THE NEW ZEALAND GAZETTE.

Provided that it shall not be obligatory upon the society to issue a license.

  1. Every such license shall entitle the person named therein to fish in any of the said waters from the first day of October in any one year to the thirty-first day of March in the following year inclusive, between the hours of four a.m. and ten p.m. only; but no such license shall confer any right of entry upon the land of any person without his consent.

  2. No person shall fish for, take, catch, or kill, or have in his possession, or attempt to fish for, take, catch, or kill, in any manner whatever, any of the salmonidæ or trout, except during the above-mentioned period.

  3. Every such license shall entitle the person named therein to fish with one rod and line only, and with the following baits: Natural or artificial fly, natural or artificial minnow, silveries, bullies, grasshoppers, spiders, caterpillars, creepers, and worms.

  4. No person shall use any other bait, or any method, device, or contrivance of any sort or kind whatever, for the purpose of fishing for, taking, catching, or killing trout, except a rod and line, and a landing-net or gaff for fish taken with rod and line.

  5. No cross-line fishing, stroke-hauling, or any other unsportsmanlike device shall be used for the purpose of taking, catching, or killing trout; nor shall any of the baits above mentioned be used with any medicated or chemical preparation whatever.

  6. No person shall fish without a license, and every person fishing shall, on demand of any ranger, constable, member of the said society, or person producing a license, produce and show to such ranger, member, constable, or person his license, and the contents of his creel or bag, and the bait used by him for taking, catching, or killing trout.

  7. Every trout not exceeding eight inches in length from nose to tip of tail, taken or caught by any person, shall immediately be returned alive into the water from which the same is taken.

  8. No person shall put, throw, or place, or allow to be put, thrown, or placed, in any of the said waters, any sawdust or sawmill refuse, or anything of any kind or description whatever poisonous, deleterious, or noxious to fish.

  9. No person shall take, fish for, catch, or kill, in any manner whatever, or have in his possession, any salmon, salmon-parr, or smolts, or the ova, young, or fry of any salmon in any stage whatever; and any of the above-named taken by accident shall immediately be returned to the water from whence it was taken.

  10. No person shall buy, sell, or expose or offer for sale, within the county to which these regulations relate, any of the salmonidæ or trout, or take, fish for, catch, or kill any of the salmonidæ or trout in order to make sale of the same, without permission in writing under the hand of the Secretary of the said society.

  11. No person shall have in his possession any of the salmonidæ or trout between the first day of April and the thirtieth day of September inclusive in each year, which period is appointed a close season for all such fish.

  12. The penalty for the breach of any of these regulations shall not be less than forty shillings or more than fifty pounds.

  13. These regulations shall come into force as from the day of the date hereof.

Revoking Order in Council under the Fisheries Encouragement Act.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twelfth day of October, 1891.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS an Order in Council prohibiting the exportation from the colony of all rock-oysters taken or produced in the waters of the colony was made, under the powers conferred by “The Fisheries Encouragement Act, 1885,” on the twenty-fifth day of March, one thousand eight hundred and eighty-six, and published in the New Zealand Gazette No. 17, of the same date: And whereas it is desirable to revoke the said Order in Council:

Now, therefore, I, William Hillier, Earl of Onslow, the Governor of the Colony of New Zealand, in exercise of all the powers enabling me in that behalf, and acting by and with the advice and consent of the Executive Council of the said colony, do hereby revoke the said Order in Council of the twenty-fifth day of March, one thousand eight hundred and eighty-six.

Vesting a Reserve in the Rodney County Council.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twelfth day of October, 1891.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto was reserved for a site for a quarry: And whereas it is expedient that the said land should be vested in the Rodney County Council:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that, from and after the day of the date hereof, the reserve mentioned in the Schedule hereto shall become vested in the Chairman, Councillors, and inhabitants of the Rodney County, in trust, for a site for a quarry.


SCHEDULE.

ALL that parcel of land in the Land District of Auckland, being Section No. 27A of Block I., Mahurangi Survey District, containing by admeasurement 2 acres 3 roods 38 perches, more or less. Bounded towards the north by Section No. 34 of Block XII., Pakiri Survey District, 881 links; towards the south-east generally by a public road, 34, 205, 189, 176, 94, and 90 links; towards the south by Section No. 27 of Block I., Mahurangi Survey District, 378 links; and towards the west by said Section No. 27, 511 links, to the point of commencement: be all the aforesaid linkages more or less.

IN pursuance and exercise of all powers and authorities enabling him under “The Public Revenues Act, 1882,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby appoint

WESTBY BROOK PERCEVAL, Esquire,

to be an Agent for the purposes of the sixteenth section of the said Act, to take, hold, and exercise the office of such Agent in conjunction with any other Agent or Agents appointed or acting under the said section, to have, exercise, and perform all the powers and authorities exercisable by such Agent or Agents.

IN pursuance and exercise of the power and authority conferred upon him by the fourth section of “The Lost Debentures Act, 1886,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby delegate to Sir Penrose Goodchild Julyan, of London, in the United Kingdom, a Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, and a Companion of the Most Honourable Order of the Bath, and to WESTBY BROOK PERCEVAL, Esquire, the powers by the said Act vested in the Governor in Council or the Governor.
