be sufficient if given by the Governor or the Minister having charge of the Marine Department, or any person acting under his or their instructions, and delivered at or posted to the last known address of the said Council, their successors, or assigns. No compensation or allowance shall be payable in such case.

  1. The Council shall be liable for any injury which the said wharf may cause any vessel or boat to sustain through any default or neglect on its part.

  2. In case the Council shall—
    (1.) Commit or suffer a breach of the conditions hereinbefore set forth, or any of them; or
    (2.) Cease to use or occupy the said wharf,
    then and in either of the said cases this Order in Council, and every right, power, or privilege, may be revoked and determined by the Governor in Council without any notice to the Council or other proceeding whatsoever, and publication in the New Zealand Gazette of an Order in Council containing such revocation shall be sufficient notice to the Council, and to all persons concerned or interested, that this Order in Council, and the rights and privileges thereby conferred, have been revoked and determined.

Postponing Mayoral Elections, Boroughs of Tauranga and Dunedin.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fifteenth day of November, 1887.

Present:

His Excellency the Governor in Council.

IN pursuance of the powers and authorities vested in him by “The Municipal Corporations Act, 1886,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby extend the time for holding the election of Mayor of the Borough of Tauranga, and the election of Mayor of the City of Dunedin, and doth declare that the said elections shall be held and take place on Thursday, the first day of December next ensuing, in lieu of Wednesday, the thirtieth day of November instant.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fifteenth day of November, 1887.

Present:

His Excellency the Governor in Council.

WHEREAS by an Order in Council dated the twentieth day of October, one thousand eight hundred and eighty-seven, and published in the New Zealand Gazette of the same date, the time for holding the general election of Councillors for certain counties, including the County of Amuri, was for reasons therein mentioned extended to the sixteenth day of November, one thousand eight hundred and eighty-seven: And whereas the number of Councillors to be elected for the said County of Amuri is eight: And whereas, the Returning Officer, in giving public notice of the said election, inadvertently notified that the number of Councillors to be elected was seven, and the error was not observed in sufficient time to publish a corrected notice, and it is therefore necessary to postpone the said elections as hereinafter set forth:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of the powers and authorities vested in him by section three hundred and twenty-two of “The Counties Act, 1886,” and of all powers in anywise enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said Colony, doth hereby further extend the time for holding the general election of Councillors for the said County of Amuri, and doth hereby order and declare that the said general election shall be held and take place on Wednesday, the thirtieth day of November next ensuing, in lieu of Wednesday, the sixteenth day of November.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fifteenth day of November, 1887.

Present:

His Excellency the Governor in Council.

WHEREAS by section fourteen of “The Public Works Act, 1882,” it is enacted that, if it is found that any land held, taken, purchased, or acquired at any time under that Act or any other Act or provincial ordinance, or otherwise however, for public works, is not required for public use, the Governor may, by an Order in Council publicly notified and gazetted, cause the same to be sold under the conditions therein set forth:

And whereas the Minister for Public Works has laid before the Governor the memorial referred to in the section aforesaid, praying the Governor, by an Order in Council, to cause such land to be sold:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise and pursuance of the powers and authorities aforesaid, do hereby order and authorise the land mentioned in the Schedule hereto to be sold and dealt with in the manner and subject to the conditions of the fourteenth and following sections of the above in part recited Act.
