defined by Proclamation to be issued in that behalf; but no more than ten thousand acres shall be so set apart or proclaimed in one block at any one time, and the lands so set apart and proclaimed from time to time shall not, in the aggregate, exceed seven hundred and fifty thousand acres: And whereas, in the opinion of the Governor, the lands described in the Schedule hereto are required for bonâ fide mining purposes and the several purposes connected therewith, and the said lands are comprised in one block, containing ten thousand acres: And whereas it is expedient the said land should be set apart and defined by this Proclamation:

Now, therefore, I, William Hillier, Earl of Onslow, the Governor of the Colony of New Zealand, in pursuance and exercise of all powers and authorities enabling me in this behalf under the hereinbefore-mentioned contract or otherwise, do hereby proclaim and declare that the block of land defined and described in the Schedule hereto is set apart under the provisions of the said contract for bonâ fide mining purposes and the several purposes connected therewith.

SCHEDULE.

Block VII., 10,000 acres, more or less, comprising the South Beach, Paroa, Rutherglen, Cameron’s, Lower New River, Marsden, and Welshman’s Gold-diggings. Bounded towards the north-east by the Borough of Greymouth to the Milton Road; towards the east by the said Milton Road to the southern boundary of Section No. 1875; thence towards the north by Sections Nos. 1875 and 1544; towards the east by Section No. 1513 to Saltwater Creek; again towards the north by said Saltwater Creek and Section No. 1510 to its easternmost corner; thence again towards the east by a line bearing due south for a distance of about 350 chains; towards the south by a line bearing due west to the Teremakau River, and by the said Teremakau River and Section No. 7497 to the sea-coast; thence towards the north-west by the sea-coast: exclusive of sold lands and reserves.

Given under the hand of His Excellency the Right Honourable William Hillier, Earl of Onslow, of Onslow in the County of Salop; Viscount Cranley, of Cranley in the County of Surrey; Baron Onslow, of Onslow in the County of Salop, and of West Clandon in the County of Surrey; Baron Cranley, of Imbercourt; Baronet; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony, at Wellington, this tenth day of October, in the year of our Lord one thousand eight hundred and ninety-one.

Regulations for Trout-fishing, Tauranga Acclimatisation District.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this sixth day of October, 1891.

Present:

THE HONOURABLE THE COLONIAL SECRETARY PRESIDING IN COUNCIL.

IN pursuance of the powers and authorities vested in him by “The Fisheries Conservation Act, 1884,” His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulations for the Tauranga Acclimatisation District, which consists of the Counties of Tauranga and Rotorua, and so much of the Counties of East Taupo and Whakatane as lies to the north of the Rangitaiki River, together with all town districts and boroughs situate within the boundaries of such district, and the waters thereof; and doth hereby declare that these regulations shall, as from the date of this Order in Council, supersede all regulations at variance therewith.

REGULATIONS.

  1. LICENSES to fish for trout in all the waters of the Tauranga Acclimatisation District may be issued under the hand of the Secretary of the Tauranga Acclimatisation Society (hereinafter termed “the said society”), or any one authorised by the said Secretary in that behalf.

  2. For every such license issued a fee of five shillings will be charged.

  3. Any holder of a license may fish with one rod and line for trout, and may use a landing-net or gaff to secure any trout caught with such rod and line, in the above-named waters, from the first day of October in any one year to the thirty-first day of March in the following year.

  4. No license shall authorise any person other than the person named therein to fish, and that with natural or artificial fly, insect, worm, or fish only.

  5. No person shall have in his possession any of the salmonidæ or trout between the first day of April and the thirtieth day of September in any year, which period is hereby appointed a close season for all such fish: Provided always that this regulation shall not apply to fish caught by the officers of the said society for purposes of acclimatisation.

  6. No person shall put, throw, or place, or allow to be put, thrown, or placed, into any rivers or streams, or at the mouth or entrance of any such river or stream, any dynamite or other explosive substance, or any sawdust or sawmill refuse, or anything of any kind or description whatsoever poisonous, deleterious, or noxious to fish.

  7. No person shall take, fish for, catch or kill, in any manner whatever, or have in his possession, any salmon, salmon-parr, or smolts, or the ova, young, or fry of any salmon in any stage whatever; and any of the above-named taken by accident or otherwise shall immediately be returned to the water from whence it was taken.

  8. No person shall fish for trout without a license, and every person fishing shall, on demand of any ranger, constable, member of the said society, or person producing a license, produce and show to such ranger, member, constable, or person his license, and the contents of his creel or bag, and the bait used by him for taking, catching, or killing such trout.

  9. Every trout not exceeding seven inches in length from nose to tip of tail, taken or caught by any person, shall immediately be returned alive into the water from which the same is taken.

  10. No cross-line fishing, stroke-hauling, or any other unsportsmanlike device shall be used for the purpose of taking, catching, or killing trout; nor shall any of the above-mentioned baits be used with any medicated or chemical preparation whatever.

  11. Except as aforesaid, no person shall fish with or use any net or other engine, instrument, or device for taking fish in any of the rivers or streams in the said district, or at the mouth or entrance of any such rivers or streams.

  12. For the purposes of these regulations the mouth of every such river or stream shall be deemed to include every outlet of the same and the sea-shore between such outlets, and shall extend over a radius of one-quarter of a mile from the point or line where the waters of such river or stream meet those of the sea or of any harbour at low-water ordinary tides.

  13. No person shall buy, sell, or expose or offer for sale, or shall fish for the purpose of obtaining for sale, any salmon, trout, or any part thereof.

  14. The penalty for the breach of any of these regulations shall not be less than forty shillings or more than fifty pounds.

  15. If any person shall be convicted of any offence against these regulations the license (if any) held by the offender shall thereupon become void.
