Regulations for Trout-fishing, under “The Salmon and Trout Act, 1867,” Southland District.

IN pursuance of the powers and authorities vested in him by “The Salmon and Trout Act, 1867,” His Excellency the Governor of the Colony of New Zealand doth hereby make the following regulations for that portion of the Provincial District of Otago formerly known as the Province of Southland, and in the waters thereof.

REGULATIONS.

  1. LICENSES to fish for trout in all the waters within and forming the District of Southland, including Mataura River, southern side, will be issued under the hand of the Secretary of the Southland Acclimatisation Society, at Invercargill, and for every such license a fee of ten shillings will be charged: Provided that it shall not be obligatory upon the society to issue a license.

  2. Every such license shall entitle the person named therein to fish in any of the said waters from the first day of October, one thousand eight hundred and eighty-six, to the eleventh day of April, one thousand eight hundred and eighty-seven, inclusive, between the hours of four a.m. and ten p.m. only, but no such license shall confer any right of entry upon the land of any person without his consent.

  3. No person shall fish for, take, catch, or kill, or have in his possession, or attempt to fish for, take, catch, or kill, in any manner whatever, any of the salmonidæ or trout, except during the above-mentioned period.

  4. Every such license shall entitle the person named therein to fish with one rod and line only, and with the following baits: natural or artificial fly, natural or artificial minnow, silveries, bullies, grasshoppers, spiders, caterpillars, creepers, and worms.

  5. No person shall use any other bait, or any method, device, or contrivance of any sort or kind whatever, for the purpose of fishing for, taking, catching, or killing trout, except a rod and line, and a landing net, or gaff, for fish taken with rod and line.

  6. No cross-line fishing, stroke-hauling, or any other unsportsmanlike device shall be used for the purpose of taking, catching, or killing trout, nor shall any of the baits above mentioned be used with any medicated or chemical preparation whatever.

  7. No person shall fish without a license, and every person fishing shall, on demand of any ranger, constable, member of the Acclimatisation Society, or person producing a license, produce and show to such ranger, member, constable, or person his license and the contents of his creel or bag, and the bait used by him for taking, catching, or killing trout.

  8. Every trout not exceeding eight inches in length from nose to tip of tail, taken or caught by any person, shall immediately be returned alive into the water from which the same is taken.

  9. No person shall put, throw, or place, or allow to be put, thrown, or placed, in any of the said waters, any sawdust or sawmill refuse, or anything of any kind or description whatever poisonous, deleterious, or noxious to fish.

  10. No person shall take, fish for, catch, or kill, in any manner whatever, or have in his possession, any salmon, salmon-parr, or smolts, or the ova, young, or fry of any salmon in any stage whatever; and any of the above-named taken by accident or otherwise shall immediately be returned to the water from whence it was taken.

  11. No person shall buy, sell, or expose or offer for sale, within the district to which these regulations relate, any of the salmonidæ or trout, or take, fish for, catch, or kill any of the salmonidæ or trout, in order to make sale of the same, without permission in writing under the hand of the Secretary of the Southland Acclimatisation Society.

  12. No person shall have in his possession any of the salmonidæ or trout between the twelfth day of April and the thirtieth day of September in each year, which period is appointed a close season for all such fish.

  13. The penalty for the breach of any of these regulations shall not be less than forty shillings or more than fifty pounds.

  14. These regulations shall come into force as from the day of the date hereof.

Trustees appointed for the Maintenance of the Addition to the Ahaura Public Cemetery.

IN pursuance and exercise of the powers and authorities vested in me by the sixth section of “The Cemeteries Act, 1882,” I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby appoint the several persons whose names are specified in the first column of the Schedule hereto to be Trustees to provide for the maintenance and care of the public cemetery specified in the second column of the said Schedule, in addition to the cemetery specified in the warrant dated the eleventh day of September, one thousand eight hundred and eighty-three, and published in Gazette No. 93, of the thirteenth day of September, one thousand eight hundred and eighty-three.

Thomas H. Garth. James McLaughlin. George Nottle. James Marshall. AHAURA. All that piece or parcel of land containing by admeasurement 5 acres and 12 perches, be the same more or less, situate in the Land District of Nelson, and bounded as follows: On the Northward partly by Section No. 171, Square No. 122, 1190 links, and partly by a public road, 400 links; on the South-eastward by Section No. 129, Square No. 122, 1830 links; and on the Westward partly by a road reserve on the banks of the Ahaura River, 762 links, and partly by Section No. 171, Square No. 122, 850 links.

As witness the hand of His Excellency the Governor,
this twenty-first day of September, one thousand
eight hundred and eighty-six.

Appointing Commissioners to inquire into the Purchase of certain Land near Auckland for Defence Purposes.

To the Honourable THEODORE MINET HAULTAIN, of Auckland, in the Colony of New Zealand, and formerly a Member of the Executive Council of the said colony; GEORGE WILLIAM HARVEY, of Dunedin, in the said colony, a Barrister of the Supreme Court of New Zealand; and to RICHARD WESTENRA, of Christchurch, in the said colony, Esquire—Greeting:

WHEREAS in or about the month of January, one thousand eight hundred and eighty-six, the Government of New Zealand, on behalf of Her Majesty the Queen, purchased from one Robert Adam Mosley Stark, of Auckland, in the said colony, a piece or parcel of land at the North Shore, near Auckland aforesaid, containing twenty-eight acres and sixteen perches (28a. Or. 16p.) or thereabouts, for the sum of seventeen thousand one hundred pounds (£17,100), such land being so purchased for defence purposes: And whereas it is alleged that the said purchase-money so paid was in excess of the value of the said land, and also that certain irregularities occurred in the mode of conducting and completing the said purchase, and it is expedient that inquiry should be made for the purposes and in the manner hereinafter set forth:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, having confidence in your knowledge, ability, and integrity, do hereby, by and with the advice and consent of the Executive Council of the said colony, appoint you, the said

RICHARD WESTENRA

to be Commissioners, by all lawful ways and means, to inquire into the said purchase of land as aforesaid from the said Robert Adam Mosley Stark, and into all the facts and circumstances connected with or incidental to the said purchase, and the conduct of all and every persons and person concerned in or taking part in the said purchase in any way. And I do direct that such inquiry shall be held at Auckland aforesaid, on such day or days, and at such time or times, and in such place in Auckland aforesaid, as you may think convenient; and that before you commence the said inquiry at least three days’ notice of the day, place, and time on and at which you will be prepared to enter upon the said
