By-laws of the Borough of Winton.

NOTICE is hereby given that at a special meeting of the Council of Winton, held in the Town Clerk’s office, Winton, on Friday, the 30th day of October, 1885, the said Council did adopt the following by-law, made in pursuance of “The Otago Municipal Corporations Ordinance, 1865,” and “The Otago Municipal Corporations Empowering Act, 1865,” under Schedule A.

And, further, that the Council did, by resolution, order and ordain that the following by-laws shall come into operation on the 1st day of February, 1886, and the by-laws shall be enforced as from and after the 1st day of February, 1886.

BY-LAWS OF THE CORPORATION OF WINTON.

The following by-law has been adopted in terms of sections 38, 39, and 40 of “The Otago Municipal Corporations Empowering Act, 1865:”—

A by-law to provide for the better rule and government of the Town of Winton.

In pursuance of the powers contained in sections above named, the Council of the Town of Winton ordains as follows, that is to say, any person guilty of any of the following offences, omissions, or neglects, numbered 1 to 32 inclusive, within the Town of Winton shall, on being convicted of any such offence, neglect, or omission, be liable to pay any penalty not exceeding £5:—

  1. Throwing any glass, dirt, filth, nightsoil, rubbish, or other matter of a similar nature upon any street, footway, court, alley, or public place whatever.

  2. Riding, driving, leading, or wheeling any barrow, cart, dray, or carriage upon or along any footpath without permission from the Town Council.

  3. Placing any timber, bricks, stone, or other building-materials upon any footway, channel, surface-drain, or carriage-road without such permission as aforesaid.

  4. Burning any shavings, straw, or other materials or matter upon any footway, carriage-road, or open or public place, or setting fire to any bush or scrub, without such permission as aforesaid.

  5. Leaving any inflammable materials or matter upon any public shed or place, or on any open space near any building, without such permission as aforesaid.

  6. Drawing or trailing any sledge, timber, or other material upon any footway or carriage-road, to the injury of such footway or carriage-road.

  7. Placing any placard or other document on, or writing or painting on, or otherwise defacing any house or building, or any wall, fence, lamp-post, telegraph-post, or gate, without the consent of the occupier or owner thereof.

  8. Opening any drain or sewer, or removing the surface of any footway or carriage-road, without authority from the Council to do so.

  9. Neglecting to clear any private yardway, passage, or avenue, by which neglect a nuisance by offensive smell or otherwise is caused.

  10. Breaking-in any horse, or playing any game, to the annoyance of any person, in any public place, or obstructing any footpath or carriage-road, whether by allowing any cart or animal to remain across such footpath or carriage-road, or by placing goods thereon or otherwise.
