Extending Time for Preparation of Burgess Roll, Borough of Tauranga.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twentieth day of April, 1886.

Present:

THE HONOURABLE THE COLONIAL TREASURER PRESIDING IN COUNCIL.

WHEREAS it has been made to appear that certain things required to be done by “The Municipal Corporations Act, 1876,” in connection with the making and revision of the burgess lists or rolls of the Borough of Tauranga, cannot be done by or within the time required by the said Act:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities vested in him by the twelfth section of the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby extend the time for the doing of the said things in connection with the burgess lists or rolls of the said Borough of Tauranga, and doth declare that the time for the doing of such several things shall be those which are specified in the Schedule hereto.

SCHEDULE.

  1. For making out the burgess list: On or before the 23rd April, 1886.

  2. Public notification of the burgess list, and the defaulters’ list being ready for inspection: On or before the 24th April, 1886.

  3. Burgess and defaulters’ list open for inspection, and delivery of objections thereto: Until the 10th May, 1886.

  4. Inspection of list of objections: From the 10th May to the 15th May, 1886.

  5. Sitting of Council to determine claims and objections: Between the 15th May and the 24th May, 1886.

  6. Burgess roll to come into force: On the 1st June, 1886.

THE HONOURABLE THE COLONIAL TREASURER PRESIDING IN COUNCIL.

WHEREAS a petition in terms of section forty-three of “The Hospitals and Charitable Institutions Act, 1885,” has been presented to His Excellency the Governor of the Colony of New Zealand from not less than fifty of the contributors to the North Wairarapa Benevolent Society, praying that the said society may be incorporated as a separate institution under the said Act:

And whereas the substance of the said petition was gazetted on the eighteenth day of March, one thousand eight hundred and eighty-six, and no counter-petition has been received by the Colonial Secretary, or objection lodged with him by the District Board, within one month from the date of such publication:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise and in pursuance of the powers and authorities vested in him by “The Hospitals and Charitable Institutions Act, 1885,” doth hereby declare the contributors for the time being to the said society to be a body politic and corporate, by the style and title of “The North Wairarapa Benevolent Society Contributors.”

Extending Close Season for Rock-oysters in Hauraki Gulf, &c.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fifth day of May, 1886.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by “The Fisheries Conservation Act, 1884” (hereinafter termed “the said Act”), it is, among other things, enacted that the Governor in Council may from time to time make, alter, and revoke regulations for the purposes therein mentioned, which said regulations shall have force and effect only in any waters or places specified therein:

And whereas by Orders in Council dated the twenty-seventh day of March, the seventeenth day of September, and the second day of June, one thousand eight hundred and eighty-five, and the twenty-fifth day of March, one thousand eight hundred and eighty-six, certain regulations were made in exercise of the powers conferred by the said Act, prescribing a close season for rock-oysters:

And whereas certain doubts having arisen as to the situation of the River Waikawau, referred to in the last-recited Order in Council, it is advisable to repeal the same, and to make fresh regulations in lieu thereof:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise of the powers conferred on me by the said Act, and by and with the advice and consent of the Executive Council of the said colony, do hereby repeal the above-recited Order in Council dated the twenty-fifth day of March, one thousand eight hundred and eighty-six, and in lieu thereof do hereby make the regulations hereinafter set forth: Provided however that the revocation herein contained shall not invalidate or in any way prejudice any proceedings that may have been heretofore commenced under the authority of the said recited Order in Council, but such proceedings may be carried on and concluded as if this order had not been made.

REGULATIONS.

The close season for rock-oysters prescribed by the regulations made under the said Act by Order in Council bearing date the twenty-seventh day of March, one thousand eight hundred and eighty-five, is hereby declared to commence from the date hereof, and is also extended, as also the operation of the said recited regulations, until the thirty-first day of March, one thousand eight hundred and eighty-nine, in respect of the foreshore of the coast in Hauraki Gulf and Frith of Thames within a line drawn from Point Rodney to the mouth of the Waikawhau River, situated on the west coast of the Coromandel Peninsula, and which river forms one of the boundaries of the County of Coromandel, and also in respect of the foreshores of all islands in that portion of the Hauraki Gulf and the Frith of Thames lying to the southward and westward of a line drawn from Point Rodney to Cape Colville, and also in respect of the foreshores of the coast and all islands adjacent thereto between Ngatoka Rarangui Point on the north, and Bream Head on the south.

Any person committing a breach of the above regulation shall be liable to a penalty of not less than one pound and not exceeding fifty pounds.

Regulations for the Formation of Village Special Settlements on Perpetual Leasing.

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixth day of May, 1886.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the one hundred and sixty-third section of “The Land Act, 1885,” it is enacted that the Governor in Council may from time to time make, alter, and repeal regulations for fixing the terms and conditions upon which the lands in any special settlement shall be disposed of, and the mode of payment for the same:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred upon me by the hereinbefore in part recited Act, and by and with the advice and consent of the Executive Council of the said colony, do hereby fix the following terms and conditions as those upon which village special-settlement blocks shall be disposed of on perpetual leasing, and the mode of payment for the same.

REGULATIONS.

  1. The land to be selected under these regulations shall be held on perpetual lease for the first term of thirty years, and for subsequent terms of twenty-one years, without any right of acquiring the freehold.

  2. The rental shall be based on the capital value of the land, which shall in no case be less than 20s. an acre.

  3. No charge will be made for the lease, which shall be in the form in the Schedule hereto, beyond the sum of 10s. for registering the same in the Land Transfer Department.
