ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth day of October, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work authorised to be constructed by the Government, to wit, the Tamaki Section of the Wellington-Napier Railway: And whereas the said land is held or occupied by Native owners:

Now, therefore, in pursuance and in exercise of the powers vested in him by “The Public Works Act, 1882,” and the amendments thereof, and of all other powers in anywise enabling him in this behalf, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the Government work known as the Tamaki Section of the Wellington-Napier Railway shall and may be constructed on or through the parcels of land more particularly mentioned in the Schedule hereto.

All in the Provincial District of Hawke’s Bay; as the said parcels of land are more particularly delineated on the plan marked P.W.D. 14879, deposited in the office of the Minister for Public Works, at Wellington, in the Provincial District of Wellington, and thereon coloured purple and red.

Application for Registration of Two Trade Marks.

NOTICE is hereby given that EDWARD WATERS, Patent Agent, of Melbourne, in the Colony of Victoria, has applied, on behalf of THE CHARLES A. VOGLER COMPANY, of Baltimore City, in the State of Maryland, one of the United States of America, to register, under “The Trade Marks Act, 1866,” the trade marks numbered 1 and 2, of which the following is a description:—

Description of Trade Marks.

No. 1 consists of the fancy word-symbol or name “St. Jacob’s Oil,” and the representation of a monk attired in a long flowing robe, and holding a bottle in his hand. These have generally been arranged with the said fancy word-symbol printed in large black type across the top, beneath which is the picture of a monk seated at the foot of a tree, and holding in his right hand a bottle, while his left rests upon a staff. Beneath this are the words “The Great Remedy for Pain,” followed by a list of ailments for which the oil is useful, and that by the name of the firm, “The Charles A. Vogeler C°., Baltimore, Ma., U.S.A.;” but any or all of the foregoing may be omitted or changed at pleasure, except the essential features of the said trade mark, which are the fancy word-symbol “St. Jacob’s Oil,” and the representation of a monk holding a bottle.

No. 2 consists of the fancy word-symbol or name “St. Jakob’s Oel,” or, translated into English, “St. Jacob’s Oil,” and the representation of a forest and the ruins of a building. These have generally been arranged in the form of a label, and upon which the said fancy word-symbol is printed in German-text type of large size, and arranged in a curved line across the top of the label, beneath which is the representation of a pine-forest and the ruins of a building, followed by printed matter in the German language, and that by printed matter descriptive of the liniment in the English language, below which, in the right-hand corner of the label, is a facsimile of the signature, “The Charles A. Vogeler C°.” The whole is surrounded by a border of fanciful configuration with ornamental corner-pieces. Outside of the border and below it is a translation of the said fancy word-symbol and descriptive matter in the French and Spanish languages. Parallel to the border and on either side of the label is a repetition of said fancy word-symbol in Latin type. Outside of the border and on one side of the label are the words, “This form of Wrapper adopted May 6, 1877;” but all the parts of this label may be omitted, except the said fancy word-symbol and the representation of the forest and the ruins of the building, or changed at pleasure, without materially altering the character of the trade mark, the essential features of which are the fancy word-symbol “St. Jakob’s Oel,” or, translated into English, “St. Jacob’s Oil,” and the representation of a forest and the ruins of a building.

Nature of the Article to which it is intended such Trade Marks shall apply.

A medicinal preparation or liniment known as “St. Jacob’s Oil.”

The words “The Savoy,” with the name of the firm “Sykes, Josephine, and C°.” through same.

Notice to Mariners, No. 44 of 1887.

ALTERATION OF LEADING LIGHTS, OTAGO HARBOUR.

Marine Department,
Wellington, N.Z., 8th December, 1887.

THE Otago Harbour Board have given notice that, on and after the 1st day of February, 1888, a fixed green light will be exhibited from a white tower erected on the outer end of the recently constructed Cargill Mole, which runs 4,100ft. to seaward from the sandspit at the west side of the entrance to Otago Harbour. The light will be 29ft. above sea-level, and will be visible about six miles all round the compass. Also that, on the same date, the present inner leading light for crossing the bar will be changed from green to red, the outer light remaining white as before.
