Regulations for the Hiring and Use of Telephones.

ORDER IN COUNCIL.

At the Government House, at Wellington, this third day of November, 1888.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by an Order in Council bearing date the thirteenth day of June, one thousand eight hundred and eighty-five, made under the provisions of “The Electric Lines Act, 1884 (hereinafter termed “the said Act”), and published in the New Zealand Gazette of the second day of July then following, certain regulations were made prescribing the fees and charges to be taken and made in relation to the use of Government telephones established in this colony in connection with telephone exchanges: And whereas it is expedient to make further regulations in relation to the hiring and use of the said telephones:

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise of the powers vested in him by the said Act, and acting with the advice and consent of the Executive Council of the said colony, doth hereby make the regulations set forth in the Schedule hereto, and doth hereby order and declare that such regulations shall take effect on and after the first day of November, one thousand eight hundred and eighty-eight.


SCHEDULE.

REGULATIONS.

  1. At any place where telephone exchanges have been established, Edison-Bell or any other approved telephones connected with the exchanges will be placed in offices or private residences within a reasonable distance of the central office, so that a subscriber can converse with other subscribers at their offices or residences.

  2. Subscribers at each exchange will be furnished with a list of persons with whom they may communicate by telephone, and, as new subscribers are connected with the system from time to time, notification of the fact will be given by the department.

  3. The Electric Telegraph Commissioner or Superintendent of Electric Lines may exclude from the telephone exchange any subscriber who allows the telephone instruments in his custody or control to be damaged or destroyed, or put to any improper use, and may remove or cause to be removed any instruments allotted to the use of such subscriber; who shall have no claim for damages or otherwise in consequence of the removal or exclusion of the instruments under such circumstances.

  4. All charges payable in respect of the hire of any telephone instruments shall be paid quarterly, in advance, on the 1st day of January, April, July, or October following the date when the connection with the telephone exchange is completed.

  5. If such payment be not made within one week after demand, the connection with the exchange may, at the discretion of the said Superintendent, be discontinued without prejudice to any proceedings for the recovery of any moneys then due or otherwise.

  6. Every person desiring to hire any telephone instruments or set of telephones connected with a telephone exchange shall make application to the Superintendent of Electric Lines, in the Form No. 1 in the Schedule hereto; and shall, when requested so to do by the said Superintendent, execute and deliver to him a bond in the Form No. 2 of the said Schedule.

SIR,—You are desired to erect upon premises at , 18 .
a set of telephones connected with the telephone exchange.
For the use of the instruments, and for the telephone service, agree to pay quarterly, in advance, the authorised charges, and to submit to all regulations in force respecting the hire or use of Government telephones, and to perform all conditions contained in the attached form of bond, which agree to sign upon request from you.
And further agree to hire the said instruments and line for the term of .

Know all men by these presents that I [we], A.B.,¹ of in the Provincial District of ,² [and C.D., of , in the Provincial District of ,² and E.F.,¹ of the same place,² ], am [are] [jointly and severally] held and firmly bound unto Her Majesty Queen Victoria, her heirs and successors, in the penal sum of £20; for which payment, well and truly to be made, I [we] bind myself [ourselves, and each of us, and the], my heirs, executors, and administrators [of us and each of us, jointly and severally], firmly by these presents. Sealed with my seal [our seals]. Dated this day of , 18 .

Whereas on or about the day of , 18 , the said A.B. made application to the Superintendent of Electric Lines, at Wellington, for the erection upon the premises of the said A.B., at , by way of hire, of a set of telephone instruments connected with the Telephone Exchange: And whereas the said Superintendent has agreed to accede to such request upon the execution and completion of these presents: Now, the condition of this bond or obligation is such that, if the said A.B. shall duly pay in advance on the first of January, April, July, and October in each year, so long as the said instruments are in his use, custody, or control, and connected with the said exchange, all such charges as may for the time being be lawfully payable in respect of the hire of the said instruments, and will not permit the said instruments to be used by any one except upon the business of him the said A.B.; and will, upon demand, pay to the said Superintendent, on behalf of Her Majesty the Queen, all costs, charges, and expenses which may be incurred by reason of any damage done to the said instruments while in the custody of the said A.B. (damage by accidental fire only excepted); and will at all reasonable times permit the said Superintendent and his officers to enter upon the said premises, and view the state of repair of the said instruments; and will in all things abide by and perform the conditions of his said application, and all regulations and conditions which may from time to time be lawfully prescribed with respect to Government telephones or telephone exchanges and connections therewith; then this bond shall be void and of no effect, otherwise shall remain in full force and virtue.
