Regulations for a Special Settlement to be formed by Members of the Police and Armed Constabulary Force.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-third day of March, 1886.

Present:

His Excellency the Governor in Council.

WHEREAS by the one hundred and sixty-third section of “The Land Act, 1885,” it is enacted that the Governor in Council may from time to time make, alter, and repeal regulations for fixing the terms and conditions upon which the lands in any special settlement shall be disposed of, and the mode of payment for the same:

And whereas it is desirable to make regulations for the occupation of the block of land set apart by Proclamation dated the first day of January, one thousand eight hundred and eighty-six, in terms of the one hundred and sixty-second section of the said Act, as a special settlement for non-commissioned officers and members of the Police and Armed Constabulary Force who may retire for the purpose of settling thereon, or who may have been discharged on reduction of that force since the first day of January, one thousand eight hundred and eighty-two, or who, with permission of the Defence Minister, are permitted to continue to serve, with the intention of settling thereon:

And whereas it is desirable to revoke the regulations which were made by Order in Council issued on the twenty-ninth day of December, one thousand eight hundred and eighty-five, and to make new regulations in lieu thereof:

Now, therefore, I, William Francis Drummond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred upon me by the hereinbefore in part recited Act, and by and with the advice and consent of the Executive Council of the said colony, do hereby revoke the Order in Council of the said twenty-ninth day of December, one thousand eight hundred and eighty-five, and do hereby fix the following terms and conditions as those upon which the special-settlement block shall be disposed of to members of the said force, and the mode of payment for the same,

REGULATIONS.

  1. In the construction of these regulations, unless the context shall otherwise require, the following expressions shall have the meanings hereby assigned to them:—

“Land” shall mean the block of land set apart for a special settlement for occupation under these regulations:

“Settler” shall mean any member of the Police or Armed Constabulary Force who may lease land under these regulations:

“Minister” shall mean the Minister of Lands for the time being, or any member of the Executive acting for him:

“Commissioner” means the Commissioner of Crown Lands for the land district.

  1. The allotments shall not exceed 200 acres each, and shall be held exclusively on perpetual lease.

  2. All surveys shall be executed at the cost of the Government.

  3. Such portions of the land as may be required for the purposes of the Government of the colony, or for educational, recreation, or other public purposes, and as shall be approved by the Minister, shall not be open for allotment under these regulations.

  4. The allotment of sections shall be made according to priority of application to the Commissioner. Should more than one application be made for the same section on the same day, the right to occupy the same shall be determined by lot amongst the applicants.

  5. Every lease shall be for a term fixed so as to expire on the thirtieth day of June which shall first ensue after the expiration of thirty years from the date of the commencement of the term, and shall be renewable from time to time as provided by “The Land Act, 1885,” without right to the settler to acquire the freehold.

The lessee shall pay the rent reserved by his lease to the Receiver of Land Revenue of the district wherein the land leased by him is situate, by equal half-yearly instalments, in advance, on the first day of the months of January and July in each year; and the half-year’s rent, which must be paid at the time of tendering, shall be in discharge of the half-year’s rent due on the first day of January or the first day of July which shall first ensue after the commencement of the term,
