particulars in reference thereto as may be required by the Marine Department.

  1. That nothing herein contained shall authorize the said Council to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs, or any regulation of the Commissioner of Trade and Customs, or with any provisions of “The Harbours Act, 1878,” or its amendments, or any regulations thereunder.

  2. That the rights, powers, and privileges conferred by this Order in Council shall continue in force for fourteen years, computed from the date of this Order in Council, unless in the meantime altered, modified, or revoked.

  3. That the rights, powers, and privileges conferred under or by virtue of this Order in Council may be at any time resumed by the Governor on giving to the said Council six calendar months’ previous notice in writing. Any such notice shall be sufficient if given by the Governor, or the Minister having charge of the Marine Department, or any person acting under his or their instructions, and delivered at or posted to the last known address of the said Council, their successors, administrators, or assigns. No compensation or allowance shall be payable in such case.

Regulation under “The Fisheries Conservation Act, 1884.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this sixteenth day of April, 1886.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS it is provided by “The Fisheries Conservation Act, 1884” (hereinafter termed “the said Act”), that the Governor in Council may from time to time make, alter, and revoke regulations which shall have force and effect only in any waters or places specified therein, for, among other things, prohibiting the use of any particular engines, tackle, or apparatus for taking any fish or oysters: And whereas it is expedient to prohibit the use of certain apparatus for taking the oysters known as rock-oysters:

Now, therefore, His Excellency William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities vested in him by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulation for the purposes aforesaid, that is to say,—

No spade or other apparatus for taking rock-oysters shall be used of which the edge or blade shall exceed two inches in width.

Any person committing a breach of the above regulation shall be liable to a penalty of not less than one pound and not exceeding fifty pounds.

And, with the like advice and consent, it is hereby ordered and declared that the said regulation shall apply to the whole colony, and shall take effect on and after the twenty-sixth day of April, one thousand eight hundred and eighty-six.

Vesting a Reserve in the Education Board of Wellington.

IN pursuance and exercise of the powers and authorities conferred upon me by “The Special Powers and Contracts Act, 1885,” I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby vest in the Education Board of the District of Wellington, as a site for an office for the said Board, all that parcel of land, containing 15·3 perches, more or less, being Section No. 3, Block III., on the plan of the Thorndon reclaimed land, Wellington, upon the condition that if the said land is not occupied for the purpose for which it is vested within a period of five years it shall revert to the Crown.

As witness the hand of His Excellency the Governor, this nineteenth day of April, one thousand eight hundred and eighty-six.

Fixing Shooting Season for Native and Imported Game, License Fee, &c., Hawera District.

IN exercise of the powers vested in me by “The Animals Protection Act, 1880,” and the Acts amending the same, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby notify that cock-pheasants, quail, and hares may be taken or killed within the Hawera District, comprising the Counties of Hawera and Patea, from the first day of May, one thousand eight hundred and eighty-six, to the thirty-first day of July, one thousand eight hundred and eighty-six, both inclusive (subject nevertheless to the restrictions in the said Acts mentioned). And I do further notify that licenses to take or kill such game within the said district shall be issued on payment of the sum of twenty shillings each, and that licenses to sell such game shall be issued on payment of the sum of five pounds each; and the Postmaster at Hawera is hereby appointed to issue the said licenses. And I do further notify that native game (excepting tuis) may be taken or killed within the said district from the first day of April, one thousand eight hundred and eighty-six, to the thirty-first day of July, one thousand eight hundred and eighty-six, both inclusive.

As witness the hand of His Excellency the Governor, this nineteenth day of April, one thousand eight hundred and eighty-six.

County of Patangata included in Hawke’s Bay District for the Purposes of the Animals Protection Acts.

WHEREAS by a warrant made under “The Animals Protection Act, 1880,” and the Acts amending the same, and dated the twenty-ninth day of March, one thousand eight hundred and eighty-six, the Hawke’s Bay District was defined as comprising the Counties of Hawke’s Bay, Waipawa, and Wairoa: And whereas it is expedient that the County of Patangata should be included in the said district:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in exercise of the powers vested in me by the said Acts, do hereby notify that the Hawke’s Bay District shall comprise the Counties of Hawke’s Bay, Waipawa, Wairoa, and Patangata.

As witness the hand of His Excellency the Governor, this nineteenth day of April, one thousand eight hundred and eighty-six.

IN exercise of the powers vested in me by “The Animals Protection Act, 1880,” and the Acts amending the same, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, do hereby declare that cock-pheasants and Californian quail may be taken or killed within the Marlborough District, consisting of the Counties of Marlborough and Sounds, excepting the area described in the Second Schedule hereto, from the first day of June, one thousand eight hundred and eighty-six, to the thirtieth day of June, one thousand eight hundred and eighty-six, both inclusive. And I do further notify that licenses to take or kill such game within the said district shall be issued on payment of the sum of one pound each, and that licenses to sell such game shall be issued on payment of the sum of five pounds each; and that the Chief Postmaster at Blenheim is hereby appointed to issue the said licenses.

And I do further notify that native game mentioned in the First Schedule hereto may be taken or killed within the said district during the period between the first day of April, one thousand eight hundred and eighty-six, and the thirtieth day of June, one thousand eight hundred and eighty-six, both inclusive; and that native pigeons may be taken or killed within the said district from the first day of June, one thousand eight hundred and eighty-six, to the thirty-first day of July, one thousand eight hundred and eighty-six, both inclusive.

FIRST SCHEDULE.

Wild duck of any species, bittern, pied stilt plover, wild geese, dotterel, teal, black stilt plover, curlew, quail.

SECOND SCHEDULE.

DISTRICT IN WHICH NATIVE AND IMPORTED GAME MAY NOT BE TAKEN OR KILLED.

ALL that portion of the Counties of Marlborough and Sounds known as the Wairau Lagoons. Bounded generally on the West by the Wairau River to the confluence of the Opawa, and by that river to Morgan’s Creek; thence by Morgan’s Creek and Sections Nos. 22, 21, and 20 to the north-west
