  1. Each applicant for a deferred-payment section in the Second Schedule will be required to make the declaration prescribed by section one hundred and thirteen of “The Land Act, 1885,” and shall at the time of application deposit with the Receiver of Land Revenue for the Southland Land District one-tenth of the price of the allotment. Such payment shall be deemed to be a discharge of the license-fee for the six months due on the first day of January, one thousand eight hundred and eighty-nine.

  2. The purchaser of the land described in the First Schedule, upon the full payment of the purchase-money, and the purchaser of any lands described in the Second Schedule, upon the like payment, and also the fulfilment of the terms and conditions prescribed by “The Land Act, 1885,” relating to land on deferred payments, will be entitled to his Crown grant, to be issued in the usual way upon payment of the fees prescribed by law.

Terms and Conditions of Sale of Village-settlement Small-farm Allotments in the Otago Land District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-sixth day of June, 1888.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the one hundred and sixty-seventh section of “The Land Act, 1885,” it is enacted that the Governor in Council may fix the terms and conditions upon which the lands comprised in any village settlement shall be disposed of, and the mode of payment for the same:

And whereas His Excellency the Governor of the Colony of New Zealand has, by Proclamation of even date herewith, set apart the lands enumerated in the Schedule thereto for sale as village settlements:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the hereinbefore in part recited Act, and by and with the advice of the Executive Council of the said colony, doth hereby fix the following terms and conditions upon which the said village settlements shall be disposed of, and the mode of payment for the same, that is to say,—

  1. The lands enumerated in the Schedule to the Proclamation aforesaid shall be disposed of as small-farm allotments upon deferred payments.

  2. The day upon which the lands shall be open for application shall be Wednesday, the first day of August, one thousand eight hundred and eighty-eight, at the Land Office, Dunedin.

  3. The lands will be disposed of by sale upon deferred payments, and shall be subject to the provisions relating to suburban lands of Part III. of “The Land Act, 1885.”

  4. No person shall be allowed to acquire more than one allotment.

  5. The price at which the sections enumerated in the Schedule aforesaid shall be disposed of shall be one pound five shillings an acre.

  6. If there should be more than one application for any allotment, the right to occupy the same shall be determined by lot amongst the applicants.

  7. Such payment shall be deemed to be a discharge of the license-fee for the six months due on the first day of January, one thousand eight hundred and eighty-nine.

  8. The purchaser of any lands upon the full payment of the purchase-money, and also the fulfilment of the terms and conditions prescribed by “The Land Act, 1885,” relating to land on deferred payments, will be entitled to his Crown grant, to be issued in the usual way upon payment of the fees prescribed by law.

Mercer Recreation-ground brought under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-sixth day of June, 1888.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

BY virtue of the powers and authorities vested in me by the twenty-fourth section of “The Public Reserves Act, 1881,” I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, do hereby order and declare that the reserve made for public recreation in the Provincial District of Auckland, and known as the Mercer Recreation-ground, and described in the Schedule hereto, shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of “The Public Domains Act, 1881;” and such domain shall hereafter be managed, administered, and dealt with in manner directed by the said Act.


SCHEDULE.

ALL that parcel of land in the Provincial District of Auckland, containing 84 acres 3 roods, situate in the Parish of Koheroa, and known as Section No. 136. Bounded towards the north by a road reservation, averaging 100 links wide, along the Maungatawhiri River; towards the south-east by a line and by Section No. 90, Parish of Koheroa, 2100 links; and towards the south-west by a road reservation, averaging 100 links wide, along the banks of the Waikato River to its confluence with the Maungatawhiri River, at the point of commencement.

Powers delegated to the Mercer Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-sixth day of June, 1888.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the twelfth section of “The Public Domains Act, 1881,” it is, inter alia, enacted that the Governor, by Order in Council, may from time to time delegate all or any of the powers by the said Act conferred, save as is therein mentioned, to any person or persons for any period, and subject to such stipulations as may be specified in such order, and that every such delegation may from time to time in like manner be altered or revoked: And whereas, pursuant to “The Public Reserves Act, 1881,” by an Order in Council of even date herewith, the land described in the Schedule thereto is declared to be brought under the operation of and to be subject to the provisions of the said “Public Domains Act, 1881:”

Now, therefore, His Excellency the Governor, by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth, by this present order, delegate all the powers conferred by the Act first above mentioned, except the powers under or conferred by sections five and twelve, to the under-mentioned persons, who shall be known as the Mercer Domain Board, namely,—

WILLIAM HENRY PORTER,
MICHAEL GALLERY,
ROBERT MARTIN,
THOMAS PORTER,
MATTHEW HUNTER,
THOMAS NELSON, and
RICHARD TREGOWETH

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the second Monday in each month, at two o’clock p.m., at Mercer, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Monday, the ninth day of July, one thousand eight hundred and eighty-eight.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.
