THIRD SCHEDULE.

DECLARATION ON TAKING A PERPETUAL LEASE.

I, , of , in the Land District and Colony of New Zealand, , do solemnly and sincerely declare—

  1. That I am of the age of seventeen years and upwards.
  2. That I am the person who, subject to the provisions of “The Land Act, 1885,” is tendering for the purchase of a lease of Section , Block , District.
  3. That I am purchasing such lease solely for my own use and benefit, and for the purpose of cultivation, and not directly or indirectly for the use or benefit of any other person whomsoever.
  4. That, including the said lands, I am not the owner, tenant, or occupier, directly or indirectly, either by myself or jointly with any other person or persons, of any lands anywhere in the colony exceeding in the whole 50 acres.

And I make this solemn declaration conscientiously believing the same to be true, and by virtue of an Act of the General Assembly of New Zealand intituled “The Justices of the Peace Act, 1882.”

Increasing the Holding Area of Land to Settlers in the Winslow Village Settlement.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-third day of August, 1892.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by an Order in Council issued on the sixteenth day of October, one thousand eight hundred and eighty-eight, under the authority of the one hundred and sixty-seventh section of “The Land Act, 1885” (hereinafter termed “the said Act”), the terms and conditions upon which certain village-settlement lands therein enumerated should be disposed of were duly fixed, and it was provided that no person would be allowed to acquire more than one allotment in the Winslow Village Settlement:

And whereas it is expedient to allow one person to hold more than one allotment in the said settlement:

Now, therefore, His Excellency the Governor, in pursuance of the power conferred by the said Act and of all powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth hereby amend the Order in Council aforesaid so far as it affects the areas in which the land in the Winslow Village Settlement shall be held, and doth declare that, on and after the date hereof, any selector at present residing in the village settlement aforesaid may apply for and acquire additional allotments of land therein; and it is hereby further declared that all the provisions of the Order in Council of the sixteenth day of October, one thousand eight hundred and eighty-eight, aforesaid, shall apply, except as regards the area in which the sections may be held, to the Winslow Village Settlement.

Exchange of Land in Canterbury.

GLASGOW, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-third day of August, 1892.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the first column of the Schedule hereto was reserved as a gravel-pit: And whereas by an Order in Council issued on the sixth day of November, one thousand eight hundred and ninety-one, the said land was exchanged for that mentioned in the second column of the Schedule hereto:

And whereas the land described in the second column of the said Schedule was wrongly described in the said Schedule:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of the powers conferred by “The Public Reserves Act Amendment Act, 1889,” and of all other powers and authorities enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke the said Order in Council of the sixth day of November, one thousand eight hundred and ninety-one, and doth hereby declare that, from and after the day of the date hereof, the said reserve mentioned in the first column of the Schedule hereto shall be exchanged for the land mentioned in the second column of the Schedule hereto.

SCHEDULE.

Description and Purpose of Land intended to be exchanged. Description of Land to be obtained in exchange therefor.
All that parcel of land in the Canterbury Land District, containing 5 acres, more or less, being Reserve No. 2325, situate in Block XII., Hororata Survey District, and Block IX., Hawkins Survey District; as the same is delineated on the map of the said survey districts, deposited in the Survey Office, Christchurch. All that parcel of land in the Canterbury Land District, containing 5 acres, more or less, situate in Block IX., Hawkins Survey District, being a block of land, 708 links square, forming part of Section No. 21193, and situate in the north-east corner of same; as it is more particularly delineated on the map of the said survey district, deposited in the Survey Office, Christchurch.

Removal of Restrictions on Alienation of Native Land.

GLASGOW, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-third day of August, 1892.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS application has been made to the Governor in Council by John Coleman (as trustee) and Albert Karaitiana, the Native owners of the land described in the second column of the Schedule hereto, praying that the restrictions on the alienation of such land contained in the Crown grant, bearing date the sixteenth day of September, one thousand eight hundred and seventy-nine, described in the first column of the said Schedule, may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has reported that the provisions of the law in that behalf have been complied with: And whereas it appears expedient to grant such application:

Now, therefore, His Excellency the Right Honourable David, Earl of Glasgow, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred on him by “The Native Land Act, 1888,” and acting with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that all restrictions imposed by the said Crown grant on the alienation of the said land are hereby removed.

Crown grant, Index No. 5100, W. 27, page 75, under the Native Land Acts, in favour of Karaitiana Takamoana, dated 16th September, 1879, and containing the following restrictions: “Inalienable by sale, or by lease for a longer period than twenty-one years, or by mortgage, except with the consent of the Governor previously obtained to any such sale, lease, or mortgage.” (Transmission registered grant, Vol. 18, folio 197, to John Coleman, as executor.) All that parcel of land in the District of Wellington, containing 92 acres 3 roods, and known as Hokowhitu No. 7.
