of all other powers enabling him in that behalf, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby delegate to the Council of the Thames County the powers conferred upon him by section six of “The Cemeteries Act, 1882,” as to the appointment and removal of Trustees for the cemetery described in the Schedule hereto, and known as the Hastings Cemetery; and doth declare that this Order in Council shall take effect as from the first day of May next.

SCHEDULE.

HASTINGS CEMETERY.

ALL that parcel of land in the Provincial District of Auckland, containing by admeasurement 2 acres 3 roods 34 perches, more or less, called or known as the Cemetery Reserve, Hastings, and being Section No. 21A, Block XI., Hastings Survey District, Thames County. Bounded towards the North by a road, 500 links; and towards the East, South, and West by Section No. 21 of the same block, .586, 500, and 600 links.

ORDER IN COUNCIL.

At the Government House, at Wellington, this second day of April, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twenty-second day of April, one thousand eight hundred and eighty-five, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present order, delegate, but only with respect to the piece or parcel of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Kowai Public Domain Board, namely,—

FRANK COURAGE,
SAMUEL COLEMAN,
REGINALD FOSTER,
GEORGE BAYNTON STARKY.

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the first Wednesday in each month, at eleven o’clock a.m., at the office of the Chairman, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Wednesday, the eleventh day of May, one thousand eight hundred and eighty-seven.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting, and no other business than that so specified shall be transacted at such meeting.

  3. Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Monday in December in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be Chairman of such meeting.

  6. If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

SCHEDULE.

ALL that parcel of land in the Provincial District of Canterbury, being Reserve No. 2066 (in red), 213 acres, more or less, situate in the Ashley District (Kowai Road District). Bounded on the South-west by Section No. 19023; on the South-east by the road forming south-east boundary of that section; on the North-east by Reserve No. 1675 (in red); on the North by the road forming the north boundary of Section No. 20597; and on the North-west by Improvement Pre-emption Runs G and H, on Run formerly No. 8, Class III., now No. 299, Class II.

Provisions of “The Public Bodies’ Leaseholds Act, 1886,” modified as regards the Taranaki School Commissioners.

ORDER IN COUNCIL.

At the Government House, at Wellington, this second day of April, 1887.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by an Order in Council dated the twenty-first day of December, one thousand eight hundred and eighty-six, the School Commissioners for the Taranaki Provincial District were declared to be subject to the provisions of “The Public Bodies’ Leaseholds Acts, 1886” (hereinafter called “the said Act”):

And whereas it is expedient that the provisions of Part IV. of “The Land Act, 1885,” should be modified in their application to the said Commissioners and to the reserves vested in them, in manner hereinafter set forth:

Now, therefore, His Excellency Sir William Francis Drummond Jervois, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in pursuance and exercise of the powers and authorities conferred upon him by the fourteenth section of the said Act, doth hereby order and declare that, from and after the date hereof, the provisions of Part IV. of “The Land Act, 1885,” shall be modified as follows in their application to the said School Commissioners and to the reserves vested in them, that is to say: The words “Board of School Commissioners for the Taranaki Provincial District” shall be substituted for the words “Her Majesty;” the words “Treasurer of the Board of School Commissioners for the Taranaki Provincial District” for the words “Receiver of Land Revenue;” and the words “Chairman of the School Commissioners for the Taranaki Provincial District” for the word “Commissioner,” whenever the said words or expressions respectively occur in the said Part IV.

And, further, that, for the purposes aforesaid, sections one hundred and thirty-five, one hundred and thirty-seven, one hundred and forty-two, one hundred and fifty, one hundred and fifty-seven, one hundred and fifty-eight, one hundred and fifty-nine, one hundred and sixty, and one hundred and sixty-one, and the last sentence of section one hundred and forty, beginning with the words “and such lands may be dealt with,” shall be deemed to be omitted from the said Part IV. of “The Land Act, 1885.”
