Additional Rules of the Native Land Court.
WHEREAS by “The Native Land Court Act, 1886,” as amended by “The Native Land Court Act 1886 Amendment Act, 1888,” and “The Native Land Court Acts Amendment Act, 1889,” it is enacted that it shall be lawful for the Chief Judge of the Native Land Court, subject to the approval of the Governor in Council, from time to time to make rules for regulating the sittings, practice, forms, and procedure of the Court: And whereas unnecessary trouble and expense are incurred in the preparation of notices of sittings of the Court through the retention and repetition in the lists, of applications which for various reasons are not proceeded with, and it is desirable to make provision in that behalf, as hereinafter mentioned, and to regulate the practice of adjournment:
Now, therefore, I, George Boutflower Davy, the Chief Judge of the Native Land Court, in exercise of the powers enabling me in that behalf, do hereby make the following regulation, which shall be read together with the other rules of the Native Land Court in force for the time being:—
- When any application has been notified to be heard at a particular time and place, and such application shall have been called on for hearing, but, by reason of non-appearance or other neglect or default on the part of the applicant, shall not have been proceeded with, the Court may either at once dismiss such application, or may direct that the same shall stand over to be dealt with at any time before the close of the sitting of the Court. For the purpose of this regulation the adjournment of the Court to another place shall be deemed the close of the sitting.
At the close of the other business of the sitting, and immediately before the closing adjournment of the Court, every application which shall remain undisposed of as aforesaid shall be again called on; and, if the Court shall be of opinion that sufficient notice of the intended sitting of the Court had been given, and that the applicant might reasonably have been expected to appear and prosecute his claim, and if no sufficient cause to the contrary shall otherwise appear, the Court shall dismiss such application, and shall cause such dismissal and the reason thereof to be recorded on the minutes of the proceedings of the Court, and to be notified to the Registrar for the district, who shall remove such application from the list of cases.
If the Court shall decide not to dismiss such application, but to adjourn the same to a future sitting, such decision, with the reasons for the same, shall be recorded on the minutes, but no such application shall, as a matter of course, be adjourned.
Applications which have been adjourned to a particular time and place, shall, for the purpose of this regulation, be deemed to have been notified for hearing at such time and place, and shall be dealt with accordingly.

TE KUMI BLOCK.

Gisborne, 3rd March, 1893.
IN the matter of a decision of the Court given at Opotiki on the 15th day of January, 1885, upon the hearing of a claim for the investigation of title to land situate in the Survey District of Raukumara West, and known as Te Kumi Block; and in the matter of an application made to this Court in writing by Renata Tihore and others, feeling themselves aggrieved by the said decision; and in the matter of an order made on the 18th day of June, 1888, by the Chief Judge of the Court, that a rehearing as to the title to such parts of the land the subject of the said decision as are alleged to form part of a block of land known as Honokawa, or to form part of another block of land known as Maunga-parahi, and also as to the areas included by the said decision in Te Kumi No. 1 and Te Kumi No. 2, be held at Opotiki on the 26th day of July, 1888: And whereas the said rehearing was not held but adjourned:
Notice is hereby given that a sitting of the Court will be held at Waiomatatini on Thursday, the 13th day of April, 1893, for the purpose of rehearing the said claim.
