Application for Registration of Five Trade Marks.

NOTICE is hereby given that EDWARD WATERS, Patent Agent, of Melbourne, in the Colony of Victoria, has applied, on behalf of BATTY AND COMPANY, of 123 and 125, Finsbury Pavement, in the City of London, in England, Pickle and Sauce Makers and Italian Warehousemen, to register, under “The Trade Marks Act, 1866,” the trade marks numbered from 1 to 5, of which the following is a description, viz. :—

Description of Trade Marks.

No. 1 consists of a circular label, in the upper portion of which is the device of a shield bearing the representation of a crown. Beneath the shield is the signature “Batty & Co.,” and the word “London,” the whole being enclosed within a circular border.

No. 2 consists of an oblong label, bearing the representation of a man in a sitting posture, with legs crossed, in the act of eating pickles from a jar. On the jar are the words “Batty’s Nabob Pickles.” On the man’s right hand is a bottle bearing the words “Batty’s Nabob Sauce.”

No. 3 consists of an oblong label, bearing the representation of a man in a sitting posture, with legs crossed, in the act of pouring sauce from a bottle down the throat of a fish. In the right-hand lower corner of the label are two bottles, one bearing the words “Batty’s Nabob Sauce,” and the other bearing the words “Batty’s Nabob Pickles.”

No. 4 consists of the special and distinctive word “Nabob.”

No. 5 consists of an oblong label, divided into three compartments, each compartment having an arched top. In the upper portion of the central and largest compartment is a circle, within which is the device of a shield bearing the representation of a crown. Beneath the shield is the signature “Batty & Co.,” and the word “London.” On the left of the circle are the words “Batty & Co. call special notice to their,” and on the right are the words “Trade mark on each capsule thus.” Beneath the circle is a tablet supported by vertical ornamental pillars, and such tablet is intended for the reception of the name of the article in respect of which the mark is used. Beneath the tablet are the words “Batty & Co., Oil, Italian, & Export Pickle Warehouse, Finsbury Pavement, London”; and in the lower portion of the compartment is the representation of one side of a medal. The compartment on the left bears in its upper part the representation of one side of a medal, enclosed by a circular band bearing the words “Exhibition 1851, Batty & Co.”; and below the same is printed a caution to the public. At the bottom of the compartment is the signature “Batty & Co.” The compartment on the right also bears in its upper part the representation of one side of a medal, enclosed by a circular band bearing the words “For the superiority of their manufactures”; and below the same is printed information as to why the medal was awarded. At the bottom of the compartment is the signature “Batty & Co.”

Applicants desire it to be understood that they do not claim the exclusive use of the medals. Applicants claim the right to use the said trade marks in any colour or combination of colours.

Nature of the Articles to which it is intended such Trade Marks shall apply.

As to Nos. 1, 4, and 5, to all articles of food and ingredients in food.

As to No. 2, to pickles and all other articles of food or ingredients in food.

As to No. 3, to sauces and all other substances used as food or as ingredients in food.

Description of Trade Mark.

The name “Needham.”

Nature of the Articles to which it is intended such Trade Mark shall apply.

Application for Registration of a Trade Mark.

NOTICE is hereby given that EDWARD WATERS, Patent Agent, of Melbourne, in the Colony of Victoria, has applied, on behalf of JOSEPH RODGERS AND SONS, LIMITED, of 6, Norfolk Street, Sheffield, Yorkshire, England, Manufacturers of Cutlery, to register, under “The Trade Marks Act, 1866,” the trade mark of which the following is a description, viz. :—

Description of Trade Mark.

A diamond-shaped label, about the centre of which is the device of a six-pointed star on the left of the device of a Maltese cross; above these devices are the words “Original & genuine,” and below them are the words “Rodgers’ Cutlery;” the whole being enclosed within a diamond-shaped border.

The applicant company claims the right to vary the word “Cutlery” on such label by substituting therefor the name of any other article in respect of which the said trade mark is now sought to be registered.

Nature of the Articles to which it is intended such Trade Mark shall apply.

Unwrought and partly-wrought metals used in manufacture, including steel; instruments, apparatus, and contrivances for surgical or curative purposes, or in relation to health; knives, razors, scissors, and cutlery in general, including edge tools, and all other articles having a cutting edge; and goods of precious metals, including aluminium, nickel, Britannia metal, &c., and imitations of the same; and jewellery, including also Sheffield and other plated goods, and silver plate.

Description of Trade Mark.

The name “Fry.”

Nature of the Articles to which it is intended such Trade Mark shall apply.

Description of Trade Mark.

The representation of a dog’s head. This representation may be used either blown in glass bottles or printed on labels.
