, 13, 17, 18, 19, 20, 21, 22, and 23, Block X., Town of Winton. Bounded on the north by John Street, 700 links; on the east by Sections Nos. 14 and 16 of said Block X., 500 links; on the south by Essex Street, 700 links; and on the west by a road-line, 500 links.

IN exercise and pursuance of the powers and authorities vested in him by "The Public Domains Act, 1881," His Excellency the Governor of the Colony of New Zealand, acting with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the fourteenth day of July, one thousand eight hundred and eighty-eight, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present Order, delegate, but only with respect to the piece or parcel of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Darfield Public Domain Board, namely,—

WILLIAM LONG,

EDWIN SMITH,

ROBERT REID, and

DONALD GILLANDERS

(herein referred to as "the Board"), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the third Monday in each month, at half-past seven o'clock p.m., at the Schoolroom, Darfield, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Monday, the twenty-first day of May, one thousand eight hundred and ninety-four.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days' notice of such meeting be given to each member, specifying the business to be transacted at such special meeting, and no other business than that so specified shall be transacted at such meeting.
