inconsistent with any law relating to the Customs, or any
regulation of the Commissioner of Trade and Customs, or
with any provision of “The Harbours Act, 1878,” or its
amendments, or any regulations made thereunder, and that
are now or may hereafter be in force.

  1. The rights, powers, and privileges conferred or granted
    by this Order in Council may be at any time resumed by
    the Governor, without payment of any compensation what-
    ever, on giving to the licensees three calendar months’
    previous notice in writing. Any such notice shall be suffi-
    cient if given by the Minister and delivered at or posted to
    the last known address of the licensees.

  2. The licensees shall be liable for any injury which the
    said fishing establishment may cause any vessel or boat to
    sustain through any default or neglect on their part.

  3. In case the licensees shall—
    (1.) Commit or suffer a breach of the conditions herein-
    before set forth, or any of them ;
    (2.) Cease to use or occupy the said fishing establishment
    for a period of three calendar months ;
    (3.) Become bankrupt, or be in any manner brought
    under the operation of any Act for the time being
    in force relating to bankruptcy ; or
    (4.) Fail to pay the sums specified in clause 3 of these
    conditions ;
    then and in either of the said cases this Order in Council,
    and every license, right, power, or privilege, may be revoked
    and determined by the Governor in Council without any
    notice to the licensees or other proceedings whatsoever ; and
    publication in the New Zealand Gazette of an Order in Coun-
    cil containing such revocation shall be sufficient notice to
    the licensees and to all persons concerned or interested that
    this Order in Council, and the license, rights, and privileges
    thereby granted and conferred, have been revoked and deter-
    mined.

  4. In these conditions the term “Minister” means the
    Minister having charge of the Marine Department, as defined
    by “The Shipping and Seamen’s Act, 1877,” and includes
    any officer, person, or authority acting by or under the direc-
    tion of such Minister.

At the Government House, at Wellington, this thirty-first
day of March, 1892.

Present :

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT
IN COUNCIL.

IN pursuance and exercise of the powers and authorities
vested in him by the sixth section of “The Local Bodies’
Finance and Powers Act, 1885,” and of every other power
and authority enabling him in that behalf, His Excellency
the Administrator of the Government of the Colony of New
Zealand, by and with the advice and consent of the Execu-
tive Council of the said colony, doth hereby vest in the
Mayor, Councillors, and Burgesses of the Borough of Ross
all the rights of the Crown to the water-race known as the
Mikonui Water-race, in the Totara Survey District, and to
all branch supply-races, dams, and other rights connected
with such water-race, as the same are more particularly
described in the Schedule hereto, to hold the said several
rights subject to the several conditions upon which the same
are now held, and subject to the regulations in force for
mining within the said colony. And it is hereby declared
that this Order in Council shall take effect on the date
hereof.

SCHEDULE.
ALL that piece or parcel of land containing by admeasure-
ment 42 acres 3 roods 38 perches, more or less, situate in the
Survey District of Totara, Provincial District of Westland,
commencing at a point on the north side of Donnelly’s Creek,
the same being 25550 links south and 63880 links west of the
Initial Geodesical Station of Hokitika Survey Circuit, in the
said Provincial District of Westland. Bounded easterly
by a line, 122 links ; generally northerly by lines, 340, 1006,
507, 430, 846, 596, 214, and 179 links respectively ; generally
easterly by lines, 1865, 45, 3559, 83, and 4849 links re-
spectively ; westerly by a line, 56 links ; northerly by a line,
223 links ; generally easterly by lines, 1904, 174, 421, 256,
and 576 links respectively ; northerly by a line, 40 links ;
generally easterly by lines, 161 and 861 links respectively ;
southerly by a line, 15 links ; generally easterly by lines, 1007
and 367 links respectively ; southerly by a line, 129 links ;
easterly by a line, 487 links ; northerly by boundary of Mining
Lease No. 623, 463 links ; easterly by boundary of Mining
Lease No. 623, 98 links ; northerly by boundary of Mining
Lease No. T649, 195 links ; generally westerly by lines, 514
293, 298, 1077, 850, 132, 553, 221, 484, 296, and 2151 links
respectively ; southerly by a line, 189 links ; easterly by a
line, 70 links ; generally westerly by lines, 4600, 71, 3544, 49,
and 2002 links respectively ; generally southerly by lines, 315,
355, 498, 779, 475, 421, 1100, and 331 links respectively ;
easterly by a line, 122 links, to the commencing-point : save
and excepting any land granted for water-races or other
mining purposes at the date of the Proclamation of the 23rd
April, 1883, declaring lands and streams to be taken for the
Mikonui Water-race aforesaid, and included within the above
area.

Also that piece or parcel of land containing by admeasure-
ment 11 acres 1 rood 15 perches, more or less, situate in the
Survey District of Totara, Provincial District of Westland,
commencing at the western boundary of mining lease
formerly known as T671, the same being 9106 links south and
72779 links west of the Initial Geodesical Station of Hokitika
Survey Circuit, in the said Provincial District of Westland.
Bounded easterly by boundary of said mining lease, 151
links ; generally northerly by lines, 460, 864, 720, 151, 419,
336, 804, and 705 links respectively ; south-westerly by a line,
300 links ; generally southerly by lines, 499, 699, 296, 440, 168,
719, 387, and 388 links respectively ; easterly by boundary of
said mining lease, 151 links, to commencing-point : save and
excepting any land granted for water-races or other mining
purposes at the date of the Proclamation aforesaid, and
included within the above area ; the above area and linkages
being either more or less : as the said several parcels of land
are more particularly shown and delineated on a plan marked
P.W.D. 9869, deposited in the Warden’s Court, at Ross, in
the County of Westland. Together with the following streams
of water for the purpose of supplying the said water-race,
namely, Donnelly’s Creek, Stony Creek, Tunnel Creek,
Scandinavian Creek, Jones Creek, and all their tributaries ;
save and except any prior rights held by private persons
and already granted ; the said streams being shown on plan
deposited as above.

Also all that piece or parcel of land containing by admeasure-
ment 176 acres, more or less, situate in the Survey
District of Totara, Provincial District of Westland ; com-
mencing at a point on the north side of Donnelly’s Creek,
the same being 25550 links south and 63880 links west of the
initial geodesical station of the Hokitika Survey Circuit,
in the said Provincial District of Westland, the width of the
reservation to be 2 chains, i.e., 1 chain on each side of the
centre-line, shown in blue upon plan referred to below ; such
centre-line to extend in a straight line in a south-easterly
direction for a distance of 155 chains 47 links from the start-
ing-point above described to a point about 30 links south of
Monteith’s Creek ; thence along the eastern slope of the
Mount Greenland Range, following a line 49ft. less in alti-
tude than the Mikonui Race, originally surveyed and shown
in red on the plan mentioned below, to the saddle between
the Totara and Mikonui Rivers ; thence across said saddle
and along the western and southern slopes of Fraser Peak to
a point on the Mikonui River half a mile south-west of head-
works (point A in red on plan) 49ft. below and abreast of
traverse peg 25 of the Mikonui Race survey, already referred
to : save and excepting any land granted for water-races or
other mining purposes at the date of this Proclamation, and
included within the above-mentioned area of 176 acres ; as
the same is more particularly delineated upon the plan
marked P.W.D. 15506, deposited in the Warden’s Court, at
Ross, in the County of Westland. Together with the fol-
lowing streams of water taken for the purpose of supplying
the said water-race, namely, Monteith’s Creek, Fraser’s
Creek, Rocky Creek, Long’s Creek, Spencer’s Creek, Cedar
Creek, McLeod’s Creek, Sabot’s Creek, and Ford’s Creek,
and Mikonui River, and all their tributaries ; save and ex-
cept any prior rights held by private persons and already
granted ; the said streams being shown on plan deposited as
hereinabove mentioned.
