Land set apart for Settlement.

A PROCLAMATION.

WHEREAS by the second section of “The Government Loans to Local Bodies Act Amendment Act, 1891” (herein termed “the said Act”), it is, amongst other things, enacted that, before certain moneys therein mentioned shall be expended upon any block of land, it shall be necessary that the same be proclaimed as set apart for settlement:

Now, therefore, in pursuance and exercise of every power and authority enabling me in this behalf, and for the purposes of the said Act, I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, do hereby proclaim the block of land described in the Schedule hereto as set apart for settlement.

SCHEDULE.

MATA-HIKURANGI BLOCK.

ALL that area in the Land District of Hawke’s Bay, being Sections Nos. 1 and 2 of Block VIII., Section 1 of Block XII., and Section 1 of Block IV., Hikurangi Survey District; Sections 2 and 3 of Block I., Sections 2, 3, and 4 of Block V., Mata Survey District; containing by admeasurement 6,498 acres, more or less.

Given under the hand of His Excellency the Right Honourable David, Earl of Glasgow; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twelfth day of October, in the year of our Lord one thousand eight hundred and ninety-three.

Land declared open for Mining Purposes.

A PROCLAMATION.

WHEREAS an agreement was entered into on the twenty-second day of March, one thousand eight hundred and eighty-one, by or on behalf of Her Majesty the Queen with the Native owners of certain reserves, including the land described in the First Schedule hereto (hereinafter referred to as “the said land”), and by the said agreements the terms and conditions upon which the said reserves were to be worked under the provisions of “The Gold-mining Districts Act, 1873,” were fixed and determined:

And whereas by memorandum of cession, dated the thirtieth day of March, one thousand eight hundred and ninety-three, by the Native owners of the said land to Her Majesty the Queen, the terms and conditions of the said agreements, in so far as they apply to or affect the said land, were superseded by the terms and conditions imposed by the said memorandum of cession:

And whereas in pursuance of the said memorandum of cession it is expedient to declare the said lands as now open for mining purposes in manner hereinafter specified:

Now, therefore, I, David, Earl of Glasgow, the Governor of the Colony of New Zealand, do hereby proclaim and declare that the lands described in the First Schedule hereto shall, as from the first day of January, one thousand eight hundred and ninety-four, be open for mining purposes as defined by “The Mining Act, 1891,” subject to the conditions contained in the said recited memorandum of cession of the thirtieth day of March, one thousand eight hundred and ninety-three, as set forth in the Second Schedule hereto, and subject to the provisions of the said Act and the regulations made thereunder, in so far as the same are not inconsistent with the terms of the said memorandum of cession.

FIRST SCHEDULE.

ALL that parcel of land in the Auckland Land District, containing by admeasurement 381 acres and 14 perches, exclusive of the areas hereinafter excepted, being the residue of Section No. 17 of Block IX. of Te Aroha Survey District. Bounded towards the north-east by Section No. 15, Block IX., Te Aroha Survey District aforesaid, 5220 links; towards the south-east by Section No. 15 aforesaid, the crossing of a road, and Section No. 15 aforesaid, 7200 links; towards the south-west by a road reserve along the Waihou River; towards the west by the railway reserve along the Te Aroha Railway line, 335·5 links, 135 links, 95 links, 249·9 links, 150 links, 167·6 links, 166·6 links, 150 links, 166·6 links, 75 links, 212·4 links, 166·6 links, 100 links, 166·6 links, 125 links, 372·9 links, 75 links, 166 links, 300 links, 130·2 links, 192·3 links, and 611·4 links; towards the east by aforesaid railway reserve, 303·6 links, 300 links, 2158 links, and 776 links; again towards the south-west by a road reserve along the Waihou River; and towards the north-west by a road, the crossing of a road, and a road, 6479 links; save and except a road 100 links wide, containing 9 acres 2 roods, and Blocks XVI. and VIII., and part of Block IX., of Te Aroha Goldfields Township, containing respectively 2 acres, 1 acre 3 roods 32 perches, and 2 roods: be all the aforesaid areas and linkages more or less.
