Given under the hand of His Excellency Sir William Francis Drummond Jervois, Lieutenant-General in Her Majesty's Army, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Companion of the Most Honourable Order of the Bath, Governor and Commander-in-Chief in and over Her Majesty's Colony of New Zealand and its Dependencies, and Vice-Admiral of the same; and issued under the Seal of the said Colony, at the Government House, at Wellington, this nineteenth day of April, in the year of our Lord one thousand eight hundred and eighty-seven.

Extending Close Season for Seals.

ORDER IN COUNCIL.

At the Government House, at Wellington, this nineteenth day of April, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by “The Fisheries Conservation Act, 1884” (hereinafter termed “the said Act”), it is, among other things, enacted that the Governor in Council may from time to time make, alter, and revoke regulations for the purposes therein mentioned, which said regulations shall have force and effect only in any waters or places specified therein:

And whereas by Order in Council dated the twenty-seventh day of March, one thousand eight hundred and eighty-five, certain regulations were made, in exercise of the powers conferred by the said Act, prescribing a close season for seals, and extending such close season until the first day of June, one thousand eight hundred and eighty-six:

And whereas by Order in Council dated the first day of June, one thousand eight hundred and eighty-six, a regulation was made further extending such close season for seals until the first day of June, one thousand eight hundred and eighty-seven:

And whereas it is expedient to further extend such close season:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise of the powers conferred on me by the said Act, and by and with the advice and consent of the Executive Council of the said colony, do hereby make the following regulation:—

The close season for seals in the Colony of New Zealand, prescribed and extended by the regulations made under the said Act by Orders in Council bearing date the twenty-seventh day of March, one thousand eight hundred and eighty-five, and the first day of June, one thousand eight hundred and eighty-six, is hereby further extended until the first day of June, one thousand eight hundred and eighty-eight.

Fixing Pilotage, Port Charges, and Harbourmaster's Fees for Kaipara.

ORDER IN COUNCIL.

At the Government House, at Wellington, this nineteenth day of April, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the two hundred and fifteenth section of “The Harbours Act, 1878,” it is, among other things, enacted that every Harbour Board shall have power from time to time, by by-laws, to do the following things for and within the limits of the harbour under the control of such Harbour Board, namely, to fix and authorize the levying of Harbourmasters’ fees and port charges, and to fix and alter pilotage rates:

And whereas by the twelfth section of the said Act it is enacted that in harbours where there is no Harbour Board the Governor in Council shall have all the powers, functions, duties, and authorities by that Act conferred upon Harbour Boards, and may exercise the same in accordance with the said Act:

And whereas there is no Harbour Board for the harbour of Kaipara:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, in pursuance and exercise of the powers and authorities vested in him by the hereinbefore in part recited Act, doth hereby make the following by-law in respect of the harbour of Kaipara:—

BY-LAW.

The Harbourmaster’s fees, port charges, and pilotage rates set forth in the Schedule hereto are hereby fixed and authorized to be levied and taken at the harbour in the said Schedule mentioned, on and after the first day of May, one thousand eight hundred and eighty-seven, all former charges in respect of such harbour for the said purposes being from the said date repealed.

SCHEDULE.
KAIPARA HARBOUR.

Harbourmaster’s Fees:—
For each time the Harbourmaster or his deputy goes on board to appoint the place of anchorage of any vessel, or to remove her from one place of anchorage to another

Port Charges:—
Vessels or boats plying within the port or employed in coasting only, quarterly
Vessels not plying within the port or not employed in coasting only, which employ a pilot, on arrival
Vessels not plying within the port or not employed in coasting only, which do not employ a pilot
Not to exceed 1s. per ton in any one half-year.

Pilotage: Charged both inwards and outwards:—
Sailing-vessels of and under 100 tons
Sailing-vessels over 100 tons, first 100 tons
Sailing-vessels over 100 tons, every ton over 100
Steamers of and under 100 tons
Steamers over 100 tons, first 100 tons
Steamers over 100 tons, every ton over 100

Validating Election of Members of Waitara Harbour Board.

ORDER IN COUNCIL.

At the Government House, at Wellington, this nineteenth day of April, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS it is provided by the two hundred and thirty-third section of “The Harbours Act, 1878” (hereinafter termed “the said Act”), that in any case in which, by any misadventure or accident, anything is at any time done after the time required by the said Act, or is otherwise irregularly done in matter of form, the Governor may, by Order in Council duly gazetted, from time to time make provision for any such case, or may extend the time within which anything is required to be done, or may validate anything so done after the time required or so irregularly done in matter of form, so that the true intent and purpose of the said Act may have effect: And whereas on Monday, the seventh day of March, one thousand eight hundred and eighty-seven, the Town Board of Raleigh elected two members, that is to say, Robert Trimble and John Masey Stapcoole, to be members of the Waitara Harbour Board: And whereas such election should have been held on Monday, the fourteenth day of February, one thousand eight hundred and eighty-seven, that being the second Monday in the month of February, the day fixed by the said Act for the said election: And whereas it is expedient to validate the said election:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice of the Executive Council of the said colony, and in exercise of the powers conferred upon him by the said Act, doth hereby validate the said election, and doth declare that Robert Trimble and
