Making Rules for District Courts under “Imprisonment for
Debt Abolition Act, 1874.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this sixteenth
day of April, 1886.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

WHEREAS by “The Imprisonment for Debt Abolition
Act, 1874” (hereinafter referred to as “the said Act”),
it is enacted that in the said Act the term “prescribed”
means, as respects the District Courts, prescribed by general
rules to be made under “The District Courts Act Amend-
ment Act, 1865,” or any Acts amending the same; and it is
also by the said Act provided that general rules and orders
may, as respects such District Courts, be made by the
Governor for the purpose of carrying the said Act into effect:
And whereas by “The District Courts Act Amendment
Act, 1865,” it is provided that it shall be lawful for the
Governor in Council, with the concurrence of one of the
Judges of the Supreme Court, to frame general rules and
orders for regulating the practice of the said Courts and the
form of proceedings therein, and from time to time to
rescind, suspend, alter, or amend all rules, orders, and forms
now framed or hereafter to be framed, or any of them or any
part thereof, and such original or amended rules, orders, and
forms, or any rules rescinding the same or any of them,
shall be in force in any District Court respectively from a
day to be fixed by the said Governor in Council:
And whereas by an Order in Council bearing date the fifth
day of January, one thousand eight hundred and seventy-five,
certain general rules and orders were made and fees pre-
scribed to be taken in District Courts under the said Act,
and it is advisable to rescind one of the said rules and to
make another rule in lieu thereof:
Now, therefore, I, William Francis Drummond Jervois,
the Governor of the Colony of New Zealand, in pursuance
and exercise of the powers and authority conferred upon me
by the hereinbefore recited Acts, and by and with the advice
and consent of the Executive Council of the said colony,
and with the concurrence of Sir James Prendergast, Chief
Justice of the Supreme Court, do hereby rescind number
twenty-five of the said rules, and the table of fees prescribed
by the said recited Order in Council, and, in lieu thereof
respectively, do hereby make the rule and prescribe the fees
set forth in the Schedules hereto, and do order that the same
shall come into force on and after the tenth day of May, one
thousand eight hundred and eighty-six.

FIRST SCHEDULE.

  1. The costs which shall be payable for proceedings under
    the said Act shall be the fees specified in the Second
    Schedule hereto, and such fees shall be deemed to be the
    prescribed costs referred to in section 13 of the said Act.

Delegating Powers under “The Cemeteries Act, 1885,” to
the Southland County Council.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this sixteenth
day of April, 1886.

Present:

THE HONOURABLE THE PREMIER PRESIDING IN COUNCIL.

IN exercise and pursuance of the powers vested in him by
“The Cemeteries Act 1882 Amendment Act, 1885,” and
of all other powers enabling him in that behalf, His
Excellency Sir William Francis Drummond Jervois, the
Governor of the Colony of New Zealand, by and with the
advice and consent of the Executive Council of the said
colony, doth hereby delegate to the Council of the County
of Southland the powers conferred upon him by section six
of “The Cemeteries Act, 1882,” as to the appointment and
removal of Trustees for the cemeteries described in the
Schedule hereto; and doth declare that this Order in
Council shall take effect as from the seventh day of May
next.

SCHEDULE.

LONGBUSH TOWNSHIP.

All that piece or parcel of land in the Southland Land Dis-
trict, containing 3 acres 2 roods 24 perches, more or less,
being section 30 on the map of the Longbush Township.
Bounded towards the North by a public road, 676 links; on
the East by Section No. 29 of said township, 349 links;
towards the South-east boundary of the said township, 700
links; and on the West by Section No. 31 of the said town-
ship, 775 links: be all the aforesaid linkages more or less;
as the same is delineated on the map in the Survey Office,
Invercargill.

TOWNSHIP OF GORE.

All that parcel of land in the Provincial District of Otago,
being Sections Nos. 57 and 58, Block XVI., Township of West
Gore, containing by admeasurement 4 acres 3 roods 6 perches
and 3 acres 3 roods 38 perches respectively, more or less, as
the same is delineated on the plan deposited in the Survey
Office, Invercargill.

ATHOL TOWN.

All that parcel of land in the Southland Land District,
being Section No. 1, Block IV., containing 2 acres, more or
less.

All that parcel of land in the Southland Land District
containing by admeasurement 8 acres, more or less, being
Sections Nos. 1 and 2, Block XXXIII., Township of Athol.
Bounded towards the South-east by Albion Street, 400 links;
towards the South-west by Carlisle Street, 2000 links;
towards the North-west by Clyde Street, 400 links; and
towards the North-east by north-east boundary of township,
2000 links: be all the aforesaid linkages more or less.

NEW RIVER HUNDRED.

All that parcel of land in the Southland Land District,
being Section No. 66, Block XVI., containing 5 acres, more
or less, and Section No. 59, Block XVI., containing 2 roods,
more or less.

CAMPBELLTOWN.

All that parcel of land situated in Block I. of the Camp-
belltown Hundred, in the Southland Land District, con-
taining by admeasurement 12 acres and 25 perches, more
or less, and known as the Cemetery Reserve. Bounded
towards the North by Section No. 15 of said block, 1461
links, by a public road, 100 links, and by Section No. 14 of
said block, 178 links; towards the South-east by Section
No. 14 aforesaid, 1794 links; and towards the West and
South-west by a public road, 1040 and 1030 links.

DIPTON.

All that piece or parcel of land in the Southland Land
District containing, exclusive of water-race, 5 acres and 12
perches, more or less, being part of Section No. 104, Taringa-
tura District, and bounded as follows, namely: commencing
at the southern boundary of said Section No. 104, 1502 links,
due east of the south-eastern angle of Section No. 133;
thence by a line bearing 5° 49′, a distance of 1005 links;
thence by a line running 488 links, bearing due east; thence
by a line running 1000 links, bearing due south; thence by
a line running 589½ links, bearing due west, to starting-point:
be the aforesaid linkages more or less.

WINTON HUNDRED.

All that piece or parcel of land in the Southland Land
District, being Section No. 41a, Block II., containing 20
acres 3 roods 38 perches, more or less.
