Notice of Intention to change the Purpose of a Portion of a Reserve.

WHEREAS by “The Public Reserves Act, 1881,” it is, amongst other things, enacted that the Governor may declare his intention to make, change, exchange, or alter the dedication of any public reserve now or hereafter vested in Her Majesty or the Governor for any of the purposes named in Class II. of the Schedule to the said Act, whether the same be granted or not; and, in the case of any reserves made under the authority of section one hundred and forty-four of “The Land Act, 1877,” if it shall, in the opinion of the Governor, be expedient to change the purpose of such reserves or any part thereof from the purpose or presumed purpose for which it was set apart to any other purpose, or if it shall, in the opinion of the Governor, be expedient to exchange any of the land comprised in such reserve for other land of equal value, to be dedicated to one or more purposes named in the said Class II., the Governor may, by notice in the Gazette, declare his intention to make such change, exchange, or dedication, as the case may be, and in such notice declare the manner and terms in which the same is intended to be so made:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby, in exercise and pursuance of the powers and authorities vested in me by “The Public Reserves Act, 1881,” aforesaid, declare my intention to change the specific purpose of a portion of the reserve described in the first column of the Schedule hereto, the area of which is described in the second column of the said Schedule, to the specific purpose set opposite such description in the third column of the said Schedule.


SCHEDULE.

Description and Purpose of Original Reserve. Portion of which the Purpose is intended to be changed. Intended Purpose.
All that parcel of land in the Township of Cobden, Provincial District of Nelson, containing 2 acres, more or less. Bounded towards the North by Fox Street, 500 links; towards the East by Newcastle Street, 400 links; towards the South by Bright Street, 500 links; and towards the West by Sturge Street, 500 links. Reserved by Order in Council issued on the 7th January, 1869, for a site for public buildings or other purposes of the General Government. All that parcel of land in the Township of Cobden, Provincial District of Nelson, containing 32 perches, more or less. Bounded on the North-eastward by Section No. 175, Fox Street, 100 links; on the South-eastward by Section No. 31, Bright Street, 200 links; on the South-westward by Bright Street, 100 links; and on the North-westward by Section No. 33, Bright Street, 200 links. For a site for a library.

As witness the hand of His Excellency the Governor, this sixth day of May, one thousand eight hundred and eighty-six.

Regulations under “The Land Act, 1885,” amending the Form of Lease of Small Grazing Runs.

IN pursuance and exercise of the powers and authorities conferred upon me by the two hundred and third section of “The Land Act, 1885,” and of all other powers enabling me in that behalf, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby revoke the warrant issued on the eighth day of March, one thousand eight hundred and eighty-six, and the form of lease thereby prescribed, and in lieu thereof do hereby prescribe that the form of lease to be issued for small grazing runs shall be that set forth in the Schedule hereto.


SCHEDULE.

NEW ZEALAND.

LEASE OF SMALL GRAZING RUN.

THIS deed, made the day of , 18 , between the Land Board of the Land District (herein referred to as “the lessor”), of the one part, and , of , in the Provincial District of , (who with executors, administrators, and assigns hereinafter referred to as “the lessee”), of the other part, Witnesseth that, in consideration of the rents, covenants, conditions, and agreements hereinafter reserved and contained and implied, and on the part of the said lessee to be paid, observed, and performed, the said lessor doth hereby demise and lease unto the said lessee All that area of Crown lands containing by estimation acres, more or less, and being Run No. , in the Provincial District of , in New Zealand, as the said land is delineated on the plan in the Crown Lands Office at , and also on the plan drawn in the margin hereof and bordered ; together with all rights, easements, and appurtenances to the said land belonging or appertaining: To hold the same as a small grazing run for pastoral purposes unto the said lessee for the term of twenty-one years, computed from the day of , 18 , subject to the several provisions of “The Land Act, 1885,” relating to small grazing runs, and yielding and paying therefor unto the lessor, during the continuance of such term, the annual rent, of £ , by equal half-yearly payments, in advance, on the first day of March and the first day of September in each year, clear of all rates, taxes, and deductions whatsoever. The first of such payments having been made, the next to become due and be made on the day of next. And the said lessee doth hereby, for heirs, executors, administrators, and assigns, covenant with the lessor that , the said lessee, shall and will pay the yearly rent of £ , hereinbefore reserved, at the times and in manner aforesaid, and will, in relation to the terms hereby demised, perform, observe, and keep the several covenants, stipulations, and conditions contained in “The Land Act, 1885,” and on the said lessee part to be performed, observed, and kept respectively; and will in all respects abide by and conform to the provisions of the said Act relative to small grazing runs.

In witness whereof the Commissioner of Crown Lands for the Land District of , for and on behalf of the Land Board of the said district, and the said lessee hereunto set their hands, the day and year first above written.
