Powers delegated to the Christchurch Domains Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth day of September, 1891.

Present :

His Excellency the Governor in Council.

IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the seventeenth day of February, one thousand eight hundred and ninety, making delegation of certain powers in manner as therein appears ; and doth, with the like advice and consent, by this present order, delegate, but only with respect to the pieces or parcels of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Christchurch Domains Board namely,—

The Hon. Sir John Hall,
The Hon. William Rolleston,
Richard James Strachan Harman,
Hugh Percy Murray-Aynsley,
Charles Christopher Bowen,
John William Allman Marchant,
The Mayor of the City of Christchurch,
The Mayor of the Borough of Sydenham,
The Mayor of the Borough of St. Albans, and
The Chairman of the Selwyn County Council,

subject to the stipulations hereinafter contained :—

  1. The Board shall meet at such times and places as shall be from time to time appointed by the Chairman, or when it shall be convened by him ; and the business shall be conducted under such regulations as shall be determined on by the Board.

  2. The Board shall keep proper minutes and records of all its proceedings, and full accounts of its receipts and expenditure ; and a yearly statement of the same, together with a general report of its proceedings, shall be forwarded to the Governor once in every year.

  3. This delegation of powers to the Board shall not in any way affect any lease or contract now validly in force in respect of any portion of the lands named in the Schedule hereto, nor any agreement in respect of the dedication of any portion of the said lands to any purpose of public recreation or amusement.

  4. None of the powers delegated shall be exercised in respect of the ground occupied by the building known as the Canterbury Museum, or by any building pertaining thereto which has been or may hereafter be erected in connection therewith, or to such enclosures in connection therewith as may be approved by the Board and the Governor.

The Trustees of the said Museum, and their officers and servants, shall at all times have the right of ingress and egress to and from the said Museum, at such times as shall be determined by the said Trustees.

SCHEDULE.

  1. The land commonly known and described in the Schedule B to “The Canterbury Association’s Ordinance, Session IV., No. 6,” as the Government Domain, No. 25, save and except such part of the same as has been duly conveyed to the Corporation of Christ’s College, Canterbury.

  2. The land commonly known as Hagley Park, being part of the land numbered 24, and described as the town reserves in the Schedule B to “The Canterbury Association’s Ordinance, Session IV., No. 6.” Bounded on the west and south by the road reserved along the boundary of the town reserves ; on the north by the road reserved along the banks of the River Avon ; on the east and south-east by the River Avon and the Lower Lincoln Road.

Removal of Restrictions on Alienation of Native Land.

ONSWLOW, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-ninth day of September, 1891.

Present :

The Honourable the Premier presiding in Council.

WHEREAS application has been made to the Governor in Council by Raniera Erihana, the Native owner of the land described in the second column of the Schedule hereto, praying that the restrictions on the alienation of such land contained in the Crown grant, bearing date the eleventh day of April, one thousand eight hundred and seventy, described in the first column of the said Schedule, may be removed : And whereas inquiry has been duly made by the Native Land Court, and the said Court has reported that the provisions of the law in that behalf have been complied with : And whereas it appears expedient to grant such application :

Now, therefore, His Excellency the Right Honourable William Hillier, Earl of Onslow, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred on him by “The Native Land Act, 1888,” and acting with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that all restrictions imposed by the said Crown grant on the alienation of the said land are hereby removed.

Crown grant, No. 10977, O. 40, page 81, dated the 11th April, 1870, in favour of Daniel Ellison, and containing the following restrictions : “Inalienable by sale, or by lease for a longer period than twenty-one years, or by mortgage, except with the consent of the Governor being previously obtained to every such sale, lease, or mortgage.” All that parcel of land in the Provincial District of Otago, known as Section 61, Block D, Otago Heads Native Reserve, containing 120 acres.
