Vesting Control of Litchfield's Bridge in Omaka Road Board.

A PROCLAMATION.

WHEREAS by section four of “The Public Works Acts Amendment Act, 1887” (hereinafter termed “the said Act”), it is, inter alia, enacted that the Governor may, upon the terms and conditions in the said section mentioned, by Proclamation publicly notified, direct that any bridge already constructed, or which may hereafter be constructed, over or across any river or arm of the sea respectively shall, from and after a date to be fixed in such Proclamation, be under the exclusive care, control, and management of such local authority as shall be mentioned in that behalf in such Proclamation; and may, by any such Proclamation as aforesaid, fix and determine whether all or any, and, if so, what, part of the cost of maintaining, repairing, improving, or reconstructing any such bridge is to be paid by the local authority or local authorities, and, if so, by what local authority or authorities; and may, by any such Proclamation as aforesaid, direct how, when, and to whom any such payment is to be made:

And whereas it is expedient that provision should be made under the hereinbefore in part recited Act for the purposes hereinafter mentioned:

Now, therefore, I, James Prendergast, in the name and on behalf of His Excellency the Governor of the Colony of New Zealand, and as his duly-appointed Deputy, in exercise and pursuance of the powers and authorities in him vested by the said Act, and of every other power and authority in anywise enabling him in this behalf, do hereby direct that the bridge mentioned in the Schedule hereto, and known as Litchfield’s Bridge, shall, from and after the date of this Proclamation, be under the exclusive care, control, and management of the Omaka Road Board; and, in further pursuance and exercise of the powers aforesaid, I do hereby fix and determine that the cost of maintaining, repairing, improving, or reconstructing the said bridge is to be provided and paid by the local authorities hereinafter mentioned in the following proportions: namely, the Omaka Road Board, fifty per centum; and the Wairau Road Board, fifty per centum. And I do also hereby direct that the contribution hereby required to be made as aforesaid by the Wairau Road Board towards the cost of maintaining, repairing, improving, or reconstructing the said bridge shall be paid from time to time, in the proportion hereinbefore prescribed, by the Wairau Road Board, out of the Road Board Fund of the said Wairau Road District, within a period of ten days after a demand in writing, made by or on behalf of the Omaka Road Board, stating the amount so required to be paid and the purpose for which it is so required, shall have been left at the office of the Wairau Road Board; and the payments so to be made shall be made from time to time to the Clerk of the Omaka Road Board for and on behalf of the Omaka Road Board.

SCHEDULE.

THAT bridge over the Omaka River, known as Litchfield’s Bridge, situated on the Middle Renwick Road, on the main road leading from Blenheim to the Wairau Valley, in the Omaka Road District, Land District of Marlborough: as the same is delineated on the plan marked S.G. 20572, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Land District of Wellington, and thereon marked in red.

Given under the hand of the Honourable Sir James Prendergast, Knight, Chief Justice, for and on behalf of His Excellency the Governor, and as his duly-appointed Deputy in and over Her Majesty’s Colony of New Zealand and its Dependencies; and issued under the seal of the said Colony, at the Government House, at Wellington, this eighth day of November, in the year of our Lord one thousand eight hundred and ninety-three.

Defining the Middle Line of a Further Portion of the Otago Central Railway (Hyde-Kyeburn Section).

A PROCLAMATION.

WHEREAS the Otago Central Railway (hereinafter termed “the said railway”) is a railway the con-
struction of which is authorised by “The Public Works Act, 1879”: And whereas the said railway has been partly constructed, and it has been determined to construct and maintain a further portion of the same:

Now, therefore, I, James Prendergast, Knight, Chief Justice, in the name and on behalf of His Excellency the Governor of the Colony of New Zealand, and as his duly-appointed Deputy, in exercise and pursuance of the powers and authorities conferred by “The Public Works Act, 1879,” and “The Public Works Act, 1882,” and in exercise of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the middle line of the said further portion of the said railway shall be that defined and set forth in the Schedule hereto.

SCHEDULE.

COMMENCING at a point on the eastern boundary of Section No. 18, Block III., Township of Hyde, and distant about 25 links from the south-east corner thereof, the said point being the termination of a portion of the railway as described in a Proclamation dated the 22nd July, 1892, and published in the New Zealand Gazette No. 62, of the 5th August, 1892; proceeding thence generally in a northerly direction for a distance of nine miles, and passing in, into, through, or over the following lands: viz., Sections 18 and 17, Block III., Township of Hyde; Railway Reserve, and Sections 16, 13, 12, 11, 10, and 9, Block VII.; 5, 4, and 13, Railway Reserve, and Section 11, Block III.; Railway Reserve, Block XIII., Rock and Pillar Survey District; and Railway Reserve and Coal Reserve, Block XVI., Maniototo Survey District; and terminating at a point in the said Railway Reserve distant about 5 chains in a north-westerly direction from the north-eastern corner of Section 16, Block XVI., including all adjoining and intervening places, lands, reserves, roads, streams, rivers, and watercourses; all in the Provincial District of Otago: as the same is delineated on the plan marked P.W.D. 17080, a copy of which has been deposited in the office of the Registrar of the Supreme Court at Dunedin, in the said Provincial District of Otago.

Given under the hand of the Honourable Sir James Prendergast, Knight, Chief Justice, for and on behalf of His Excellency the Governor, and as his duly-appointed Deputy in and over Her Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this tenth day of November, in the year of our Lord one thousand eight hundred and ninety-three.

Inglewood Recreation-ground brought under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this seventh day of November, 1893.

Present:

His Excellency the Deputy-Governor in Council.

BY virtue of the powers and authorities vested in me by the twenty-fourth section of “The Public Reserves Act, 1881,” I, Sir James Prendergast, Knight, Chief Justice, in the name and on behalf of His Excellency the Governor of the Colony of New Zealand, and as his duly-appointed Deputy, by and with the advice and consent of the Executive Council of the said colony, do hereby order and declare that the reserve made for public recreation in the Land District of Taranaki, and known as the Inglewood Recreation-ground, and described in the Schedule hereto, shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of “The Public Domains Act, 1881,” and such domain shall hereafter be managed, administered, and dealt with in manner directed by the said Act.

SCHEDULE.

ALL that parcel of land in the Provincial District of Taranaki, containing by admeasurement 2 roods, more or less, being Sections Nos. 73 and 85, Town of Inglewood. Bounded on the north by Section No. 61, 225 links; on the east by Section No. 181, 224 links; on the south by Section No. 97, 225 links; on the west by Elliot Street, 224 links: be all the aforesaid linkages more or less; as the same is delineated on the plan deposited in the office of the Chief Surveyor, New Plymouth.
